Route 2, Box 92-D Mount Gilead, N.C. 27306 Dear Sirs: I v . \ !; WA ?EHNR October 6, 1995 Montgomery County DEM Project # 951074 You have our approval to place fill material in 0.01 acres of wetlands or waters for the purpose of constructing a road to a landfill at Montgomery County landfill, as you described in your application dated 4 October 1995. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2732. This certification allows you to use Nationwide Permit Number 14 when it is issued by the Corps of Engineers. This action supplements a Certification under Nationwide Permit 26 issued on 13 January 1995. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. The site is located southwest of the town of Troy bordering SR 1137 (Figure 1). Approximately 0.85 acre of headwater wetland was affected by expansion. The U. S. Army Corps of Engineers provided authorization for this action under Nationwide Permit #26 on January 13, 1995 (see attached permit; Action ID No. 199500806)). In addition, 401 Water Quality Certification was approved for the project on January 25, 1995 (see attached Certification; DEM #941045). Environmental Services, Inc. (ESI) performed the initial evaluation of the site in 1992 and 1993, and ESI assisted with preparation of the initial PDN application. As part of the implementation phase of the project, it has been determined that access to borrow areas in existing portions of the landfill site south of SR 1137 will be required.. A proposed access road to the borrow site will cross a small, intermittent tributary approximately 4 feet in width (Figure 2). This system is a bank-to-bank headwater tributary with no adjacent wetlands. A culvert will be placed in the channel to allow for continued, intermittent flow. Approximately 0.01 acre of surface waters may be affected by access road construction. Project impacts associated with previously permitted wetland encroachment, in addition to the current requested roadway, total 0.86 acre. Therefore, we request that the existing 401 Water Quality Certification for the landfill project be modified to accommodate this additional impact. A revised PDN application and accompanying information is being submitted for your review. By copy of this letter and PDN application, we are requesting review by COE for continued compliance under Nationwide Permit #26 (we realize there is no notification required to COE for less than 1 acre under Nationwide Permit #26, however, a courtesy copy is being provided for review). Fish and Wildlife Service was contacted for comment regarding impacts to federal protected endangered or threatened species. The Service agreed that no impacts were anticipated. In addition, the N.C. Natural Heritage Program indicated that the proposed project would not likely cause adverse impacts to any state parks, state recreation or scenic areas, or state natural or historic preserves. The project was coordinated with the N.C. State Historic Preservation Office (SHPO) and no impacts to cultural resources were found to exist. Based on these initial evaluations, we do not anticipate impacts to protected species, state priority areas, or cultural resources as a result of proposed access road improvements. Review of this revised PDN application and accompanying information is appreciated. This verification will remain valid for the two years if, during that period, the nationwide permit authorization is reissued without modification or the activity complies with any subsequent modification. If during the two years, the nationwide permit authorization expires or is suspended or revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the nationwide permit, activities which have commenced or are under contract to commence, in reliance upon the nationwide permit, will remain authorized.
