Dear Mr. Graves:
You have our approval to discharge return water from an upland diked disposal basin for the
purpose of conducting maintenance dredging at the shipping berth of Hoechst Celanese Plant, as you
described in your application dated 13 June 1995. After reviewing your application, we have decided
that this fill is covered by General Water Quality Certification Number 2668. This certification allows
you to use Nationwide Permit Number 16 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get any other federal, state or local permits before you go ahead with your
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401
of the Clean Water Act. If you have any questions, please telephone John Domey at 919-733-1786.

9. PROTECT DESCRIPTION 07/05/95
The entire project site is a 1,577 acre tract with a manufacturing plant along the west bank of
the Northeast Cape Fear River approximately 8.5 miles upstream of Wilmington. The property was
formerly known as Cape Industries and was issued a maintenance dredging permit in 1986 under that
name. There is an existing dock barge loading facility ("T"-head pier) adjacent to the river for
waterborne shipping activities.
The area is classified as Conservation by the New Hanover County Land Use Plan. The waters of
the Northeast Cape Fear River are classified as C Sw by the Division of Environmental Management
and have been designated as Primary Nursery Area by the Division of Marine Fisheries. There are no
shellfish resources within the project site.
The berthing facility is approximately 1200 ft long and 280 ft wide with Mean Low Water depths
ranging from 8.7 to 14.9 ft. The applicant proposes to maintain the basin to the following dimensions:
1200 ft X 280 ft X 14.5 ft MLW. Approximately 6000 cubic yards of mostly silty sands will be
excavated by hydraulic pipeline dredge with the excavated material being deposited in a previously used
diked spoil disposal area on high ground approximately 1000 ft from the dredging site. The spoil
disposal site is a 2.3 acre tract owned by the applicant and will be prepared according to the
specifications submitted within the application. All maintenance and preparation to the dike walls will
be done prior to use. The influent pipe is proposed to extend over wetlands and through the diked wall.
The dredge effluent will be decanted and released through a weir control structure where it will be
directed to the existing manufacturing process water discharge canal for eventual discharge back into
the Northeast Cape Fear River.
10. ANTICIPATED EMPACTS
The excavation will cause the disturbance of 336,000 square feet of bottom area. The project
will remove approximately 6000 cubic yards of material from the system. There will be an increase
in turbidity during excavation. Spoil placement will cause the disruption of an existing 2.3 acre spoil
site. Provided that the project is timed to avoid peak biological activity, no significant adverse impacts
are anticipated. Both anadromous and non-anadromous fish and shrimp have the potential to utilize the
area depending on salinity values in the river.

Gentlemen: Permit Application
It is requested that a maintenance dredging permit be issued
to Hoechst Celanese Corporation in accordance with the attached
permit application and supporting sketches. The area was dredged
last in April 1987. This dredging is proposed to begin in the
fall of 1995 and be completed within 60 days thereafter.
The proposed dredging around the existing dock-barge loading
facility of Hoechst Celanese Corporation in the Northeast Cape
Fear River north of Wilmington is required to maintain waterborne
shipping activities at this location. The dredging will be per-
formed by hydraulic pipeline dredge with the excavated material
placed in a diked spoil disposal area on high ground, ap-
proximately 1,000 feet from the dredging site. The dredge ef-
fluent will be decanted and released through a weir control struc-
ture where it will be directed to the existing manufacturing
process water discharge canal for eventual discharge back into
the Northeast Cape Fear River. The material to be excavated is
comprised primarily of silty sand which will be excavated to a
depth of minus 14 feet mean low water (existing bottom depths are
variable, ranging from minus 8 to minus 15-plus feet MLW).
Notification will be given to your office prior to any proposed
dredging operation.

In response to your letter dated June 13, 1995 the following
additional information is submitted:
a. Proposed work is least environmentally damaging and prac-
ticable alternative. The proposed maintenance dredging lies
in the main run of the river and the depth of a good portion
is as deep or deeper than the proposed dredged depth. The
objective of this project is to lower the high spots to al-
low river vessels servicing the Hoechst Celanese site to
navigate at the same depth as the lower river channel. This
barge berth has been maintained by prior owners (Cape In-
dustries, Hercules, Hercofina, and Hoechst Celanese) since
1974.
Prior maintenance dredging has caused no noticeable detrimen-
tal effects to the river bottom. The proposed hydraulic
dredging is accepted as the least disturbing operation of
all methods used to maintain river depth, especially in this
case where most of the dredging involves removal of less
than two feet of bottom.
There are no wetlands to be disturbed in this project.
The upland disposal area is the same area used in prior main-
tenance dredging.
There is no upland alternative to using river barges for
hauling bulk liquids to the river dock. The entire opera-
tion was based originally and presently on the economic jus-
tification of barge hauling versus upland operations, such
as truck hauling.

Enclosed is the application of Hoechst Celanese Corporation, represented
by Mr. Hubert C. Graves, Director of Finance, for Department of the Army (DA)
authorization and a State Water Quality Certification to maintain a barge
berth on the Northeast Cape Fear River, near Wilmington, New Hanover County,
North Carolina. Your receipt of this letter verifies your acceptance of a
valid request for certification by Section 325.2(b)(ii) of our administrative
regulations.
We are considering authorizing the proposed activity pursuant to Section
404 of the Clean Water Act, and we have determined that a water quality
certification is required under the provisions of Section 401 of the same law.
A Department of the Army permit will not be granted until the certification
has been obtained or waived.
. According to our administrative regulations, 60 days is reasonable for
State action. Therefore, if you have not acted on the request, or asked for an
extension of time, by August 14, 1995, the District Engineer will deem that
waiver has occurred.

A copy of the deed (with state application only) or other
instrument under which the applicant claims title to the
affected property. If the applicant is not claiming to be
the owner of said property, then forward a copy of the
deed or other instrument under which the owner claims

An accurate work plat (including plan view and cross
sectional drawings) drawn to scale in black ink on an 8
1/2 x 11 white paper. (Refer to Coastal Resources
