THIS CERTIFICATION is issued in conformity with the requirements of Section 401 Public
Laws 92-500 and 95-217 of the United States and subject to the North Carolina Division of
Environmental Management Regulations in 15 NCAC 2H, Section .0500 to Phillip Matthew and
Robert Nichols resulting in 2265 square feet of wetland impact in Onslow County pursuant to an
application filed on the 2nd day of February of 1995 to construct a bulkhead at lots 11 and 12, Hurst
Harbor subdivision..
The Application provides adequate assurance that the discharge of fill material into the waters
of AIWW in conjunction with the proposed development in a Onslow County will not result in a
violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of
North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92-
500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set
forth.
Condition(s) of Certification:
1. That the activity be conducted in such a manner as to prevent significant
increase in turbidity outside the area of construction or construction
related discharge (50 NTUs in streams and rivers not designated as trout
waters by DEM; 25 NTUs in all saltwater classes, and all lakes and
reservoirs; 10 NTUs in trout waters).
Violations of, any condition herein set.forth shall result in revocation of this Certification. This
Certification shall become null and void unless the above conditions are made conditions of the
Federal 404 and/or Coastal Area Management Act Permit. This Certification shall expire upon
expiration of the 404 or CAMA permit.
If this -Certification is unacceptable to you, you have the right to an adjudicatory hearing upon
written request within thirty (30) days following receipt of this Certification. This request must be in
the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and
filed with the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. Unless
such demands are made, this Certification shall be final and binding.

Enclosed is the application of Mr. Barry Matthews, Ms. Ruth Matthews, Mr.
Robert Nichols and Ms. Harriette Nichols for Department of the Army (DA)
authorization and a State Water Quality Certification to construct and
backfill bulkheads on the Atlantic Intracoastal Waterway (AIWW), Lots Nos. 11
and 12, Hurst Harbor Subdivison, east of Hammocks State Park, Onslow County,
North Carolina. Your receipt of this letter verifies your acceptance of a
valid request for certification in accordance with Section 325.2(b)(ii) of our
administrative regulations.
We are considering authorizing the proposed activity pursuant to Section
404 of the Clean Water Act, and we have determined that a water quality
certification is required under the provisions of Section 401 of the same law.
A Department of the Army permit will not be granted until the certification
has been obtained or waived.
In accordance with our administrative regulations, in most cases, 60 days
after receipt of a request for certification is a reasonable time for State
action. Therefore, if you have not acted on the request, or asked for an
extension of time, by April 3, 1995, the District Engineer will deem that
waiver has occurred.

PROJECT SUMMARY: Each applicant proposes to construct a section of bulkhead with fill in the 404
wetlands. Each will construct a single family residence on their respective lot.

9. NARRATIVE DESCRIPTION: The project site is located about 2 miles southwest of
Swansboro, at the end of SR #1511 , just east of Hammocks Beach State Park on lots
#11 and #12 in Hurst Harbor Subdivision, Onslow County.
Mr. Matthews and Mr. Nichols are co-applicants in their pursuit of authorization to
construct a bulkhead 152 feet long, within an area of 404 wetlands located that is within
the Estuarine Shoreline Area of Environmental Concern. The two lot that make up the
project site extend from the paved road known as John L Hurst Drive to a point of land
that separates the waters of the Atlantic Intracoastal Waterway (AIWW) from Fosters'
Bay. On the southwest side of the point, lot #11 is characterized by a pocket marsh
dominated by saltmarsh cordgrass and an irregularly flooded pond. This feature of the
project site extends well onto lot #12. On the northeast side of the point, lot #12 is
-characterized by a long narrow sand beach and berm that separates the saltmarsh from
regular tidal influence. The application indicates that Mr. Matthews owns lot #11 and
Mr. Nichols owns lot #12.
The Corps of Engineer's representative, Mr. Jeff Richter, has visited the site and
confirmed the 404 Wetlands alignment as shown on the workplat drawings; sheet 2 of
4 shows clearly the 404 wetlands boundary in relationship to the proposed bulkhead
alignment. According to the Corps, the project meets the requirements for the
Nationwide Permit #18. The applicant's consultant, Mr. Wayne Ragland, has calculated
the amount of wetlands fill involved on each lot. On lot #11, the proposed bulkhead and
fill will displace approximately 452 square feet and on lot #12 the project will generate
a footprint impact of about 1813 sq. ft. The location and construction of Mr. Matthews
house on lot #11 is not dependent on the proposed bulkhead, where as, the location the
construction of Mr. Nichols house on lot #12 is directly dependent on the project. As
sheet 2 of 4 shows, the southeast corner of Mr. Nichols' house will cover approximately
576 sq. ft. of 404 wetlands landward of the proposed bulkhead.
It is important to note that the location and construction of both of the proposed houses
are within the Estuarine Shoreline AEC. In addition, each site plan calls for the
construction of a concrete driveway with turn-around and parking bay that will extend
into the AEC on the west side of each house. The width of the concrete turn-around and
parking bays is 25 ft. and is limited by the location of the permitted septic tanks and
drain field lines.
10. ANTICIPATED IMPACTS: Construction of the proposed bulkhead with the associated
fill will result in the direct displacement of approximately 2265 sq. ft. of 404 wetland
adjacent to the coastal saltmarsh and within the Estuarine Shoreline AEC. The applicant's
consultant has calculated that the combined amount of impervious surface is about 5%
of the total AEC on both lots.

Based on the 1217/94 on-site meeting of the co-applicants, Wayne Ragland, and Mr Jeff Richter
(Army Corps of Engineers representative): my additional discussions with Mr Richter after that
meeting, and : an on-site meeting_ of the co-applicants with Mr Jim Mercer on 12/9/94 (verbal
Mmopsis provided to me by Mr Matthews): it appears that most relevant concerns expressed
regarding the proposed improvements subject of the above CAMA application were in regards
to the EPA 404 (b) (1) guidelines for evaluating permits for fill proposed in Section 404
wetlands. This procedure basically requires a procedure that first maximizes avoidance of
wetlands, then requires one to minimize potential adverse impacts and then finally mitigation
(on site preferred over off site) if adverse impacts are considered unacceptable on an
individual site or accumulative basis. After describing the avoidance criteria to Jeff Richter, he
agreed that for the given circumstances, the avoidance criteria is probably met but he did
suggest several additional considerations for minimizing the adverse impacts (i.e. auantity of
wetlands to be filled).

(b) (1) guidelines would be helpful to the review agencies Based on the information provided

The following procedure was used to determine the design layout of the application for use of
NWP 18 in the ES AEC on the 2 lots subject to referenced CAMA application. The
designAgyout decision process will be offered in the same sequence as the 404 (b) (1)
guidelines The U3/95 Addendum CAMA Exhibit Map should be reviewed concurrently with
the following narrative to assist in understanding the narrative information.
AVOIDANCE: The basic intent of the proposed improvements are to preserve the property
values of the 2 lots relative to both the high initial raw land cost of each lot and the
neighborhood character established by existing residences as well as recorded restrictive
covenants This concern became known when the severity of the setback limitations imposed
by the Improvements Permits issued by the health department became evident by plotting the
permits to scale on the respective lots. The permits and Section .1990 rules mandate that no
improvements nor soil disturbances occur in the location of the permitted systems and 100%
repair areas As a result of the narrow lot dimensions along the roadway and the sewage
system design the only remaining usable location for the residences is between the permitted
systems and the wetlands that dominate the Eastern end of the lots.
The generic 55' by 55' residential footprint was established by evaluating the overall
dimensions of the existing residences and establishing comparable criteria. The total footprint
allows for irregular turns in wall alinement wing arrangements, roofed porches, patios and
similar total roof coverage area. The footprint is not necessarily the perimeter geometry of the
houses that may be built but does reasonably represent the total squared off footprint of the
probable house characteristics expected to be built and typical to the subdivision

The distance between the residence footprint and the on-site sewage system was determined
by the minimum outside turning radius of a conventional automobile as recommended by
nationally recognized architectural and planning references. This criteria was used to assure
minimum vehicle access from the driveway to potential garage parking. The location of the
retainer wall was determined by maintaining at least 10' from the wall to the residence and the
elimination of acute wall angles so that residence foundation stability would not be threatened.
While a standard residence can be fitted onto lot #11 without filling 404 wetlands under this
criteria it became evident that lot #12 must encroach into the wetlands or construct a house
geometry that is considerably less livable and even threaten the resale value of the residence
and lot.
The result of the geometry of required fill on lot #12 will result in an acute angle of wetlands
and retainer wall contiguous to lot #11 unless the wall extends across that lot also. Based on
the above criteria, the recognition that the retainer wall is necessary, and the fear that adverse
impacts on land value of a lot also impacts the adjacent lots, the land owners of both lots
decided to request the permit as co-applicants:
MINIMIZATION: After reviewing alternatives for which side of the lot (i.e. North or South side of
usable soils areas) would be better for the placement of the septic system & 100% repair, it
was found that the turning radius for vehicular access to the residences eliminated any
significant advantage of one position over another. Based on the recommendations of Jeff
Richter and concurrence of the co-applicants, the retainer wall alinement between wetland
points A10 and A11 was revised to eliminate the small quantity of wetland fill at that location.
The alinement of the residences have also been revised so that the retainer wall alinement on
lot #11 could be terminated near wetland point # A7 instead of # A6. The net effect of these
revisions is a reduction from 2789 SF of wetland fill to 2265 SF and a reduction in wall length
from 178.2 LF to 152.6 LF._

No other significant reductions could be found that did not produce an unmaintainable acute
angle of wetlands or an acute unstable turn in the retainer wall or a threat to structural stability
of the residence foundations without extraordinary engineering and cost requirements.
MITIGATION: The CW AEC delineation was established under very conservative criteria of the
mere presence or nearness of a few sprouts of cattail's and no portion of the proposed
improvements encroach into that area of environmental concern. The wetland fill proposed is
allowed under NWP #18 (i.e. up to 4560 SF) and has been minimized to the extent possible
under the presently known limitations and approved planned uses of the lots. The proposed fill
does not impact wetlands that are presently providing any significant water quality hydrologic
functions since the upland watershed contributing runoff to this wetland location is exceeding
small and roof gutters can and should route roof runoff away from the filled area to optimize
structural stability of the residence foundations. This can easily be assured by making roof
gutters a condition of the CAMA permit. In effect, there is no significant immediate nor
accumulative adverse impact from the fill that needs mitigation beyond the avoidance and
minimization that has already been stringently pursued. Please advise if any additional
information explanation or other questions need to be addressed relative to the design criteria
that resulted in the layouts proposed

8. PROJECT SUMMARY: Each applicant proposes to construct a section of bulkhead with fill in the 404
wetlands. Each will construct a single family residence on their respective lot.

9. NARRATIVE DESCRIPTION: The project site is located about 2 miles southwest of
Swansboro, at the end of SR #1511 , just east of Hammocks Beach State Park on lots
#11 and #12 in Hurst Harbor Subdivision, Onslow County.
Mr. Matthews and Mr. Nichols are co-applicants in their pursuit of authorization to
construct a bulkhead 152 feet long, within an area of 404 wetlands located that is within
the Estuarine Shoreline Area of Environmental Concern. The two lot that make up the
project site extend from the paved road known as John L Hurst Drive to a point of land
that separates the waters of the Atlantic Intracoastal Waterway (AIWW) from Fosters'
Bay. On the southwest side of the point, lot #11 is characterized by a pocket marsh
dominated by saltmarsh cordgrass and an irregularly flooded pond. This feature of the
project site extends well onto lot #12. On the northeast side of the point, lot #12 is
characterized by a long narrow sand beach and berm that separates the saltmarsh from
regular tidal influence. The application indicates that Mr. Matthews owns lot #11 and
Mr. Nichols owns lot #12.
The Corps of Engineer's representative, Mr. Jeff Richter, has visited the site and
confirmed the 404 Wetlands alignment as shown on the workplat drawings; sheet 2 of
4 shows clearly the 404 wetlands boundary in relationship to the proposed bulkhead
alignment. According to the Corps, the project meets the requirements for the
Nationwide Permit #18. The applicant's consultant, Mr. Wayne Ragland, has calculated
the amount of wetlands fill involved on each lot. On lot #11, the proposed bulkhead and
fill will displace approximately 452 square feet and on lot #12 the project will generate
a footprint impact of about 1813 sq. ft. The location and construction of Mr. Matthews
house on lot #11 is not dependent on the proposed bulkhead, where as, the location the
construction of Mr. Nichols house on lot #12 is directly dependent on the project. As
sheet 2 of 4 shows, the southeast corner of Mr. Nichols' house will cover approximately
576 sq. ft. of 404 wetlands landward of the proposed bulkhead.
It is important to note that the location and construction of both of the proposed houses
are within the Estuarine Shoreline AEC. In addition, each site plan calls for the
construction of a concrete driveway with turn-around and parking bay that will extend
into the AEC on the west side of each house. The width of the concrete turn-around and
parking bays is 25 ft. and is limited by the location of the permitted septic tanks and
drain field lines.
10. ANTICIPATED IMPACTS: Construction of the proposed bulkhead with the associated
fill will result in the direct displacement of approximately 2265 sq. ft. of 404 wetland
adjacent to the coastal saltmarsh and within the Estuarine Shoreline AEC. The applicant's
consultant has calculated that the combined amount of impervious surface is about 5%
of the total AEC on both lots.
