After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2733. This certification allows you to use Nationwide Permit Number 18 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days,of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. PROTECT DESCRIPTION 10/25/95 Figure 8 Island is the first barrier island north of Wrightsville Beach in New Hanover County. This is a private island developed residentially with the exception of the community marina and clubhouse. The project site lies adjacent to the first lagoon to the south of the causeway. The site, #1 Beach Bay Lane is a vacant lot with a sand and shell substrate (created in part by the original excavation of this basin), vegetated predominantly with Sea Oats. S artina alterniflora borders the property at the basin, and S artina 12atens and Borrichia frutescens extend deep into the lot. Bank's Channel is classified SA-ORW by the Division of Environmental Management; the area is designated Primary Nursery by the Division of Marine Fisheries, and is open to the taking of shellfish. The New Hanover County Land Use Plan classifies the area as Conservation. The applicant had a joint "404" and coastal wetland line delineated by the US Army Corps of Engineers and the Division of Coastal Management. This line was surveyed for lots 1, 3, and 5. At the southeast side of lot 1, there is a wetland finger extending approximately 42' into the property. This finger averages 12' in width. This high marsh area has crab holes scattered sporadically through it. The three property owners have jointly received a General Permit (#13283-D) for a bulkhead to be constructed along the delineated wetland line. The individual application addressed in this report is submitted by the owner of lot 1 requesting to continue the bulkhead across the wetland finger rather than around it. The bulkhead wall requested is 16' in length, and removes from jurisdiction approximately 504 square feet of mixed high marsh. The wall is expected to be constructed 3' above substrate level, and the backfill graded to meet the existing lot elevation. Approximately 37 cubic yards of fill material purchased from a high ground source are anticipated to be used. The new wall would tie into the existing bulkhead to the south. 10. ANTICIPATED DvIPACTS The project as proposed would fill and remove from jurisdiction approximately 504 square feet of mixed high marsh. The applicant had a joint "404" and coastal wetland line delineated by the US Army Corps of Engineers and the Division of Coastal Management. This line was surveyed for lots 1, 3, and 5. At the southeast side of lot 1, there is a wetland finger extending approximately 42' into the property. This finger averages 12' in width. This high marsh area has crab holes scattered sporadically through it. The three property owners have jointly received a General Permit (#13283-D) for a bulkhead to be constructed along the delineated wetland line. The individual application addressed in this report is submitted by the owner of lot 1 requesting to continue the bulkhead across the wetland finger rather than around it. The bulkhead wall requested is 16' in length, and removes from jurisdiction approximately 504 square feet of mixed high marsh. The wall is expected to be constructed 3' above substrate level, and the backfill graded to meet the existing lot elevation. Approximately 37 cubic yards of fill material purchased from a high ground source are anticipated to be used. The new wall would tie into the existing bulkhead to the south. 10.
