You have our approval to place fill material in 0.02 acres of wetlands or waters for the purpose
of lot fill at Landfall subdivision, Lot 17, Block 14, as-you described in your application dated
15 December 1994. After reviewing your application, we have decided that this fill is covered by
General Water Quality Certification Number 2733. This certification allows you to use Nationwide
Permit Number 18 when it is issued by the Corps of Engineers.
. This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached. certification.- In
addition, you should get any other federal, state or local permits; before you go ahead with your
project.
If you do not accept any of the. conditions of. this: certification, you may ask for an adjudicatoryhearing. You must act within 30. days of the date, that you receive, this letter. To ask for a hearing;
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes, to the;
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401

PROJECT SUMMARY: Applicant proposes the construction of a single family residence that
would consume the upper 960 square feet of delineated 404 wetlands connected to Howe Creek.

9. PROJECT DESCRIPTION 02/06/95
The project site is a residential lot in the Landfall development of New Hanover County. 404
Mason's Point Place is not a riparian lot, but contains wetlands that connect to Howe Creek
some 300' away. The property is within the Outstanding Resource Waters Estuarine Shoreline
AEC.
The lot is approximately 28,864 square feet in size, and extends from 14' to 24' in elevation.
The area is classified as Conservation in the New Hanover County Land Use Plan by virtue of
the fact that it is within a CAMA AEC. Howe Creek is a designated Primary Nursery Area,
and is closed to the taking of shellfish. The waters of the creek are classified SA-ORW by the
Division of Environmental Management.
The majority of this lot is vegetated with pine trees and high ground grasses and undergrowth.
There is a moss laden drainage swale apparently created by a drainage seep and influenced by
the underground french drains installed by the developer. This area is a system of ridges and
swales responding to and resulting in the drainage patterns in the area. The landward end of this
seep still contains high ground grasses and is hummocky. This swale is vegetated by a mixture
of many wetland species Ilex W, Persea borbonia, M• rica_ cerifera, LLyonia lucida, Scirpus =,
Arundinaria i antea, and Andr9pogon glomeratus) and connects to Howe Creek on another lot,
approximately 300' - 350' away. This area has been delineated by the US Army Corps of
Engineers for the presence of 404 wetlands.
Because Landfall requires a 40' street setback, and a side entrance driveway, the applicant is
limited in situating his home on the lot. The design he has chosen would incorporate the upper
end of the drainage swale. The grading and subsequent fill of the lot for site preparation would
result in the filling of approximately 960 square feet of the above mentioned wetlands. There
appear to be very few alternatives for construction on this lot that would not impact this area of
wetlands. The Corps is handling this project as a Nationwide 18.
While the applicant is stating that the only area to be graded is the 7000 square feet of the
structure footprint, it is more realistic to assume that the majority of the lot to the waterward
side of the house will be graded for site preparation for the home or driveway, or for finishing
landscaping. Thus, approximately 23,040 square feet of high ground will be disturbed, and
approximately 960 square feet of wetland. The total impervious area is proposed at 6892 square
feet, or 24 % of the lot within 575' of mean high water. The home will tie into the county sewer
line.
10. ANTICIPATED IMPACTS
The project as proposed would result in the loss of approximately 960 square feet of delineated
federal wetland connected to Outstanding Resource Waters. The functions of the drainage
swales connected to a pristine creek should not be underestimated, especially in an area targeted
for development. However, this wetland fill is located at the upper limits of the swale, where
the system is influenced by the installed drainage system. As proposed, the water diverted to
this point will now pond at the landward side of the residence. The applicant can anticipate
numerous future problems associated with living at the terminus of a drainage swale, and having
a wetland in his backyard.
Approximately 23,040 square feet of high ground will be disturbed for the site preparation and
landscaping. The finished project will cover approximately 24% of the lot within 575' of mean
high water with impervious surfaces.

instrument under which the applicant claims title to the
affected property. If the applicant is not claiming to be
the owner of said property, then forward a copy of the
deed or other instrument under which the owner claims
title, plus written permission from the owner to carry out
the project.

sectional drawings) drawn to scale in black ink on an 8
1/2 x 11 white paper. (Refer to Coastal Resources

only high quality copies will be accepted. Blue-line 2t7
prints or other larger plats are acceptable only if If high
quality copies are provided by applicant (Contact the
U.S. Army Corps of Engineers regarding that agency's

of plat requirements and it must be sufficiently detailed
