Kobel Bob Neill & Associates, Inc. 2121 Commonwealth Avenue Suite 200 Charlotte, N.C. 28205-5100 Dear Mr. Kobel: You have our approval to place fill material in 0.27 acres of wetlands or waters for commercial fill, the site is located in the drainage area of Forney Creek, as you described in your application dated 24 November 1995. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2671. This certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. Kobel of Bob Neill & Associates, Inc., I am requesting confirmation of the extents of Jurisdictional Waters on the proposed commercial site and eligibility to utilize NWP 426 and 401 Water Quality Certification to impact + 0.27 Acres of headwaters. The site is within a drainage area of Forney Creek (Water Classification - C), a headwater tributary of Killian Creek which flows to Dutchman's Creek. It is in the Catawba River Basin. The majority of the site is an upland ridge with moderately steep to steep side slopes to a well defined drainageways. The soils according to SCS Soil Survey on site include Pacolet sandy clay loam (PeC2), and Winnsboro fine sandy loam (WnB), both typically well drained upland soils. The site is currently wooded in mixed forest. Hydrophytic vegetation, primarily Facultative and Facultative Wet, occurs along the slopes of the drainage ways and the bank of tributaries. Based on my on-site assessment on November 17 and 22, jurisdictional waters are limited to these bank to bank tributaries and a very small seep area near a tributary as depicted on the plan. I have also informed my client that an application to the NCDEM will be required if the project area changes and impacts to jurisdictional waters exceed 1/3 Acre for a 401 Water Quality Certification.
