Dear Mr. Parker:
You have our approval to discharge decant from an upland diked disposal basin into waters of the
AIWW , as you described in your application dated 9 October 1995. After reviewing your application,
we have decided that this fill is covered by General Water Quality Certification Number 3025.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification.
Applicant shall notify the NC Division of Shellfish Sanitation Section Environmental Health, at least
10 days in advance of the dredging to allow a temporary closure of this area. In addition, you should
get any other federal, state or local permits before you go ahead with your project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401

This letter is in response to your letter of November 6, 1995,
regarding the maintenance dredging project for which we are
requesting a permit. To summarize the project, we propose to use a
hydraulic dredge to remove approximately 2000 cubic yards of mud and
sand from our existing small boat canal. Over the years, shallow
areas have accumulated which impede low-tide boat movement and
diminish the natural tidal flushing which such a canal requires.
The material removed would be deposited in a diked disposal area
located on a privately owned island east of the AIWW. The disposal
area is located approximately 950 feet from the mouth of the canal.
This project is located in a highly developed residential area with
extensive areas of marshland sprinkled throughout. There is simply
no upland location within a reasonable distance which would be
available for the deposit of dredging materials.
We have been informed that there is a possible disposal area
near Bradley Creek which is adjacent to closed shellfish waters. We
have been advised that it would not be feasible to use this disposal
area because a pipe run of over 5000 feet would be required. A pipe
run of this length, along with the required booster pumps, would make
the project prohibitively expensive.
As to the use of a dredging method other than hydraulic
dredging, we explored the feasibility of using a clamshell device in
conjunction with transfer barges. For the amount of material we are
considering, we again have an alternative that would not only be too
costly, but would require an inordinate amount of time to complete.

The Division of Environmental Management, Water Quality Section has reviewed your plans located at
Shinn Creek to the AIWW in New Hanover County. Based on this review, we have identified significant uses
which would be removed by this project. These uses are commercial shellfishing in the area of the discharge
from the upland diked disposal basin. Furthermore, insufficient evidence is present in our files to conclude that
your project must be conducted as planned in waters and/or wetlands. Therefore, we are moving toward denial
of your 401 Certification as required by 15A NCAC 2B.0109. Until we receive additional information, we are
requesting (by copy of this letter) that the U.S. Army Corps of Engineers and/or the N.C. Division of Coastal
Management place your project on administrative hold.
Please provide us with information supporting your position that your project must be constructed as
planned and that you have no practicable alternative to your dredging. Specifically can you:
1. Conduct the dredging rather than hydraulic dredge, or
2. Pump the hydraulically dredged material to an upland diked disposal area within the
Wrightsville Restricted area or
3. Pump the effluent from the basin back to the area being dredged
on nearby uplands or prior converted farmland? Any documentation such as maps and narrative that you can
supply to address alternative designs for your project may be helpful in our review of your 401 Certification.
Please respond within two weeks of the date of this letter by sending a copy of this information to me and one
copy to our Mr. Jim Gregson at the Wilmington Regional Office at 127 Cardinal Drive Extension, Wilmington ,

The project has been reviewed to determine impacts to water quality. The following
comments have been provided.
The waters of the Shinn Point Canal are closed to the harvesting of shellfish by the
Division of Marine Fisheries. The spoil material generated from the maintenance of the canal
will be pumped hydraulically from these closed waters to an existing diked disposal area across
the AIWW from the project site. Discussions with CAMA and DMF indicate that the waters
adjacent to this disposal area are open to the harvesting of shellfish. The discharge of water
from closed shellfish waters into open shellfish waters would likely result in a violation of water
quality standards for fecal coliform and potentially a closure of the waters to shel fishing.
Therefor it is recommended that the project as proposed be denied.. It is also suggested that the
applicant consider the following alternatives:

1. Conducting the project using mechanical dredging instead of hydraulic dredging.
2. Pumping the dredged material to a diked disposal area within the Wrightsville
Restricted area (SB Waters).
3. Pumping the effluent from the proposed diked disposal area back to the area
being dredged. (This alternative would probably be the most cost prohibitive)

9. PROTECT DESCRIPTION 9/20/95
The Shinn Point Canal is a community access channel winding along the north side of Shinn Creek,
somewhat parallel to State Road 1513. The tract is approximately 45 acres in size, subdivided into 1/2
acre lots developed with single family residences. Shinn Creek is classified as a Primary Nursery Area
by the Division of Marine Fisheries, and is closed to the taking of shellfish. The waters are classified
SA by the Division of Environmental Management. The New Hanover County Land Use Plan classifies
the area as Conservation.
The Shinn Point channel extends inland for approximately 2500' from the AIWW in Greenville Sound,
and is dotted with residential docks. There is a bulkhead along the north side of the channel for all but
400'. The south side is bulkheaded for approximately 700', and the remainder is marsh. The canal
itself is approximately 60' wide for approximately 1790'; it is approximately 80' in width for
approximately 450'; and the turning basin at the landward end is approximately 260' x 125'.
The applicants are proposing the maintenance excavation of this canal. The 1790' stretch has current
soundings of approximately -5' mlw, and is proposed to be excavated to -6.5' mlw for a width of
approximately 25'; the 450' section has current soundings of approximately -4.1' mlw, and is proposed
to be excavated to a depth of approximately -5' mlw for a width of approximately 30'; the basin area
has current soundings averaging approximately -3.5' mlw, and is proposed for an excavated depth of
-4.75' mlw with a width of approximately 75'. The excavated area involves approximately 77, 750
square feet in total. Approximately 3839 cubic yards of silty bottom material are to be removed from
the system.
The dredging is to be accomplished hydraulically, utilizing an existing spoil island on the southeast side
of the AIWW opposite the project site. The applicant has proposed the construction of a diked spoil
area, approximately 100' x 300' with a 10' wall. The spillway is proposed for 8', and leads to an
effluent pipe extending to the mean low water contour. This site is privately owned, and permission
is on file for its use for this project. This spoil area as proposed should accommodate approximately
8888 cubic yards of material.
10. ANTICIPATED VAPACTS
The dredging as proposed will disturb approximately 77,750 square feet of shallow bottom area, and
remove approximately 3839 cubic yards of material from the system. Spoil placement will cause the
filling of approximately 30,000 square feet of an existing spoil area. The proposed excavated channel
will be a minimum of 35' from the marsh edge. Though there is always a water quality concern in
lengthy channels terminating in high ground, the applicant has proposed the excavation to grade from
the shallowest at the landward end to the deepest where the channel connects to the AIWW.
Localized turbidity increases are to be expected during excavation.
There has been a complaint entered into the file from one property owner in the development, stating
that the project is unnecessary, and allows for boats that are too large for the system to. accommodate.
The dredging accomplishes a depth of -6.5' at its deepest.

DESCRIPTION OF PROPOSED EXCAVATION
SHINN POINT CANAL
Item 6a
Entering the tract from the A.I.W.W., the canal is bulkheaded on
the right side and is bounded by marsh on the left side. This
section of the canal is 1790 feet in length and 60' wide. The
proposed top cut excavation in this section will be 25 feet in width.
There is currently a bar at the mouth, giving a 3' MLW depth. Beyond
this bar, the depth of this section varies from 4.3' MLW to 7.2' MLW
with random humps and deep spots, but averages 5.1' MLW. We propose
to dredge to a depth of 5' MLW at the inland end of this section,
sloping down to a depth of 6.5' MLW at the mouth. Based on extensive
soundings, we anticipate the removal of 1080 CY of spoil material
from this section of the canal.
The next section of the canal is bulkheaded on both sides, is
80' wide from bulkhead to bulkhead, and is 450' in length. The
proposed top cut excavation in this section will be 301. The current
depth of this section averages 4.1' MLW and we propose to excavate to
a depth of 4.75' MLW at the inland end sloping to 5' MLW at the
waterway end. We calculate that 430 CY of spoil material will be
removed from this section.
The final section of the canal is bulkheaded on all sides and
serves as an oval-shaped turning basin. This basin is 260' in length
and 125' at its widest point. At the widest point, the top cut
excavation will be 75' with the excavation narrowing so as to stay
25' from the bulkheads. While a shallow portion at the far end
measures 2.6' MLW, most of this section shows a depth of 4' MLW. We
propose to excavate to a depth of 4.5' MLW at the far end sloping to
4.75' MLW at the waterway end. We anticipate that 270 CY of spoil
will be removed from the turning basin area.

Enclosed is the application of Shinn Point Homeowner's
Association for Department of the Army authorization and a State
Water Quality Certification to maintenance dredge approximately
77,750 square feet of nonvegetated shallow bottom in a canal off
of Greenville Sound, in the Shinn Point subdivision, in
Wilmington, in New Hanover County, North Carolina. Your receipt
of this letter verifies your acceptance of a valid request for
certification in accordance with Section 325.2(b)(ii) of our
administrative regulations.
We are considering authorizing the proposed activity pursuant
to Section 404 of the Clean Water Act, and we have determined
that a water quality certification is required under the
provisions of Section 401 of the same law. A Department of the
Army permit will not be granted until the certification has been
obtained or waived.
In accordance with our administrative regulations, in most
cases, 60 days after receipt of a request for certification is a
reasonable time for State action. Therefore, if you have not
acted on the request, or asked for an extension of time, by
December 29, 1995, the District Engineer will deem that waiver
has occurred.

The Division of Coastal Management hereby acknowledges receipt of youur application for State
approval for development of your property located at the end of Shinnwood Rd. It was received
completed on 9/19/95, and appears to be adequate for processing at this time. The projected deadline
for making a decision is 12/02/95. An additional 75-day review period is provided by law when such
time is necessary to complete the review. If you have not been notified of a final action by the initial
deadline stated above, you should consider the review period extended. Under those circumstances, this
letter will serve as your notice of an extended review. However, an additional letter will be provided
on or about the 75th day.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must be
posted at the property of your proposed development. You should post this notice at a conspicuous
point along your property where it can be observed from a public road. Some examples would be:
Nailing the notice card to a telephone pole or tree along the road right-of-way fronting your property;
or at a point along the road right-of-way where a private road would lead one into your property.

The Shinn Point Canal is a community access channel winding along the north side of Shinn Creek,
to State Road 1513. The tract is approximately 45 acres in size, subdivided into 1/2
somewhat parallel
acre lots developed with single family residences. Shinn Creek is classified as a Primary Nursery Area

The Shinn Point channel extends inland for approximately 2500' from the AIWW in Greenville Sound,
and is dotted with residential docks. There is a bulkhead along the north side of the channel for all but
400'. The south side is bulkheaded for approximately 700', and the remainder is marsh. The canal
itself is approximately 60' wide for approximately 1790'; it is approximately 80' in width for
approximately 45W; and the turning basin at the landward end is approximately 260' x 125 .
The applicants are proposing the maintenance excavation of this canal. The 1790' stretch has current
soundings of approximately -5' m1w, and is proposed to be excavated to -6.5' m1w for a width of
approximately 25'; the 450' section has current soundings of approximately -4.1' mlw, and is proposed
to be excavated to a depth of approximately -5' m1w for a width of approximately 30'; the basin area
has current soundings averaging approximately -3.5' m1w, and is proposed for an excavated depth of
-4.75' m1w with a width of approximately 75'. The excavated area involves approximately 77, 750
square feet in total. Approximately 3839 cubic yards of silty bottom material are to be removed from
the system.
The dredging is to be accomplished hydraulically, utilizing an existing spoil island on the southeast side
of the -IWW opposite the project site. The applicant has proposed the construction of a diked spoil
area, approximately 100' x 300' with a 10' wall. The spillway is proposed for 8', and leads to an
effluent pipe extending to the mean low water contour. This site is privately owned, and permission
is on file for its use for this project. This spoil area as proposed should accommodate approximately
8888 cubic yards of material.
10. ADI=A DRAM
The dredging as proposed will disturb approximately ?7,750 square feet of shallow bottom area, and
remove approximately 3839 cubic yards of material from the system. Spoil placement will cause the filling of approximately 30,000 square feet of an existing spoil area. . proposed excavated channel
will be a minimum of 35' from the marsh edge. Though there is always a water quality concern in
lengthy channels terminating in high ground, the applicant has proposed the excavation to grade from
the shallowest at the landward end to the deepest where the channel connects to the AIW W.
Localized turbidity increases are to be expected during excavation.

DESCRIp'?'ION OF PROPOSED EXCAVATION
SHINN POINT CANAL
Ttem 6a
Entering the tract from the A.Z.W.W., the canal is bulkheaded on
the right side and is bounded by marsh on the left.side. This
section of the canal is 1790 feet in_ length and 60' wide. The
proposed top cut excavation in this section will be 25 feet in width.
There is currently a bar at the mouth, giving a 3' MLW depth. Beyond
this bar, the depth of this section varies from 4.3' MLW to 7.2' MLW
with random humps and deep spots, but averages 5.1' MLW. We propose
to dredge to a depth of 5' MLW at the inland end of this section,
sloping down to a depth of 6.5' MLW at the mouth. Based on extensive
soundings, we anticipate the removal of 1080 CY of spoil material
from this section of the canal.
The next section of the canal is bulkheaded on both sides, is
80' wide from bulkhead to bulkhead, and is 450' in length. The
proposed top cut excavation in this section will be 301. The current
depth of this section averages 4.1' MLW and we propose to excavate to
a depth of 4.75' MLW at the inland end sloping to 5' MLW at the
waterway end. We calculate that 430 CY of spoil material will be
removed from this section.
The final section of the canal is bulkheaded on all sides and
serves as an oval-shaped turning basin. This basin is 260' in length
and 125' at its widest point. At the widest point, the top cut
excavation will be 75' with the excavation narrowing so as to stay
25' from the bulkheads. While a shallow portion at the far end
measures 2.6' MLW, most of this section shows a depth of 4' MLW. We
propose to excavate to a depth of 4.5' MLW at the far end sloping to
4.75' MLW at the waterway end. We anticipate that 270 CY of spoil
will be removed from the turning basin area.

Dear Mr. Parker:
Reference the application of the Shinn Point Homeowner's Association for
a Department of the Army permit to authorize the maintenance excavation of an
existing canal into the Shinn Point subdivision. The proposed work will
result in the excavation of 3,839 cubic yards of material from 77,750 square
feet of unvegetated shallow bottom. The dredged material is to be placed on
an existing diked disposal island. The project is located on a canal off of
Greenville Sound, in wilmington, New Hanover, North Carolina.
The Federal agencies have completed review of the proposal as presented
by the application and your field investigation report.
We recommend that the following condition(s) be included in the State
authorization:
All work authorized by this permit must be performed in strict
compliance with the permit plans.
All excavated materials will be confined landward of the mean high water
(MHW) elevation contour and any regularly or irregularly flooded vegetated
wetlands within adequate dikes or other retaining structures to prevent
spillover of solids into any vegetated wetlands or surrounding waters.
The terminal end of the pipeline from the dredge into the diked
retention area will be positioned at or greater than 50 feet from any part of
the dike and a maximum distance from spillways to prevent dike erosion and to
allow adequate settlement of suspended solids.
A water control structure will be installed at the intake and of the
effluent pipe leading from the retention area in order to ensure maximum
settlement of suspended solids.
Flow from the diked retention area will be confined by pipe, trough, or
similar device to a point at or below the mean low water (MLW) elevation
contour to prevent gully erosion and siltation.
No excavated or fill materials will be placed at any time in any
vegetated wetlands or waters.
No vegetated wetlands will be excavated or filled.
Excavation will not exceed 6.5 feet below the elevation of mean low

water (MLW).
This permit does not authorize the interference with any existing or
proposed Federal project, and the permittee will not be entitled to
compensation for damage or injury to the authorized structure or work which
may be caused from existing or future operations undertaken by the United
States in the public interest.
No attempt will be made by the permittee to prevent the full and free
use by the public of all navigable waters at or adjacent to the authorized
work. Use of the permitted activity must not interfere with the public's
right to free navigation on all navigable waters of the United states.
No excavated or fill material will be placed in any location or in any
manner so as to impair surface water flow into or out of any wetland area.
The permittee will maintain the authorized work in good condition and in
conformance with the terms and conditions of this permit. The permittee is
not relieved of this requirement if he abandons the permitted activity without
having it transferred to a third party.
The authorized structure and associated activity will not cause an
unacceptable interference with navigation.
The activity will be conducted in such a manner as to prevent a
significant increase in turbidity outside the area of construction or
construction-related discharge. Increases such that the turbidity in the
waterbody is 50 NTU's or less in all rivers not designated as trout waters by
the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or
less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or
less in trout waters, are not considered significant.
If the permittee discovers any previously unknown historic or
archeological remains while accomplishing the authorized work, he will
immediately notify the Wilmington District Engineer who will initiate the
required State/Federal coordination.
If possible, under applicable law, the permittee will incorporate this
permit as part of the documents reflecting title to or interest in the real
property affected.
This Department of the Army permit does not obviate the need to obtain
other Federal, State, or local authorizations required by law.
This permit does not grant any property rights or exclusive privileges.
In issuing this permit, the Federal Government does not assume any
liability for:
a. Damages to the permitted project or uses thereof as a result of
other permitted or unpermitted activities or from natural causes.
b. Damages to the permitted project or uses thereof as a result of
current or future Federal activities initiated on behalf of the general
public.

c. Damages to other permitted or unpermitted activities or structures
caused by the authorized activity.
d. Design and construction deficiencies associated with the permitted
work.
e. Damage claims associated with any future modification, suspension,
or revocation of this permit.
MAINTENANCE DREDGING:
The work authorized herein includes periodic maintenance which may be
performed for ten years from the date of issuance of this permit provided:
a. The permittee will advise the District Engineer in writing at least
two weeks before he intends to undertake any maintenance dredging.
b. The proposed area to be dredged, method of dredging and disposal of
dredged material will be in strict accordance with that authorized by this
permit.
