Box 1213 Wilmington, NC 28402 Dear Mr. Bray: f COPY You have our approval to dredge in 1.58 acres of wetlands or waters for the purpose of renovating the Carolina Beach Yacht Basin, as you described in your application dated 18 September 1995. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3025. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. A holding tank pump out shall be installed and utilized. A stormwater approval shall be obtained from the DEM - Wilmington Regional Office before construction begins. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. PROJECT SUMMARY: Applicant proposes a major modification to existing State Permit #8- 88 to convert the project from a commercial marina to a single family residential community with community and commercial marina. If Basin Street Associates Page 2 .1 9. PROTECT DESCRIPTION 8/22/95 The project site is a 3.31 acre tract on the west side of the Carolina Beach Yacht Basin in Carolina Beach. Access to the property is from St. Joseph's Street to Yacht Street and Basin Street. The property averages 3' - 12' in elevation, and fronts the basin. The tract was used in years past as a marina with boat repair services available. In recent years it has been largely unused, and the bulkhead and docks have fallen into disrepair. The tract is largely vacant and vegetated only with high ground grasses and weeds. A permit was obtained in 1988 to revitalize and enlarge the original use of the property. It authorized a 670' bulkhead, a 33,900 square foot basin, 4 drystack buildings to house 376 boats, a forklift for launching purposes, 6 docks for the mooring of 130 boats, and parking for 209 vehicles. The applicant received a variance from the Coastal Resource Commission to exceed the pier head line by 20' on one dock and by 40' on another. The permit has been renewed through the years. It was modified on 3/20/95 to re-align the permitted bulkhead in response to recent erosion. The current applicant has made an offer to purchase the property based on obtaining the permits necessary to convert the use of the property to residential, with a smaller commercial marina. The Carolina Beach Yacht Basin is approximately 400' - 500' wide at the project site. According to the applicant, the depths grade from -1' m1w at the shoreline to approximately -15' mlw at the pier head ltire? The wwaters-e-wed-.SB_._b_y?he Division of Environmental Management. The area is not a designated Primary Nursery Area, and it is closed to the taking of s eThe?a?olina Beach Land Use Plan classifies the location as Developed; the portions of the project within the CAMA AEC are classified Conservation. The proposal is to improve the 3.31 acre tract for the sale of residential lots and construct a commercial and community marina. To accomplish this, 3.1 acres will be graded for house pads, a road system, parking lot, club house and swimming pool. Entrances to the development will be from Burris Drive, Yacht Road, and Basin Street. Water and sewer lines will run under the road system and connect to the city system. There is to be a 200' x 128' parking lot in the south west corner of the tract to serve customers of the commercial marina. This lot will provide 132 spaces. A 10' wide accessway from Basin Street will allow public access to the docking facility without crossing individual lots. There is a 10' wide walkway parallel to the shoreline for the length of the property (approx. 1000) to access the various docks. The docking system consists of 6 piers, each with finger piers. The footprint of this facility incorporates approximately 151,375 square feet of public trust area, or 3.48 acres. There are 109 slips within this marina to accommodate boats 25' to 45' in length. Ninety one of the slips are for commercial use, while 18 will be reserved for the residential lots. Docks A extends beyond the pier head line by approximately 40% Dock D extends beyond the pier head line by 80'. The variance addressed above allowed for these two docks to exceed the pier head line by 20' and 40' respectively. The other docking structures terminate at the pier head line. The docking facilities are shown on the plats to be set back from the property lines extended into the water. However, riparian corridor lines are not shown. In drawing the corridor lines. 90 degrees from the pier head line, the northern structure appears to be located approximately 10' from this line. No waiver has been obtained. 0* A holding tank pumpout is proposed, though is apparently not indicated on the plats. This is intended to connect to the city system. There are to be "No Sewage Discharge" signs at both ends of five docks for a total of 10 signs. Two signs are to indicate the availability of a pumpout facility. There are two "No Wake" signs proposed. Marina policy will allow overnight dockage, but no live-aboard. There is no fuel service associated with this facility. Maintenance excavation by backhoe and hydraulic dredge are proposed for the shoaled area adjacent to the shoreline. The excavation area can be broken into three sections; 300' x 100', 300' x 35', 160' x 180'. This would disturb approximately 1.58 acres of sandy bottom, and would remove approximately 3745 cubic yards of material from the system. The spoil will be removed to the high ground area in the southeast corner of the lot that will become the parking area after use. Dike walls will be constructed approximately 8' in height, with a 1.511 slope. It is proposed to be approximately 202' x 175', providing a capacity of 7855 cubic yards. A stilling basin will be installed to 6' in height, with an effluent pipe extending to mean low water back in the basin. The applicant plans to construct a clubhouse with a footprint of approximately 2000 square feet and a swimming pool with a footprint of approximately 1176 square feet. Roadways will be stabilized with marl and paver stone. There are no homes to be constructed under this permit. Individuals will obtain all permits and construct homes independent of the developer. There are to be 18 single family lots. Though the applicant states the average lot size as 5000 - 7000 square feet, the plans indicate this range to be from approximately 4300 - 5500 square feet. The bulkhead is to be constructed as per the modification issued on March 20, 1995. 10. ANTICIPATED IM PACTS The project as proposed will remove approximately 3745 cubic yards of sandy material from the Yacht Basin. The dredging will disturb approximately 1.58 acres of shallow bottom area. The spoil will be contained on high ground in an area approximately 35,350 square feet in size. As proposed, this spoil area will contain approximately 7855 cubic yards of material: This site will then be graded and used for the parking lot. Increased turbidity is to be expected during excavation. Improvements for the subdivision, as well as construction of the clubhouse, pool, and parking lot will require the grading of approximately 3.1 acres of high ground. Stormwater and Sedimentation/Erosion Control Plans have both been submitted for approval. While the applicant states that there will be 30% impervious coverage within the Estuarine Shoreline, this will actually be controlled by the Minor Permits issued to individual property owners. The marina will serve as a commercial facility for all but the 18 slips to be deeded with lots. This facility incorporates approximately 3.48 acres of open water. As depicted, docks A and D exceed the pier head line by double the amount allowed in the variance issued by the CRC. As well, dock F appears to encroach within 15' of the adjacent riparian corridor. The Carolina Beach Yacht Basin has a very high boating use, and is essentially one large marina. The Town has a municipal marina, and there are several smaller marinas within the basin. The applicant has a permit currently for 376 boats in dry stack, and 130 wet slips. This new proposal is a less intense use of the property. Parking should be ample with 132 spaces provided for the public who will be using 91 slips. This property has been essentially vacant for years, and has suffered from unauthorized use. PROJECT SUNHAARY: Applicant proposes a major modification to existing State Permit #8- 88 to convert the project from a commercial marina to a single family residential community with community and commercial marina. Basin Street Associates Page 2 9. PROTECT DESCRIPTION 8/22/95 The project site is a 3.31 acre tract on the west side of the Carolina Beach Yacht Basin in Carolina Beach. Access to the property is from St. Joseph's Street to Yacht Street and Basin Street. The property averages 3' - 12' in elevation, and fronts the basin. The tract was used in years past as a marina with boat repair services available. In recent years it has been largely unused, and the bulkhead and docks have fallen into disrepair. The tract is largely vacant and vegetated only with high ground grasses and weeds. A permit was obtained in 1988 to revitalize and enlarge the original use of the property. It authorized a 670' bulkhead, a 33,900 square foot basin, 4 drystack buildings to house 376 boats, a forklift for launching purposes, 6 docks for the mooring of 130 boats, and parking for 209 vehicles. The applicant received a variance from the Coastal Resource Commission to exceed the pier head line by 20' on one dock and by 40' on another. The permit has been renewed through the years. It was modified on 3/20/95 to re-align the permitted bulkhead in response to recent erosion. The current applicant has made an offer to purchase the property based on obtaining the permits necessary to convert the use of the property to residential, with a smaller commercial marina. The Carolina Beach Yacht Basin is approximately 400' - 500' wide at the project site. According to the applicant, the depths grade from -1' mlw at the shoreline to approximately -15' mlw at the pier head line. The waters are classified SB by the Division of Environmental Management. The area is not a designated Primary Nursery Area, and it is closed to the taking of shellfish. The Carolina Beach Land Use Plan classifies the location as Developed; the portions of the project within the CAMA AEC are classified Conservation. The proposal is to improve the 3.31 acre tract for the sale of residential lots and construct a commercial and community marina. To accomplish this, 3.1 acres will be graded for house pads, a road system, parking lot, club house and swimming pool. Entrances to the development will be from Burris Drive, Yacht Road, and Basin Street. Water and sewer lines will run under the road system and connect to the city system. There is to be a 200' x 128' parking lot in the south west corner of the tract to serve customers of the commercial marina. This lot will provide 132 spaces. A 10' wide accessway from Basin Street will allow public access to the docking facility without crossing individual lots. There is a 10' wide walkway parallel to the shoreline for the length of the property (approx. 1000') to access the various docks. The docking system consists of 6 piers, each with finger piers. The footprint of this facility incorporates approximately 151,375 square feet of public trust area, or 3.48 acres. There are 109 slips within this marina to accommodate boats 25' to 45' in length. Ninety one of the slips are for commercial use, while 18 will be reserved for the residential lots. Docks A extends beyond the pier head line by approximately 40% Dock D extends beyond the pier head line by 80. The variance addressed above allowed for these two docks to exceed the pier head line by 20' and 40' respectively. The other docking structures terminate at the pier head line. The docking facilities are shown on the plats to be set back from the property lines extended into the water. However, riparian corridor lines are not shown. In drawing the corridor lines 90 degrees from the pier head line, the northern structure appears to be located approximately 10' from this line. No waiver has been obtained. A holding tank pumpout is proposed, though is apparently not indicated on the plats. This is intended to connect to the city system. There are to be "No Sewage Discharge" signs at both ends of five docks fora total of 10 signs. Two signs are to indicate the availability of a pumpout facility. There are two "No Wake" signs proposed. Marina policy will allow overnight dockage, but no live-aboard. There is no fuel service associated with this facility. Maintenance excavation by backhoe and hydraulic dredge are proposed for the shoaled area adjacent to the shoreline. The excavation area can be broken into three sections; 300' x 100', 300' x 35', 160' x 180'. This would disturb approximately 1.58 acres of sandy bottom, and would remove approximately 3745 cubic yards of material from the system. The spoil will be removed to the high ground area in the southeast corner of the lot that will become the parking area after use. Dike walls will be constructed approximately 8' in height, with a 1.511 slope. It is proposed to be approximately 202' x 175', providing a capacity of '7855 cubic yards. A stilling basin will be installed to 6' in height, with an effluent pipe extending to mean low water back in the basin. The applicant plans to construct. a clubhouse with a footprint of approximately 2000 square feet and a swimming pool with a footprint of approximately 1176 square feet. Roadways will be stabilized with marl and paver stone. There are no homes to be constructed under this permit. Individuals will obtain all permits and construct homes independent of the developer. There are to be 18 single family lots. Though the applicant states the average lot size as 5000 - 7000 square feet, the plans indicate this range to be from approximately 4300 - 5500 square feet. The bulkhead is to be constructed as per the modification issued on March 20, 1995. 10. ANTICIPATED EVIPACT The project as proposed will remove approximately 3745 cubic yards of sandy material from the Yacht Basin. The dredging will disturb approximately 1.58 acres of shallow bottom area. The spoil will be contained on high ground in an area approximately 35,350 square feet in size. As proposed, this spoil area will contain approximately 7855 cubic yards of material. This site will then be graded and used for the parking lot. Increased turbidity is to be expected during excavation. Improvements for the subdivision, as well as construction of the clubhouse, pool, and parking lot will require the grading of approximately 3.1 acres of high ground. Stormwater and Sedimentation/Erosion Control Plans have both been submitted for approval. While the applicant states that there will be 30% impervious coverage within the Estuarine Shoreline, this will actually be controlled by the Minor Permits issued to individual property owners. The marina will serve as a commercial facility for all but the 18 slips to be deeded with lots. This facility incorporates approximately 3.48 acres of open water. As depicted, docks A and D exceed the pier head line by double the amount allowed in the variance issued by the CRC. As well, dock F appears to encroach within 15' of the adjacent riparian corridor. The Carolina Beach Yacht Basin has a very high boating use, and is essentially one large marina. The Town has a municipal marina, and there are several smaller marinas within the basin. The applicant has a permit currently for 376 boats in dry stack, and 130 wet slips. This new proposal is a less intense use of the property. Parking should be ample with 132 spaces provided for the public who will be using 91 slips. This property has been essentially vacant for years, and has suffered from unauthorized use.
