After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Numbers 2732 and 2671. These certifications allow you to use Nationwide Permit Numbers 14 and 26 when they are issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local pen-nits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. Assistant Director DATE: January 10, 1995 SUBJECT: Land Management Group, Inc. 401 Water Quality Certification for commercial lot development in 404 wetlands, on HWY 133 just south of its intersection with HWY 211 near Southport, Brunswick County, North Carolina. DEM ID: 941116. Staff biologists with the Wildlife Resources Commission have reviewed the subject permit application. A site visit was made on January 4, 1995. Our comments are provided in accordance with provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et. seq.), and section 401(b) of the Clean Water Act of 1977 (as amended), and North Carolina General Statutes (G.S. 113-131 et seq.). The applicant has applied for a Water Quality Certification to fill 0.47 acre of isolated wetlands vegetated with wax myrtle, red bay, loblolly pine, greenbriar and switch cane to facilitate construction of a restaurant. A larger portion of this wetland pocket, approximately 2 acres, has already been permitted and filling activity was underway at the time of our site visit. Despite its small size, this wetland provides good wildlife habitat. Small mammal trails traverse the property and several pools of standing water offer excellent amphibian habitat. Remains of a snake carcass were observed arranged in such a way as to indicate raptor predation and a woodcock was flushed. The wetland serves to retain and filter stormwater runoff from adjacent parking lots. Due to the direct, unmitigated loss of wildlife habitat and stormwater retention capacity, we find the proposal inconsistent with our Policies and Guidelines for Conservation of Wetland and DEM ID: 941116 2 January 10, 1995 Aquatic Habitats. It is the policy of this agency to oppose projects which "displace, damage, or modify wetland values and functions". We also believe that this project is inconsistent with the Environmental Protection Agency's Section 404(b)(1) guidelines in that the project does not constitute a water dependent activity. Due to these factors, we request that a 401 Water Quality Certification not be issued. Modification of the project to avoid or minimize wetland impacts would result in a more favorable review by this agency. Thank you for the opportunity to comment on this project.
