NORTH CAROLINA New Hanover County CERTIFICATION THIS CERTIFICATION is issued in conformity with the requirements of Section 401 Public Laws 92-500 and 95-217 of the United States and subject to the North Carolina Division of Environmental Management Regulations in 15 NCAC 211, Section .0500 to Wilmington Resources, Inc resulting in 0.1 acres of wetland impact in New Hanover County pursuant to an application filed on the 5th day of January of 1995 to dredge existing basins, construct a railroad spur. construct boat ramps and replace bulkheads. The Application provides adequate assurance that the discharge of fill material into the waters of NE Cape Fear River in conjunction with the proposed development in New Hanover County will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. Condition(s) of Certification: -That the activity be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction related discharge (50 NTUs in streams and rivers not designated as trout waters by DEM; 25 NTUs in all saltwater classes, and all lakes and reservoirs; 10 NTUs in trout waters). 2. Dredging in the boat basins shall be done to no more than four (4) feet below existing grade. If additional dredging is required, applicant shall submit additional sediment- metal data to DEM:for written approval before dredging commences. 3. Best management practices as outlined in the 12 November. 1994 letter from Mr. Richard Jaross, President of Wilmington Resources to DEM shall be followed at all times during the salvage operation. 4. The final disposal area shall be limed before and after placement of the spoil in order to help immobilize any trace metals. Violations of any condition herein set forth shall result in revocation of this Certification. This Certification shall become null and void unless the above conditions are made conditions of the Federal 404 and/or Coastal Area Management Act Permit. This Certification shall expire upon expiration of the 404 or CAMA permit. If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of Administrative Hearings, P.O. FROM: T. BARRETT Please find enclosed a memorandum from Charlie Stehman and Jim Gregson from the DEM regarding the submittal of information requested. The memorandum states that the information submitted is adequate for evaluation of the project. The applicant has also changed the scope of his application request, and has submitted a new application. This information was completed on 1/3/95, giving the project a new projected decision date of 3/19/95. I am enclosing a copy of the new application as well as a revised field report. Below is an abbreviated version of the project revisions. 1) Maintenance dredging in the large basin will be limited to -20' mlw instead of -25' mlw. Excavation in the small basin will be -10' mlw consistently. Spoil material will be trucked to the spoil site across the railroad tracks (now 200' x 600') after being dewatered at two temporary spoil areas. The temporary areas measure 100' x 100' and 100' x 200'. The two other permanent spoil areas proposed have been eliminated. Excavation will occur by clambucket to barge in the large basin, and dragline to high ground in the small basin. 2) The proposed new dolphins have been eliminated. The existing dolphins will now remain. The pier originally proposed for removal will now remain (250' x 25'). The two work platforms originally proposed have now been eliminated. 3) The applicant proposes the construction of two ramps with rails in the landward end of the large basin. The ramps measure 150' x 75', and 100' x 50', and will have winches at the landward end. The ramps will have a floor of rock, and will have concrete rails on which the vessels rest. Retaining walls will be constructed along the sides of these structures. These structures are necessary in order to remove the ship hulls as they are being cut. The concrete rails on the larger ramp will extend approximately 60' from mean high water. On the smaller ramp, they will extend approximately 20' from mean high water. 4) A railroad spur is to be constructed across the property, measuring approximately 850' x 16'. This will be constructed on high ground with the exception of a 40 square foot pocket of designated 404 wetlands. There is an existing crane way around the large basin. This 40' wide berm is to be extended for 400', and maintained for the existing 650'. There is to be a 160' x 60' open storage building constructed. The existing parking areas are to be regraded and marl placed on them. Attached please find a modified field report reflecting the above changes to the application. PROTECT DESCRIPTION 10/03/94 The project area is a 27 acre tract adjacent to the west side of the Northeast Cape Fear River, approximately 1 mile north of the 3rd Street bridge on Highway 421 North. The property contains several warehouse buildings, a small basin (A) - approximately 130' x 200', a large basin (B) - approximately 280' x 750', a dock extending approximately 200' into the river, and 11 mooring dolphins. The property averages 8' to 12' in elevation, is largely denuded from traffic, and supports typical highground grasses and shrubs. There is a fringe approximately 5' in width of Typha latifolia, Phrag_ ites australis and Iva frutescens along the north side of the small basin. Spartina alterniflora lines the north side of the mouth of the basin. Both basins have a 5'-7' escarpment. There are remains of a bulkhead around the back and south side of the small basin. Soundings in the small basin indicate -5' to -8' water depth at low tide; soundings in the large basin show -8"to -12' water depths connecting to a river depth of -26' mlw. The existing business is serviced by a well and septic tank. Because the business has been operated as one of marine salvaging and construction in the past, there is the possibility of toxins in the existing bottom sediment. Preliminary discussions with representatives from the Division of Environmental Management have revealed concern for the re-introduction of these hazardous materials into the system. The Northeast Cape Fear River is a designated Primary Nursery Area at the project site. The Division of Environmental Management classifies the water as C-swamp, and there is no shellfish resource this far north in the river. The New Hanover County Land Use Plan classification for the project area is Conservation. The applicant is the Wilmington Resources, Inc., formerly known as Delta Marine, Inc. The company is proposing the replacement of a non-functioning bulkhead, maintenance dredging of both basins, the construction of a ramp and rail system, the construction of a railway system, and the construction of a crane way. Basin A is to be dredged to the dimensions of 200' x 100', with a finished depth of -10' mlw. This excavation will avoid the wetland fringe on the north side. Basin B will be dredged to 750' in length, 240' in width, and to a finished depth grading from -12' at the landward end, to -20' at the waterward end. This connects to a river depth of -26' mlw. This will constitute approximately 30,000 cubic yards of sand and silt to be removed by dragline and clam bucket. Spoil will be placed within dike walls toward the western edge of the property fronting highway 421 North. The spoil area measures 600' x 200', and avoids the delineated wetlands in this area. The typical dike wall will be 12' high. This area should have the capacity for approximately 53,000 cubic yards of material. There are two temporary spoil areas along the basins, measuring 100' x 100', and 100' x 200'. Spoil will be carried to the permanent diked area after dewatering in the temporary sites. The necessity for this effort is the prevention of chloride intrusion into the surficial aquifer. This need was made apparent by the Groundwater Section of the DEM. There are two ramps proposed for the landward end of basin B. These measure approximately 150' x 75' and 100' x 50'. They are to be underlain with rock, and contain concrete rails. The rails will extend beyond mean high water approximately 20' on the smaller ramp, and approximately 60' from mean high water on the larger ramp. The applicant proposes to place a retaining wall along the sides of the ramp. Each will have a winch at the landward end. A railroad spur is intended to cross the property, extending for 850' across high ground and a small pocket (40 sf) of designated 404 wetlands. This structure will be approximately 16' in width. The crane way around the large basin exists presently for approximately 650' x 40'. This portion will be upgraded, and another 400 linear feet added. A steel bulkhead is proposed for the back or western portion of the small basin, extending along the southern edge and wrapping around the south east corner. Total linear footage on this structure is approximately 300'. The wall alignment will be approximately 2' from mean high water. Approximately 267 cubic yards of material will be needed for backfill. No wetlands, are to be incorporated by this structure. The existing work platform (250' x 25') and the existing dolphins in and out of the basin are to be utilized as they exist. This platform extends approximately 200' into the river. There is a new storage building proposed for the north side of the property measuring approximately 160' x 601. Existing parking areas will be repaved and new marl placed for stabilization. The intended use of the project will remain commercial. Specifically, the applicants propose a vessel salvage and repair business. 10. ANTICIPATED DvIPACTS The excavation portion of this project will disturb approximately 200,000 square feet of previously dredged bottom area. This will remove approximately 30,000 cubic yards of sand and silt from the system. The temporary and permanent spoil areas, in addition to the ramp system, the railway system, the crane way, and the storage building will cause the filling of approximately 7.75 acres of high ground as well as approximately 40 square feet of designated 404 wetlands. Temporary turbidity increases can be expected during the excavation, which will be accomplished by dragline to truck, and clambucket to barge. The bulkhead will fill approximately 600 square feet of previously dredged basin area. The ramps will fill approximately 3750 square feet of the same. The primary anticipated impact from this project is not from the development but from the intended use. Marina vessel salvage is an activity that must be exercised with upmost caution in order that toxic materials be properly handled and not adversely effect the estuarine system. Based on concerns that basin sediments could be contaminated with toxic metals, we requested that the applicant perform sediment analysis of the material to be dredged from the two basins. Sediment samples were to be collected in two foot increments down to the proposed dredging depth and analyzed using TCLP for metals. Sediment analysis the applicant provided to the Division on December 12, 1994 included data from a series of four foot core samples. At that time the applicants were proposing to remove as much as 14 feet of sediment in some areas. Based on this data we provided comments to John Parker in a memo dated December 27, 1994 which stated that the data submitted by the applicant would be sufficient to complete our review only if dredging in the two basins is limited to removal of no more than four feet of existing sediment. If the applicants propose to dredge the two basins to depths indicated in the October 5, 1994 CAMA Bio-Report, additional sediment analysis would be required for this Office to complete its review of the subject project. Nowhere in the current application package is it explicitly stated that the applicant intends to remove four feet or less of accumulated sediment from the basins. Therefor the CAMA Permit should contain a specific condition that no more than four feet of sediment can be removed from either basin. Review of the analytical results from the basin sediment indicates that metal concentrations are below the "hazardous" levels established by the Toxicity Characteristic Leachate Procedure (TCLP), but several of compounds present have the potential to violate groundwater standards. However, due to the close proximity of the temporary storage area and permanent disposal area to wetlands and the Wilmington Resources boat basin, there appears to be very little distance before groundwater found in the surficial aquifer would discharge into these features. The disposal areas shown in the application are at least 100 feet from any well. The Groundwater Section is concerned that the application states that "Temporary disposal areas, if needed for dewatering of the material, are shown on the plan." The Section recommends that these temporary areas be used so that free water in the spoil be drained off before it is moved to the final disposal area. We also recommend that the final disposal area be limed immediately prior to the placement of the spoil and after disposal (on top of the dredge material). Based on the CAMA Bio-report and the October 11 site visit, significant water quality and groundwater concerns were identified: 1. Due to the history of the site (decades of ship salvage and repair), there is a high probability that the sediment in the basins to be dredged could be contaminated with toxic metals. The applicants are proposing to use draglines and clam shell buckets to dredge the basins. In some areas as much as 14' of sediment will have to be removed. The Water Quality Section is concerned that toxic constituents will be resuspended during dredging. The Groundwater Section is concerned that contaminates in the dredge spoil disposal areas could be leached into the surficial aquifer. Please note that the project site is located along the US Hwy 421 industrial corridor which is situated on a peninsula of land formed at the confluence of the Cape Fear and the Northeast Cape Fear Rivers. This area of New Hanover County depends on the surficial aquifer for water supply. Here, the Castle Hayne Aquifer has been pinched off and the lower Pee Dee Aquifer is brackish. Consequently, wells in this area are very shallow and easily contaminated. If the large disposal area on the west side of the railroad right-of-way is to be used, chloride contamination of the surficial aquifer would also be a concern. 2. Because demolition of the destroyers will occur while the ships are still in the water, the possibility exists that material from cuttings, bilge water, etc., may be released into the surface waters of the Northeast Cape Fear River. 3. During the site visit Charlie Hollis indicated that there was a approximately 100 cu. yd. stockpile of petroleum contaminated soil on the site which was located in a proposed dredge material disposal area. The Groundwater Section has no record of a release of petroleum product at this site having been reported to this Division. Additionally, a a permit application for the remediation of petroleum contaminated soil at this site has not been received by this Office. It 94845.Oct Page Three The above concerns as well as the following additional information needed from the applicant were discussed during the October 13 meeting at the Wilmington Regional Office. 1. Sediment analysis of the material to be dredged from the two basins. Analysis should include core samples from two locations in each basin; near the center of each basin approximately 1/3 and 3/4 of the way into each basin. Each two feet of core sample should be composited and analyzed using TCLP for metals. (For example: if the sample station 2/3 of the way into the basin was currently 12' MLW and was to be dredged to 24' MLW, six two foot composites would need to be collected and analyzed) 2. A step by step procedure to be followed for dismantling the ships should be submitted to this Office for review. Included in this should be an explanation of how material will be prevented from reaching the surface waters during cutting and dismantling. 3. The Groundwater Section should be satisfied that the petroleum contaminated soil issue is resolved and that the site where the release occurred has been determined to be clean. This matter needs to be resolved prior to permitting the spoil disposal site located in this area. Consulting Chemists PROTOCOL FOR BASIN SAMPLING On November 19, 1994 basin sediment samples were obtained from Wilmington Resources site located at 2200 US Highway 421 North. Samples were obtained using a 4 foot length of 14 inch PVC pipe attached to a hollow handle. Sampler was driven at least 4 feet into sediment, determined by measurement on handle, using a hammer. The handle being hollow reduced core compression and was capped off prior to removal to prevent loss of core sample. After removing the 4 foot 14 inch PVC pipe from its handle, the entire core sample was transferred to a container and placed in a cooler with ice. A representative portion of each sample was analyzed for metals by EPA Method 1311 for TCLP. Samples were obtained from center (approximately 75 feet) of large basin at 1/3 (approximately 230 feet) and 3/4 (approximately 525 feet)in from river. Samples were obtained from center (approximately 50 feet) of small basin at 1/3 (approximately 85 feet) and 3/4 (approximately 190 feet) in from the river. The applicant has also changed the scope of his application request, and has submitted a new application. This information was completed on 1/3/95, giving the project a new projected decision date of 3/19/95. I am enclosing a copy of the new application as well as a revised field report. Below is an abbreviated version of the project revisions. 1) Maintenance dredging in the large basin will be limited to -20' mlw instead of -25' mlw. Excavation in the small basin will be -10' mlw consistently. Spoil material will be trucked to the spoil site across the railroad tracks (now 200' x 600') after being dewatered at two temporary spoil areas. The temporary areas measure 100' x 100' and 100' x 200'. The two other permanent spoil areas proposed have been eliminated. Excavation will occur by clambucket to barge in the large basin, and dragline to high ground in the small basin. 2) The proposed new dolphins have been eliminated. The existing dolphins will now remain. The pier originally proposed for removal will now remain (250' x 25'). The two work platforms originally proposed have now been eliminated. 3) The applicant proposes the construction of two ramps with rails in the landward end of the large basin. The ramps measure 150' x 75', and 100' x 50', and will have winches at the landward end. The ramps will have a floor of rock, and will have concrete rails on which the vessels rest. Retaining walls will be constructed along the sides of these structures. These structures are necessary in order to remove the ship hulls as they are being cut. The concrete rails on the larger ramp will extend approximately 60' from mean high water. On the smaller ramp, they will extend approximately 20' from mean high water. 4) A railroad spur is to be constructed across the property, measuring approximately 850' x 16'. This will be constructed on high ground with the exception of a 40 square foot pocket of designated 404 wetlands. There is an existing crane way around the large basin. This 40' wide berm is to be extended for 400', and maintained for the existing 650'. There is to be a 160' x 60' open storage building constructed. The existing parking areas are to be regraded and marl placed on them. Attached please find a modified field report reflecting the above changes to the application. * - Wilmington Resources, Inc. PROTECT DESCRIPTION 10/03/94 The project area is a 27 acre tract adjacent to the west side of the Northeast Cape Fear River, approximately 1 mile north of the 3rd Street bridge on Highway 421 North. The property contains several warehouse buildings, a small basin (A) - approximately 130' x 200', a large basin (B) - approximately 280' x 750', a dock extending approximately 200' into the river, and 11 mooring dolphins. The property averages 8' to 12' in elevation, is largely denuded from traffic, and supports typical highground grasses and shrubs. There is a fringe approximately 5' in width of Typha latifolia, Phra mites australis and Iva frutescens along the north side of the small basin. Spartina alterniflora lines the north side of the mouth of the basin. Both basins have a 5'-7' escarpment. There are remains of a bulkhead around the back and south side of the small basin. Soundings in the small basin indicate -5' to -8' water depth at low tide; soundings in the large basin show -8'-to -12' water depths connecting to a river depth of -26' mlw. The existing business is serviced by a well and septic tank. Because the business has been operated as one of marine salvaging and construction in the past, there is the possibility of toxins in the existing bottom sediment. Preliminary discussions with representatives from the Division of Environmental Management have revealed concern for the re-introduction of these hazardous materials into the system. The Northeast Cape Fear River is a designated Primary Nursery Area at the project site. The Division of Environmental Management classifies the water as C-swamp, and there is no shellfish resource this far north in the river. The New Hanover County Land Use Plan classification for the project area is Conservation. The applicant is the Wilmington Resources, Inc., formerly known as Delta Marine, Inc. The company is proposing the replacement of a non-functioning bulkhead, maintenance dredging of both basins, the construction of a ramp and rail system, the construction of a railway system, and the construction of a crane way. Basin A is to be dredged to the dimensions of 200' x 100', with a finished depth of -10' mlw. This excavation will avoid the wetland fringe on the north side. Basin B will be dredged to 750' in length, 240' in width, and to a finished depth grading from -12' at the landward end, to -20' at the waterward end. This connects to a river depth of -26' mlw. This will constitute approximately 30,000 cubic yards of sand and silt to be removed by dragline and clam bucket. Spoil will be placed within dike walls toward the western edge of the property fronting highway 421 North. The spoil area measures 600' x 200', and avoids the delineated wetlands in this area. The typical dike wall will be 12' high. This area should have the capacity for approximately 53,000 cubic yards of material. There are two temporary spoil areas along the basins, measuring 100' x 100', and 100' x 200'. Spoil will be carried to the permanent diked area after dewatering in the temporary sites. The necessity for this effort is the prevention of chloride intrusion into the surficial aquifer. This need was made apparent by the Groundwater Section of the DEM. There are two ramps proposed for the landward end of basin B. These measure approximately 150' x 75' and 100' x 50'. They are to be underlain with rock, and contain concrete rails. The rails will 0% b .k extend beyond mean high water approximately 20' on the smaller ramp, and approximately 60' from mean high water on the larger ramp. The applicant proposes to place a retaining wall along the sides of the ramp. Each will have a winch at the landward end. A railroad spur is intended to cross the property, extending for 850' across high ground and a small pocket (40 sf) of designated 404 wetlands. This structure will be approximately 16' in width. The crane way around the large basin exists presently for approximately 650' x 40'. This portion will be upgraded, and another 400 linear feet added. A steel bulkhead is proposed for the back or western portion of the small basin, extending along the southern edge and wrapping around the south east corner. Total linear footage on this structure is approximately 300'. The wall alignment will be approximately 2' from mean high water. Approximately 267 cubic yards of material will be needed for backfill. No wetlands are to be incorporated by this structure. The existing work platform (250' x 25') and the existing dolphins in and out of the basin are to be utilized as they exist. This platform extends approximately 200' into the river. There is a new storage building proposed for the north side of the property measuring approximately 160' x 60'. Existing parking areas will be repaved and new marl placed for stabilization. The intended use of the project will remain commercial. Specifically, the applicants propose a vessel salvage and repair business. 10. ANTICIPATED EMPACTS The excavation portion of this project will disturb approximately 200,000 square feet of previously dredged bottom area. This will remove approximately 30,000 cubic yards of sand and silt from the system. The temporary and permanent spoil areas, in addition to the ramp system, the railway system, the crane way, and the storage building will cause the filling of approximately 7.75 acres of high ground as well as approximately 40 square feet of designated 404 wetlands. Temporary turbidity increases can be expected during the excavation, which will be accomplished by dragline to truck, and clambucket to barge. The bulkhead will fill approximately 600 square feet of previously dredged basin area. The ramps will fill approximately 3750 square feet of the same. The primary anticipated impact from this project is not from the development but from the intended use. Marina vessel salvage is an activity that must be exercised with upmost caution in order that toxic materials be properly handled and not adversely effect the estuarine system. The tanks are cleaned with a biodegradable cleaning solution and further checked as each portion of the ship is cut (C) We built a barge (with collection pans on it), which sets alongside the ship to collect slag which might come off the vessel during cutting procedures. Basin sediment sample analyses were requested by the Wilmington Regional Office as part of our review of the CAMA Major Permit Application. Based on the sample results, the following additional comments are provided: Data submitted will be sufficient to complete our review of the Subject dredging project only if dredging in the basins is limited to removal of no more than four feet of existing sediment. If this is the case, it is recommended that the applicant submit a revised permit application containing new proposed dredging depths. 2. As you will recall, the application was accepted for processing on October 4. Approximately half of the state agencies that review CAMA permit applications have commented to date. Several of the respondents are looking to this office to request additional information of you, the applicant. And we received formal notification from the Division of Environmental Management on November 1 of that agency's need for sediment analysis of ' the basin, discussion of spoil area contamination, and containment during the dismantling procedure. Expanding on the latter, is a dry dock operation with appropriate containment and clean up proposed? If not, please explain how it is possible to prevent spills, debris and particulate matter from going overboard? The Division of Coastal Management is also in need of such information and supports the request of DEM. Therefore, under the rules of the Coastal Resources Commission, application processing is placed in abeyance until that information is received and determined to be complete and accurate. In addition to the information covered in detail in the November 1 letter from Mr. John Dorney of DEM, this office requests that you clarify the corporate relationship between Delta Marine and Wilmington Resources. The information available at this time clearly indicates that Delta Marine is the property owner. Since CAMA permits are most often issued to the owner, at the very least we require written permission from Delta Marine for Wilmington Resources to apply for permits and carry out specified work. Finally, inasmuch as the state is reviewing its authority and responsibility in preventing undue usurpation of public trust waters, it is recommended that additional vessels not be moved into the River or other waters of the state at this time. And in order that we may conclude such review, it is requested that you also inform this office of the operational status of the vessels. In the simplest of terms, with proper crew aboard, can the ships be moved under their own power. P.O. At this extremity, we will install a winch mechanism on steel piling to be used for palling the remaining hull bottoms to dry land for final dismantling. 2. 1,QCATION "B": At the southwest end of the Basin we propose to build a smaller earthen ramp 50 ft. wide at the high water line by 25 ft. in width at the western extremity 100 ft. away. LOCATION "C"• We propose to build a bulkhead on dry laud along the north edge of the Basin alongside the crane roadway. This bulkhead will be of "H" pile and treated timber construction. 4. CRANE ROADWAY: We propose to rebuild existing earthen crane roadway for use by our cranes along the western extent of the Basin and work area. Enclosure (2) shows that this roadway was in place and use in 1973. Enclosures (3) & (4) (1986 & 1990), indicate less definition of roadway through lack of use by property owner. Bear in mind this property has been in continuous industrial and marine use since the early 1900(s). 5. LOCATION "D": We propose to install a railroad spur from existing CSX line through our property. This work will be done entirely outside the 75 ft estuarine set back area and does not involve any wetland. This area has been engineered and submitted to same for construction.. 6. BASIN "B": Basin "B" has an existing dilapidated bulkhead along its southern edge. We propose to rebuild this timber bulkhead in its present configuration. -3- 7. LOCATION "E: Sediment analyses have been made in both Basins. Results of these analyses will be forwarded as soon as received in our office. Wetland (Location "E"} will be submitted for wetland fill as soon as a permit is granted. 8. OTHER PROPOSED WOM All other proposed work involves rebuilding/repairing existing structures. We trust that this outline adequately defines the ongoing work we propose at the Northeast Cape Fear River site. The Division of Coastal Management is also reviewing the project for a CAMA Permit. Both Permits require a 401 Water Quality Certification from the N.C. Division of Environmental Management since fill of waters is required. A 401 Water quality Certification is a statement that water quality standard will not be violated. According to the Clean Water Act, this Certification must be issued before either the 404 or CAMA Permits can be issued. Before we can make this determination for you project, some additional information will be required as outlined below. Since insufficient information exists upon which to make a 401 decision, I hereby request that the Division of Coastal Management and U.S. Army Corps of Engineers place your project on hold until that information is available. We are concerned about the chemical nature of the sediments in the basin proposed to be dredged. In order to determine whether water quality standards would be violated, sediment analyses must be done on the material from the basins. Core samples shall be taken from two locations in each basin; near the center approximately 1/3 and 3/4 of the way into each basin. Each two feet of core sample shall be composited and analyzed using TCLP method (Toxicity Characteristic Leaching Procedure) for metals. These data will allow us to determine appropriate special design criteria (if any) for the dredging and disposal sites. The proposed disposal site apparently has been contaminated with petroleum. We are concerned that if spoil is added to this site, it will force the petroleum products into the surface water or nearby drinking water wells. Before this site can be approved for disposal, the DEM Groundwater Section in the Wilmington Regional Office must have sufficient information to assure that the site is clean. Finally, we are concerned about material entering surface water during the cutting and dismantling of the vessels. RECON51ENDED CONDITIONS OR PERMIT RESTRICTIONS: A site visit was conducted on October 11, 1994 with the applicants consultant, (Charlie Hollis) and Charlie Stehman of the Groundwater Section. A follow-up meeting was held on October 13, 1994 in the Wilmington Regional Office. The attendance roster for this meeting is attached. Based on the CAMA Bio-report and the October 11 site visit, significant water quality and groundwater concerns were identified: 1. Due to the history of the site (decades of ship salvage and repair), there is a high probability that the sediment in the basins to be dredged could be contaminated with toxic metals. The applicants are proposing to use draglines and clam shell buckets to dredge the basins. In some areas as much as 14' of sediment will have to be removed. The Water Quality Section is concerned that toxic constituents will be resuspended during dredging. The Groundwater Section is concerned that contaminates in the dredge spoil disposal areas could be leached into the surficial aquifer. Please note that the project site is located along the US Hwy 421 industrial corridor which is situated on a peninsula of land formed at the confluence of the Cape Fear and the Northeast Cape Fear Rivers. This area of New Hanover County depends on the surficial aquifer for water supply. Here, the Castle Hayne Aquifer has been pinched off and the lower Pee Dee Aquifer is brackish. Consequently, wells in this area are very shallow and easily contaminated. If the large disposal area on the west side of the railroad right-of-way is to be used, chloride contamination of the surficial aquifer would also be a concern. 2. Because demolition of the destroyers will occur while the ships are still in the water, the possibility exists that material from cuttings, bilge water, etc., may be released into the surface waters of the Northeast Cape Fear River. 3. During the site visit Charlie Hollis indicated that there was a approximately 100 cu. yd. stockpile of petroleum contaminated soil on the site which was located in a proposed dredge material disposal area. The Groundwater Section has no record of a release of petroleum product at this site having been reported to this Division. Additionally, a a permit application for the remediation of petroleum contaminated soil at this site has not been received by this Office. 94845.Oct Page Three The above concerns as well as the following additional information needed from the applicant were discussed during the October 13 meeting at the Wilmington Regional Office. 1. Sediment analysis of the material to be dredged from the two basins. Analysis should include core samples from two locations in each basin; near the center of each basin approximately 1/3 and 3/4 of the way into each basin. Each two feet of core sample should be composited and analyzed using TCLP for metals. (For example: if the sample station 2/3 of the way into the basin was currently 12' MLW and was to be dredged to 24' MLW, six two foot composites would need to be collected and analyzed) 2. A step by step procedure to be followed for dismantling the ships should be submitted to this Office for review. Included in this should be an explanation of how material will be prevented from reaching the surface waters during cutting and dismantling. 3. The Groundwater Section should be satisfied that the petroleum contaminated soil issue is resolved and that the site where the release occurred has been determined to be clean. This matter needs to be resolved prior to permitting the spoil disposal site located in this area. The site of this work is at the existing yard of the former Delta Marine, Inc. (previously Somersett, Atkinson, Wickstrom, etc.). This work is primarily maintenance, repair and replacement of existing facilities and the maintenance dredging of the two existing barge slips. The existing facilities and barge slips have been present and in use for more than 30 years as evidenced by Corps of Engineer Permit No. 21-63 issued in 1963 for improvement of existing facilities at the site. Page 2 New work will consist of removal of the existing cellular dolphins (permitted in 1963) and their replacement with traditional pile-cluster dolphins in the same location. New work will also consist of the construction of two filled work platforms along the edge of the existing larger barge slip. Work platforms have previously consisted of floating barges somewhat permanently anchored along the slip edge. The proposed new work platforms will each measure 100 feet long and extend 20 feet from the upper edge of the slip. They will consist of steel sheet-pile cells filled with a sand/rock/concrete mixture so as to provide a stable and strong platform for cranes and other equipment working alongside vessels floating in the slip. There is no grass or other vegetation to be filled. Maintenance work includes the replacement of a failed bulkhead along two sides of the smaller barge slip. The existing broken bulkhead will be removed and a new sheet-pile bulkhead installed. Maintenance dredging is proposed for both barge slips. The smaller slip is to be dredged to a depth of 12 feet mlw and the larger slip to a depth of 25 feet mlw at its riverward end, tapering to 0 feet at its landward end. All dredging will be done with draglines, backhoes, and/or clamshells. All dredged material will be deposited into diked high-ground disposal areas located onsite on the applicant's property. These areas will be leveled and grassed when the dredged material has dried sufficiently to allow such work. Request for sedimentation and erosion control permits are being prepared for submittal to New Hanover County; a copy will be provided to you. It is requested that this request be given your earliest attention. Ongoing vessel salvage and other work is proceeding only by forcing the vessels into the slips at high tide creating a somewhat unstable situation since the vessels can then not be easily moved again. SIGMA MARINA, INCORPORATED/WILMINGTON RESOURCES, INCORPORATED, 2200 U.S. Highway 421 North, Post Office Box 2140, Wilmington, North Carolina 28492, has applied for a Department of the Army (DA) permit TO MAINTAIN/DEEPEN TWO BASINS, REPLACE DOLPHINS, CONSTRUCT AND BACKFILL TWO (2) WORK PLATFORMS AND REPAIR AND BACKFILL BULKHEADS ON THE NORTHEAST CAPE FEAR RIVER, The following description of the work is taken from data provided by the applicant and from observations made during a site visit by a representative of the Corps of Engineers. Plans submitted with the application show proposed excavation, using draglines, backhoes and/or clamshells, in two (2), manmade basins. The 240-foot-wide, 750-foot-long basin is to be excavated to 25 feet, mean low water (MLW). The 100-foot-wide, 240-foot basin is to be excavated to twelve (12) feet MLW. The depths in both basins are to taper to the MLW elevation contour at the landward ends. The approximate 50,000 cubic yards of material, excavated from the basins, is to be placed in highground retention areas on the applicant's property. Existing cellular dolphins are to be replaced with pile-cluster dolphins. Existing floating barges along the edge of the larger slip are to be replaced with two (2) filled, 20-foot-wide, 100-foot-long work platforms. The platforms are to be constructed using sheet-pile cells backfilled with sand, rock and or concrete. Within the smaller basin, deteriorated perimeter bulkheads are to be replaced with sheet-pile structures. The purpose of the work is to improve facilities for vessel salvage, repair and construction activities. Plans showing the work are included with this public notice. { 2 The applicant has determined that the proposed work is consistent with the North Carolina Coastal Zone Management Plan and has submitted this determination to the North Carolina Division of Coastal Management (NCDCM) for their review and concurrence. This proposal shall be reviewed for the applicability of other actions by North Carolina agencies such as: a. The issuance of a Water Quality Certification under Section 401 of the Clean Water Act by the North Carolina Division of Environmental Management (NCDEM). b. The issuance of a permit to dredge and/or fill under North Carolina General Statute 113-229 by the North Carolina Division of Coastal Management (NCDCM). C. The issuance of a permit under the North Carolina Coastal Area Management Act (LAMA) by the North Carolina Division of Coastal Management (NCDCM) or their delegates. d. The issuance of an easement to fill or otherwise occupy State-owned submerged land under North Carolina General Statute 143-341(4), 146-6, 146-11, and 146-12 by the North Carolina Department of Administration (NCDA) and the North Carolina Council of State. e. The approval of an Erosion and Sedimentation Control Plan by the Land Quality Section, North Carolina Division of Land Resources (NCDLR), pursuant to the State Sedimentation Pollution Control Act of 1973 (NC G.S. 113 A-50-66). The requested Department of the Army (DA) permit will be denied if any required State or local authorization and/or certification is denied. No DA permit will be issued until a State coordinated viewpoint is received and reviewed by this agency. Recipients of this notice are encouraged to furnish comments on factors of concern represented by the above agencies directly to the respective agency, with a copy furnished to the Corps of Engineers. 3 Approval of this permit will give Federal authorization for maintenance dredging for a period of time not to exceed 10 years from the date of permit issuance. The permittee will be required to present plans to the District Engineer a minimum of 2 weeks prior to commencement of such maintenance work. All maintenance would be performed in accordance with Federal, State, and local permits and regulations governing such activities at the time the maintenance is undertaken. This application is being considered pursuant to Section 10 of the River and Harbor Act of 1899 (33 U.S.C. 403) and Section 404 of the Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within the comment period specified in this notice, that a public hearing be held to consider this application. Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this site is not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register constitutes the extent of cultural resource investigations by the District Engineer, and he is otherwise unaware of the presence of such resources. Presently, unknown archeological, scientific,. prehistorical, or historical data may be lost or destroyed by work under the requested permit. The District Engineer, based on available information, is not aware that the proposed activity will affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each 4 particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards and flood plain values (in accordance with Executive Order 11988), land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agencies' 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. The Corps of Engineers is soliciting comments from the public; Federal, State and local agencies and officials; Indian Tribes and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to determine whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects and the other public interest factors listed above. Comments are used in the preparation of an Environmental Assessment (EA) and/or an Environmental Impact Statement (EIS) pursuant to the National Environmental Policy Act (NEPA). Comments are also used to determine the need for a public hearing and to determine the overall public interest of the proposed activity. 5 Generally, the decision whether to issue this Department of the Army (DA) permit will not be made until the North Carolina Division of Environmental Management (NCDEM) issues, denies, or waives State certification required by Section 401 of the Clean Water Act. PROJECT SUNIMARY: Applicant proposes the renovation of a vessel salvage operation consisting of dolphin replacement, maintenance dredging, bulkhead replacement, and platform construction. PROTECT DESCRIPTION 10/03/94 The project area is a 27 acre tract adjacent to the west side of the Northeast Cape Fear River, approximately 1 mile north of the 3rd Street bridge on Highway 421 North. The property contains several warehouse buildings, a small basin (A) - approximately 130' x 200', a large basin (B) - approximately 280' x 750', a dock extending approximately 200' into the river, and 11 mooring dolphins. The property averages 8' in elevation, is largely denuded from traffic, and supports typical highground grasses and shrubs. There is a fringe approximately 5' in width of T ha latifoli a, Phragmites australis and Iva frutescens along the north side of the small basin. Spartin_a alterniflora lines the north side of the mouth of the basin. Both basins have a 5'-7' escarpment. There are remains of a bulkhead around the back and south side of the small basin. Soundings in the small basin indicate 5' to 8' of water at low tide; soundings in the large basin show - 8' to -12' water depths connecting to a river depth of -26' mlw. o uA The existing business is serviced by a well and septic tank. Because thinmentaI ' ess has been operated as marine salvaging and construction in the past, there is the possibility of tin the existing bottom sediment. Preliminary discussions with representatives from the Division of En Management have revealed concern for the re-introduction of these hazardous materials into the system. The Northeast Cape Fear River is a designated Primary Nursery Area at the project site. The Division of Environmental Management classifies the water as C-swamp, and there is no shellfish resource this far north in the river. The New Hanover County Land Use Plan Classification for the project area is Conservation. The applicant is the Wilmington Resources, Inc., formerly known as Delta Marine, Inc. The company is proposing the replacement of dolphins and pilings, the replacement of a non- functioning bulkhead, maintenance dredging of both basins, and the construction of two solid work platforms. Basin A is to be dredged to the dimensions of 200' x 1001, with a finished depth of -12' mlw. This excavation will avoid the wetland fringe on the north side. Basin B will be dredged to 750' in length, 240' in width, and a finished depth grading from the current depth of -8' at the landward end, to -25' at the waterward end. This connects to a river depth of -26' mlw. This will constitute approximately 50,000 cubic yards of sand and silt to be removed by dragline or backhoe. Spoil will be placed within three sets of dike walls - toward the western edge of the property fronting highway 421 North, to the west and northwest of the large basin, and to the small area between the two basins. The three spoil sites measure 650' x 300', 500' x 250', and 150' x 200' respectively. The typical dike wall will be 12' high. These areas should be able to contain approximately 155,554 cubic yards of material, or approximately 3 times the amount of proposed excavated material. The property has been surveyed for 404 wetlands which occur at the far western portion of the lot. All fill is to avoid this area. . A steel bulkhead is proposed for the back or western portion of the small basin, extending along the southern edge and wrapping around the south east comer. Total linear footage on this structure is approximately 300'. The wall alignment will be approximately 2' from mean high water. Approximately 267 cubic yards of material will be needed for backfill. No wetlands are to be incorporated by this structure. The applicant proposes the construction of two work platforms along the north side of the large basin. These platforms are both to be 100' x 35' in size, with 20' of the width extending below mean high water. The platforms are not to be pile supported, but steel sheet cells filled with concrete. The steel sheeting is tantamount to a bulkhead arranged in a rectangular shape. Approximately 600 cubic yards of material is anticipated for this use. The structures are intended to support the weight of construction equipment. Lastly, the applicant proposes the removal of the existing work platform, or dock, and replacement with mooring dolphins. There will be a finished total of 9 mooring dolphins, rather than the 11 existing. The dolphins will be placed within the large basin, and along the shore between the basins approximately 150' from the shoreline. This distance is approximately 100' from the federally maintained channel. The intended use of the project will remain commercial. Specifically, the applicants propose a vessel salvage and repair business. 10. ANTICIPATED IMPACTS The excavation portion of this project will disturb approximately 200,000 square feet of previously dredged bottom area. This will remove approximately 50,000 cubic yards of sand and silt from the system. The spoil areas along with the high ground portion of the work platforms will cause the fill of approximately 8.1 acres of high ground. Temporary turbidity increases can be expected during the excavation, which will be accomplished by dragline or backhoe to high ground or barge. The work platforms will cause the fill of approximately 4,000 square feet of previously dredged basin area. The bulkhead will fill approximately 600 square feet of same. The mooring dolphins will incorporate approximately 1.8 acres of public trust area, approximately 1,400 square feet of which is within a man made high ground basin. The primary anticipated impact from this project is not from the development but from the intended use.
