After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2671. This certification allows you to use Nationwide Pen-nit Number 26 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of -the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. Dorney - Water Quality Planning 401 ISSUED NC Division of Environmental Management - NCDEHNR PO Box 29535 Raleigh, NC 27626 - 0535 Re: Request for a General 401 Water Quality Certification for Villages of Lake Norma Mecklenburg County Dear John, On behalf of Mr. Gary Cangelosi of Village Lake Development Corporation, I am requesting a 401 Water Quality Certification - NWP #26 to impact approximately ± 0.29 Acres of headwaters to develop this residential site in Mecklenburg County. It is in the rapidly developing Lake Norman area north of Charlotte. The total Jurisdictional Waters of the US on the site is approximately ± 0.49 acres. The site is near the intersection of NC Hwy 73 and Sam Fuir Road near Exit 28 @ I-77 and is adjacent to abandoned and active agricultural land, and residential developments. The majority of the site is made up of steep to moderately steep side slopes of a small drainage area and intermittent tributary of McDowell Creek as depicted by the topography on the site plan. Generally, the site is wooded on the steeper slopes while the less severe slopes are open agricultural land. The site is also crossed by powerline and natural gas line right-of-way clearings. Hydrophytic vegetation in drainage and wetland areas include tulip poplar, sweetgum, red maple, ironwood, emergent vegetation in clearings, overgrowth where there has been Hurricane Hugo and dense damage. The soils on the site are Cecil sandy clay loam (CeB2,CeD2), Pacolet sandy loam (PaE), and Enon sandy loam (EnD), which are typical upland soils. Jurisdictional Waters of the US consist of a small incised headwater tributary of McDowell Creek and small associated wetland pockets and seasonal seeps. Water Classification is WS-IV. Proposed impacts to Jurisdictional Waters of the US are primarily due to the construction of required BMP's and general site development. The developer will also require strict adherence to an approved Sedimentation and Erosion Control Plan to protect the area during construction. I have informed my client that a formal application will also be required to the NCDEM if the plans change and impacts to headwaters exceed 1/3 acre and to the US Army Corps of Engineers impacts are 1 Acre or greater to headwaters.
