You have our approval to place fill material in 0.025 acres of wetlands or waters for the purpose of constructing a road crossing at Lot 15, Block 14 Mason's Point Place Road, Landfall subdivision, as you described in your application dated 12 January 1995. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2732. This certification allows you to use Nationwide Permit Number 14 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. Mr. Morrow owns a residential lot on Howe's Creek which contains a wetland area which bisects his property. Mr. Morrow is requesting a driveway access permit to reach the buildable area of his land. We arrived at the location for the proposed driveway access with the help of the Corps of Engineer Field Representative. While locating the wetland perimeter, the field representative determined this area of the wetland contained crushed rock and fill dirt from work that was performed in the past. This work was performed before Mr. Morrow bought the lot. In addition to the driveway access, Mr. Morrow plans to build a drip-thru elevated walkway across the wetland in the middle of his lot. A new residence will be constructed between the 404 area and the 75 foot New Hanover County COD setback. Morrow Page 2 9. PROJECT DESCRIPTION 02/10/95 The project site is a residential lot in the Landfall development of New Hanover County. 2325 Mason's Point Place is a riparian lot and contains wetlands that connect to Howe Creek approximately 225' away. The property is within the Outstanding Resource Waters Estuarine Shoreline AEC. The lot is approximately 40,510 square feet in size, and extends from 3' to 17' in elevation. The area is classified as Conservation in the New Hanover County Land Use Plan by virtue of the fact that it is within a CAMA AEC. Howe Creek is a designated Primary Nursery Area, and is closed to the taking of shellfish. The waters of the creek are classified SA-ORW by the Division of Environmental Management. The majority of this lot is vegetated with pine trees and high ground grasses and undergrowth. There is a drainage swale apparently created by a drainage seep and influenced by the underground french drains installed by the developer. This area is a system of ridges and swales responding to and resulting in the drainage patterns in the area. This swale is across the ridge from that in the Helmke proposal. The landward end of this seep still contains high ground grasses and is hummocky. This swale is vegetated by a mixture of many wetland species Ilex W, Persea borbonia, M• r? cerifera, _yonia lucida, Scirpus W, Cladium jamaicense, Iva frutescens, T,ypha latifolia, and Andropogon glomeratusl and connects to Howe Creek approximately 225' away. This area has been delineated by the US Army Corps of Engineers for the presence of 404 wetlands. Because Landfall requires a 40' street setback and a side entrance driveway, and the County has a 75' C.O.D. setback within the Conservation area, the applicant is limited in situating his home on the lot. The design he has chosen would require that his driveway cross the upper end of the drainage swale. The road crossing of this area has been situated at the highest end of the above mentioned wetland, and would consume approximately 750 square feet. The applicant will prevent a drainage problem and will maintain the wetland connection through the placement of a 12" culvert. The driveway will require the placement of approximately 42 cubic yards of fill, and will be stabilized with a retaining wall along both sides within the wetland area. There appear to be very few alternatives for construction on this lot that would not impact this area of wetlands. The Corps is handling this project as a Nationwide 14. While the applicant is stating that the only area to be graded is the 9276 square feet of the house and driveway footprint, it is more realistic to assume that the majority of the area between the C.O.D. setback and the wetland delineation will be graded for site preparation, or for finishing landscaping. Thus, approximately 17,200 square feet of high ground will be disturbed, and approximately 750 square feet of wetland. The total impervious area is proposed at 9276 square feet, or 24 % of the lot within 575' of mean high water. The home will tie into the county sewer line. The applicant also proposes to lay a concrete walkway from the south side of the driveway to the house. As this crosses the wetland area, a 40' x 5' elevated footbridge will be constructed of timbers. 10. ANTICIPATED IMPACTS The project as proposed would result in the loss of approximately 750 square feet of delineated federal wetland connected to Outstanding Resource Waters. The functions of the drainage swales connected to a pristine creek should not be underestimated, especially in an area targeted for development. However, this wetland fill is located at the upper limits of the swale, where the system is influenced by the installed drainage system. As proposed, the water diverted to this point will be allowed to continue uninterrupted to Howe Creek through the placement of a culvert. By ensuring this connection, the applicant should have few problems associated with constructing a home in close proximity to a wetland area. The homesite itself averages approximately 10' to 15' in elevation. Approximately 17,200 square feet of high ground will be disturbed for the site preparation and landscaping. The finished project will cover approximately 24 % of the lot within 575' of mean high water with impervious surfaces.
