Preston Howard, Jr., P.E., Director March 21, 1995 Pender County DEM Project # 95141 APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS Mr. Nathan Riverbark 1430 New Savannah Road Burgaw, N.C. 28425 Dear Mr. Riverbark: You have our approval to place fill material in 2.41 acres of wetlands or waters for the purpose of creating a parking and turn-around area for hunting and dog training at SR 1209 and SR 1332, as you described in your application dated 7 February 1995. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2671. This certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. Applicant shall contact Ms. Linda Lewis of Wilmington Regional Office to get stormwater management approval (910-395-3900). In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask for a hearing. This fill will be used for access to the tract for hunting purposes. The tract is located on the east side of NCSR 1332, 114 mile south of its intersection with NCSR 1209, in Pender County, northwest of Burgaw. The tract contains approximately 183 acres which is all classified as 404 Wetlands. The entire tract is three-year old, cutover land with FACW or OBL vegetation re-emerging. The owners would like to fence the tract for fox-hunting but would need access and off- road parking for vehicles. Their plan is to put the parking/turn-around area far enough into the tract to give good access to interior portions of the tract. The Wetlands present are considered pocosins and should rate fairly low scores on the Wetland rating system. The owners feel that since the entire tract is wet and of "low" value and trying to assemble vehicles, dogs and human along the state road would be a safety hazard this permit should be granted. I have spoken with the Corps about examining this portion of the tract and not flagging the entire tract due to the wet nature of the tract. They have give tentative agreement to not requiring a flagged, surveyed delineation before permitting this area.
