Dear Mr. Halt:
You have our approval to place fill materi al in 0.11 acres of wetlands or waters for the purpose
of constructing a residential subdivision at Colony and Summerlin Roads, as you described in your
application dated 27 November 1995. After reviewing your application, we have decided that this fill
is covered by General Water Quality Certification Numbers 2733 and 2671. These certifications allow
you to use Nationwide Permit Numbers 18 and 26 when they are issued by the Corps of Engineers,
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get any other federal, state or local permits before you go ahead with your
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401

Dear Steve:
On behalf of Mr. Bryan Halt of LandCraft Properties, Inc., I am requesting confirmation
of eligibility to utilize NWT# 18 to impact ±0.05 Acres of wetlands below the headwaters
of McAlpine Creek, and NWT #26 to impact + 0.06 Acres of headwaters to develop this
+ 23 Acre residential site in Charlotte. This site is in the south area of Charlotte. The
jurisdictional waters were evaluated in October, 1995 and verified by the USACE on
11/1/95.
The majority of the site is moderately sloped ridge with no well defined drainageway.
The soils according to SCS Soil Survey on site are made up of typically well drained soils
including Iredell fine sandy loam (IrB), Mecklenburg fine sandy loam (MeB), and Wilkes
Loam (WkB). Vegetation includes mixed hardwoods to extremely dense scrub/shrub
overgrowth with blackberry, sericea lespedeza, and honeysuckle in various stages of
succession . Much of the areas of the woodlands were impacted by Hurricane Hugo.
Facultative (FAC and FACW) vegetation is common along the small intermittent
tributary and in the small wetland area. The wetland area under the powerline includes
smartweed, and soft rush.
The total area of Jurisdictional Waters on the site is + 0.11 acres based on my site
evaluation and USAGE verification and are limited to a small bank to bank intermittent
tributary and a small wetland area under the powerline. The plan depicts that most of the
impact area will be utilized for lots and general development requirements.
A review of USGS Maps at the Natural Heritage Program on 11/13 did not indicate any
endangered species identified on the site. Schweinitz's sunflower is known to occur in a
variety of soil types such as Iredell, Enon, Cecil, Meisenheimer, Gaston, and Zion. The
area with Iredell soils which occur on this site is heavily wooded and does not appear to
be habitat for this species. The powerline clearing is in extremely heavy overgrowth
consisting of blackberry, honeysuckle, and lespedeza and traverses through Mecklenburg
and Wilkes Soils. The Office of State Archaeology, and the Survey and Restoration
Branch, was also visited in Raleigh on 11/13 and no previously identified historical or
archaeological sites were indicated. The developer will require strict adherence to an
approved Sediment and Erosion Control Plan and I have informed my client that an
application to the NC Division of Environmental Management will be required if the
development area changes and impacts of 1/3 acre or greater to Jurisdictional Waters are
necessary.
