You have our approval to place fill material in wetlands or waters for the purpose of installation
of sanitary sewer mains at Autumn Crest Place and Marshland Place, as you described in your
application dated 21 August 1995. After reviewing your application, we have decided that this fill is
covered by General Water Quality Certification Number 2664. This certification allows you to use
Nationwide Permit Number 12 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get any other federal, state or local permits before you go ahead with your
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401

Dear Mr. Dorney:
Enclosed please find seven sets of plans for utility
extensions within the Landfall subdivision, New Hanover
County, North Carolina. We have enclosed copies of the
NCDEM permit number WQ0010777, the Department of the Army
(DOA) Action ID No. 199501432 and Nationwide Permit 12
authorizing the extension of utility lines, and an
application for the Section 401 Water Quality Certification.
We request NCDEM approval and issuance of a Section 401
Water Quality Certification as noted in the DOA documents.
There are no CAMA AEC's that affect the proposed work area.

In accordance with your application received March 20, 1995, we are forwarding herewith Permit
No. WQ0010777, dated April 25, 1995, to New Hanover County Water & Sewer Authority for the
construction and operation of the subject wastewater collection extension.
This permit shall be effective from the date of issuance until rescinded and shall be subject to the
conditions and limitations as specified therein.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the
right to request an adjudicatory hearing upon written request within thim, (30) days following receipt of
this permit. This request must be in the form of a written petition, conforming to Chapter 150B of the

In accordance with the provisions of Article 21 of Chapter 143. General Statutes of North Carolina as
amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO

FOR THE
construction and operation of approximately 5,435 linear feet of 8 inch gravity sewer to serve 97 three
bedroom homes in Pembroke Jones Park, Phases 3 and 4, and the discharge of 34,920 GPD oT .,ollected
domestic wastewater into the City of Wilmington's existing sewerage system, pursuant to the application
received March 20, 1995, and in conformity with the project plan, specifications, and other supporting
data subsequ,-ntly filed and approved by the Department of Environment, Health and Natural Resources
and considered a part of this permit.
This permit shall be effective from the date of issuance until rescinded and shall be subject to the
following specified conditions and limitations:
1. This permit shall become voidable unless the facilities are constructed in accordance with the
conditions of this permit, the approved plans and specifications, and other supporting data.
2. This permit is effective only with respect to the nature and volume of wastes described in the
application and other supporting data.
3. The facilities must be properly maintained and operated at all times.
4. The sewage and wastewater collected by this system shall be treated in the City of Wilmington's
McKean Maffit Wastewater Treatment Facility prior to being discharged into the receiving stream.
5. This permit is not transferable. In the event there is a desire for the facilities to change ownership,
or there is a name change of the Permittee, a formal permit request must be submitted to the
Division of Environmental Management accompanied by an application fee, documentation from
the parties involved, and other supporting materials as may be appropriate. The approval of this
request will be considered on its merits and may or may not be approved.
6. Construction of the sewers, pump station(s) and force main shall be scheduled so as not to
interrupt service by the existing utilities nor result in an overflow or bypass discharge of
wastewater to the surface waters of the State.
7. Upon completion of construction and prior to operation of this permitted facility, a certification
must be received from a professional engineer certifying that the permitted facility has been
installed in accordance with this permit, the approved plans and specifications, and other
supporting materials. Mail the Certification to the Water Quality Permits and Engineering Unit,
P.O. Box 29535, Raleigh, NC 27626-0535.
8. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a
minimum of five years from the date of the completion of construction.
9. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee
to an enforcement action by the Division of Environmental Management, in accordance with North
Carolina General Statute 143-215.6(a) to 143-215.6(c).
10. The issuance of this permit does' not preclude the Permittee from complying with any and all
statutes. rules, regulations, or ordinances which may be imposed by other government agencies
(local, state, and federal) which have jurisdiction.
11. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance
conditions, the Permittee shall take immediate corrective action. including those as may be required
by this Division, such as the construction of additional or replacement wastewater collection
facilities.
12. Noncompliance Notification:
The Permittee shall report by telephone to the Wilmington Regional Office, telephone number
(910) 395-3900, as soon as possible, but in no case more than 24 hours or on the next working
day, following the occurrence or first knowledge of the occurrence of either of the following:
a. Any process unit failure, due to known or unknown reasons. that renders the facility incapable
of adequate wastewater transport, such as mechanical or electrical failures of pumps, line
blockage or breakage, etc.; or
b. Any failure of a pumping station or sewer line resulting in a by-pass directly to receiving.
waters without treatment of all or any portion of the influent to such station or facility.
Persons reporting such occurrences by telephone shall also file a written report in letter form within
15 days following first knowledge of the occurrence. This report must outline the actions taken or
proposed to be taken to ensure that the problem does not recur.
13. This permit shall become voidable unless the agreement between New Hanover County and the
City of Wilmington for the collection and final treatment of wastewater is in full force and effect.

14. A stormwater management plan must be submitted to and approved by the Wilmington Regional
Office in accordance with 15 NCAC 2H .1000.

Dear Mr. Cooper:
Reference your request of April 17, 1995, for Department of the Army (DA)
authorization to place three utility lines through wetlands adjacent to Howe
Creek, off of Marshland Drive, in the Landfall development, in Wilmington, New
Hanover County, North Carolina.
For the purposes of the Corps of Engineers' Regulatory Program, Title 33,
Code of Federal Regulations (CFR), Part 330.6, published in the Federal
Register on November 22, 1991, lists nationwide permits. Authorization,
pursuant to Section 404 of the Clean Water Act, was provided for the discharge
of material for backf ill or bedding for utility lines, including outf all and
intake structures, provided there is no change in pre-construction contours.
Your work is authorized by this nationwide permit provided it is
accomplished in strict accordance with the enclosed conditions and provided
you receive a Section 401 water quality certification from the North Carolina
Division of Environmental Management (NCDEM) and, in the coastal area, a
consistency determination from the North Carolina Division of Coastal
Management (NCDCM). You should contact Mr. John Dorney, telephone (919) 733-
1786, regarding water quality certification, and Mr. Steve Benton, telephone
(919) 733-2293, regarding consistency determination. This nationwide permit
does not relieve you of the responsibility to obtain other required State or
local approval.
This verification will be valid for two years from the date of this
letter unless the nationwide authorization is modified, reissued or revoked.
This verification will remain valid for the two years if, during that period,
the nationwide permit authorization is reissued without modification or the
activity complies with any subsequent modification. If during the two years,
the nationwide permit authorization expires or is suspended or revoked, or is
modified, such that. the activity would no longer comply with the terms and
conditions of the nationwide permit, activities which have commenced or are
under contract to commence, in reliance upon the nationwide permit, will
remain authorized. This is provided the activity is completed within twelve
months of the date of the nationwide permit's expiration, modification or
revocation.
Landfall Associates also proposes the placement of fill material in
wetlands for the construction of road crossings. These crossings may be
authorized by our Nationwide Permit No. (NWP) 14. You should complete the
enclosed Pre-discharge Notification form and return one copy to this office
and 7 copies to the North Carolina Division of Environmental Management.
Please include a location map. Upon our receipt of the necessary information,
we will determine whether the proposed work can be authorized by NWP 14.

GENERAL CONDITIONS
1. Navigation. No activity may cause more than a minimal adverse effect on
navigation.
2. Proper Maintenance. Any structure or fill authorized shall be properly
maintained, including maintenance to ensure public safety.
3. Erosion and Siltation Controls. Appropriate erosion and siltation controls
must be used and maintained in effective operating condition during
construction, and all exposed soil and other fills must be permanently
stabilized at the earliest practicable date.
4. Aquatic Life Movements. No activity may substantially disrupt the movement
of those species of aquatic life indigenous to the waterbody, including those
species which normally migrate through the area, unless the activity's primary
purpose is to impound grater.
5. Equipment. Heavy equipment working in wetlands must be placed on mats or
other measures must be taken to minimize soil disturbance.
6. Regional and Case-by-case Conditions. The activity must comply with any
regional conditions which may have been added by the Division Engineer and any
case specific conditions added by the Corps.
7. Wild and Scenic Rivers. No activity may occur in a component of the
National Wild and Scenic River System; or in a river officially designated by
Congress as a "study river" for possible inclusion in the system, while the
river is in an official study status. Information on Wild and Scenic Rivers may
be obtained from the National Park Service and the U.S. Forest Service.
8. Tribal Rights. No activity or its operation may impair reserved tribal
rights, including, but not limited to, reserved water rights and treaty fishing
and hunting rights.
9. Water Quality Certification. In certain states, an individual state water
quality certification must be obtained or waived.
10. Coastal Zone Management. In certain states, an individual state coastal
zone management consistency concurrence must be obtained or waived.
11. Endangered Species. No activity is authorized under any NWP which is
likely to jeopardize the continued existence of a threatened or endangered
species or a species proposed for such designation, as identified under the
Federal Endangered Species Act, or which is likely to destroy or adversely
modify the critical habitat of such species. Non-Federal permittees shall
notify the District Engineer if any listed species or critical habitat might be
affected or is in the vicinity of the project and shall not begin work on the
activity until notified by the District Engineer that the requirements of

the Endangered Species Act have been satisfied and that the activity is
authorized. Information on the location of threatened and endangered species
can be obtained from the U.S. Fish and Wildlife Service and National Marine
Fisheries Service.
12. Historic Properties. No activity which may affect Historic Properties
listed, or eligible for listing, in the National Register of Historic Places is
authorized, until the District Engineer has complied with the provisions of 33
CFR 325, Appendix C. The prospective permittee must notify the District
Engineer if the authorized activity may affect any historic properties listed,
determined to be eligible, or which the prospective permittee has reason to
believe may be eligible for listing on the National Register of Historic Places,
and shall not begin th'e activity until notified by the District Engineer that
the requirements of the National Historic Preservation Act have been satisfied
and that the activity -Ls-authorized- Information on the location and existence
of historic resources can be obtained from the State Historic Preservation
Office and the National Register of Historic Places (see 33 CFR 330.4(g))
13. Notification.
a. Where required by the terms of the NWP, the prospective permittee must
notify the District Engineer as early as possible and shall not begin the
activity:
(1) until notified by the District Engineer that the activity may proceed
under the NWP with any special conditions imposed by the District or Division
Engineer; or
(2) if notified by the District or Division Engineer that an individual
permit is required; or.
(3) Unless 30 days have passed from the District Engineer's receipt of the
notification and the prospective permittee has not received notice from the
District or Division Engineer. Subsequently, the permittee's right to proceed
under the NWP may be modified, suspended or revoked only in accordance with the
procedure set forth in 33 CFR 330.5(d)(2).
b. The notification must be in writing and include the following
information and any required fees:
(1) Name, address and telephone number of the prospective permittee;
(2) Location of the proposed project;

(3) Brief description of the proposed project; the project's purpose;
direct and indirect adverse environmental effects the project would cause; any
other NWP(s), regional general permit (s) or individual permit (s) used or
intended to be used to authorize any part of the proposed project or related
activity;
(4) Where required by the terms of the NWP, a delineation of affected
special aquatic sites, including wetlands; and
(5) A statement that the prospective permittee has contacted;
(a) The USFWS/NMFS regarding the presence of any Federally listed (or
proposed for listing) endangered or threatened species or critical habitat in
the permit area that may be affected by the proposed project; and any available
information provided by_those agencies. (The prospective permittee may contact
Corps District Offices for USFWS/NMFS agency contacts and list of critical
habitat.)
(b) The SHPO regarding the presence of any historic properties in the
permit area that may be affected by the proposed project; and the available
information, if any provided by that agency.
14. Water Supply Intakes. No discharge of dredged or =i'_1 material may occur
in the proximity of a public water supply intake except -where the discharge is
repair of the public water supply intake structures or adjacent bank
stabilization.
15. Shellfish Production. No discharge of dredged or fill material may occur
in areas of concentrated shellfish production, unless the discharge is directly
related to a shellfish harvest activity authorized by nationwide permit.
16. Suitable Material. No discharge of dredged or fill material may consist of
unsuitable material (e.g., trash, debris, car bodies, etc.) and material
discharged must be free from toxic pollutants in toxic amounts.
17. Mitigation. Discharges of dredged or fill material into waters of the
United States must be minimized or avoided to the maximum extent practicable at
the project site (i.e., on-site), unless the District Engineer has approved a
compensation mitigation plan for the specific regulated activity.
18. Spawning Areas. Discharges in spawning areas during spawning seasons must
be avoided to the maximum extent practicable.
19. Obstructions of High Flows. To the maximum extent practicable, discharges
must not permanently restrict or impede the passage of normal or expected high
flows or cause the relocation of the water (unless the primary purpose of the
fill is to impound waters).
20. Adverse Impacts from impoundments. If the discharge creates an impoundment
of water, adverse impacts on the aquatic system caused by the accelerated
passage of water and/or the restriction of its flow shall be minimized to the
maximum extent practicable.
21. Waterfowl Breeding Areas. Discharges into breeding areas for migratory
waterfowl must be avoided to the maximum extent practicable.
22. Removal of Temporary Fills. Any temporary fills must be removed in their
entirety and the affected areas returned to their preexisting elevation.
NATIONWIDE CONDITIONS
a. Material resulting from trench excavation may be temporarily sidecast
into waters of the U.S. provided that the material is not placed in such a
manner that it is dispersed by currents or other forces and must be removed
within three months.
b. The area of waters of the U.S. that is distrubed must be limited to the
minimum necessary to construct the utility line.
c. In wetlands, the top 6" to 12" of the trench should generally be
backfilled with topsoil from the trench.
d. Excess material must be removed to upland areas immediately upon
completion of construction.
e. Any exposed slopes and streambanks must be stabilized immediately upon
completion of the utility line.
REGIONAL CONDITIONS
a. Applicants must notify the District Engineer (DE) and receive from the DE
written approval prior to starting work.
b. The temporary placement of excavated or fill material in :caters or
wetlands will be for the absolute minimum period of time necessary to
accomplish the work.
c. Stabilization is required immediately on completion of each individual
crossing.
d. Work plans must be provided and must be sized to 8 1/2 by 11 IN=.
e. Restoration plans must be submitted to the District Engineer (DE)
designating a time table for restoration.
STATE CONSISTENCY CONDITIONS
a. If the proposed activity is within the North Carolina Coastal Area, the
applicant must receive written concurrence from the North Carolina Division of
Coastal Management (NCDCM) that the activity is consistent with the North
Carolina Coastal Management Program.
b. Should all or part of a proposed activity be located within an Area of
Environmental Concern (AEC) as designated by the North Carolina Coastal
Resources Commission, a Coastal Area Management Act (CAMA) permit is required
from the North Carolina Division of Coastal Management (NCDCM). Should an
activity within or potentially affecting an AEC be proposed by a Federal
agency, a consistency determination pursuant to 15 CFR 930 must be provided to
the NCDCM at least 90 days before the onset of the proposed activity.

GENERAL CERTIFICATION CONDITIONS
a. Written concurrence is required from the North Carolina Division of
Environmental Management (NCDEM).
b. The construction corridor is limited to 40 feet in width and must be
minimized to the maximum extent practicable.
c. Permanently maintained access corridors shall be restricted to the
minimum width practicable and may not exceed 10 feet in width except in
locations specified on maps for vehicular access purposes or at manhole
locations. %
d. Established sediment and erosion control practices will be utilized to
prevent violations of fhe appropriate turbidity water quality standard (50
=Is in streams and rivers not designated as trout waters by the North
Carolina Division of Environmental Management (NCDEM), 25 NTU's in all
salt-dater classes and all lakes and reservoirs and 10 =Is in trout waters).
e. Work plans must be legible and sized to 8 1/2 by 11 inches.
f. Measures shall be taken to prevent live or fresh concrete from coming
into contact with waters of the State until the concrete has hardened.
g. Additional site-specific conditions may be added to proposed projects in
order to ensure compliance with all applicable water quality and effluent
standards.
h. Concurrence from the North Carolina Division of Environmental Management
(NCDEM) applies to an individual project and shall expire three years from the
date of the cover letter from NCDEM.
