Autrey 2922 Greenbriar Drive Sanford, N.C. 27330 Dear Mr. Autrey: FIL E COPY You have our approval to place fill material in 1.12 acres of wetlands or waters for the purpose of constructing the proposed N.C. Motorsports racing complex along US Highway 1, as you described in your application dated 14 September 1995. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2671. This certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. Additional written approval is needed for a stormwater management plan including wet detention ponds before construction begins. Please contact Mr. Bradley Bennett at (919) 733-5086 ext. 525 to initiate the stormwater approval process. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. Introduction North Carolina Motorsports, Inc. (NCMS) plans to develop a -161 acre site in Moore County, North Carolina. The site is located just north of the town of Vass, along U.S. Highway #1 (US 1), near the intersection of US 1 and Thurlow Road (SR 1826). A Sig mile drag strip and "Legends" track are to be located on the site. The site is divided into three distinct tracts of land. The largest tract is located to the West of US 1 and to the South of SR 1826. This tract contains 135.70 acres of land and 23.23 acres of jurisdictional wetlands. The second tract is located to the West of US 1 and to the North of SR 1826. This tract contains 2.54 acres of land and no jurisdictional wetlands. The third tract is located to the East of US 1, across from the first tract of land. This tract contains 22.89 acres of land and 0.35 acres of jurisdictional wetlands. The total land area contained in the site is 161.13 acres and the total jurisdictional wetland area is 23.58 acres. Preliminary plans for the proposed project indicate that jurisdictional wetlands will be impacted at three locations on the site. These plans indicate that approximately 1.12 acres of wetlands would be impacted by filling. NCMS has retained C. H. Blue and Associates, P.A. to assist with the planning and permitting of the project. Impact Areas The locations of the three areas on the site where jurisdictional wetlands will be impacted are at (A) the drag strip crossing, (B) the RN camp ground area, and (C) the RN camp ground area and regular parking area near the railway right-of-way. The largest area of impact (A) does not appear to have been disturbed by any type of development or farming for at least one hundred (100) years. The stream which flows though this area is in a more or less distinct channel. The stream is likely perennial, though this is not certain. Vegetation consists of a thin canopy of large Black Gum (Nyssa), and smaller Red Maples (Ater rubrum), and Tulip Poplars (Liriodendron tulipifera). The mid-canopy species consist of Tulip Poplar, Sourwood (Oxydendrum arboreum), Sweet Bay (Magnolia virginiana), and Smilax species. Shrub species consist of Virginia Willow (Itea virginica), Viburnum (Viburnum nudum), Sweet Pepperbush (Clethra alnifolia), and Tag Alder (Alnus serrulata). The herb layer contains predominately ferns (Osmunda cinnamomea, Osmunda regalis) and sphagnum moss. Approximately 0.83 acres of jurisdictional wetlands would be filled at this location by the proposed development. 1 of 3 The second area (B) is an intermittent wetland in a wooded area. Due to the small extent of this wetland it is nearly entirely overhung by surrounding large trees. In most instances, trees within this wetland are very young, reaching barely into the mid-canopy. This area may be a seasonal seepage area. Vegetative cover consists of Willow Oak (Quercus phellos), White Oak (Quercus alba), Water Oak (Quercus nigra), and Sweet Gum (Liquidambar styriciflua). Other vegetative cover consists of Yellow Jessamine (Gelsemium sempervirens), Partridge Berry (Mitchella repens), grass species, and mosses. Approximately 0.12 acres of jurisdictional wetlands would be filled at this location by the proposed development. The last area (C) may be associated with the adjacent field, (not presently in cultivation). This wetland is an elongated seep or drain, and may be somewhat wet throughout most of the year. Trees and shrubs surround this area, with no large trees in the wetter areas. Canopy species consist of Red maple (Acer rubrum), Sweet Gum (Liquidambar styriciflua), Willow (Salix spp), and Loblolly Pine (Pinus taeda). Shrub species consist of Sweet Bay (Magnolia virginia), Privet (Ligustrum spp), and Elderberry (Sambucus canadensis). Herbaceous species include Knotweed (Polygonum spp), Goldenrod (Solidago spp), Poison Oak (Toxcodendron toxocodendron) and ferns. Approximately 0.17 acres of jurisdictional wetlands would be filled at this location by the proposed development. Functions and Values A primary function of wetland area A, as part of the larger wetland area, has been to filter runoff from nearby agricultural fields. Many nearby fields are not presently cultivated and the primary beneficial function of this area may now be wildlife habitat due to its diverse vegetation. Loss of this area may impact wildlife due to the loss of connectivity between wetland areas. The non-wetland areas immediately adjacent are forested and runoff from these areas is presently limited. The functions and values of wetland area B is limited due to its small size and location within an undeveloped, undisturbed wooded area. Limited runoff flows into this wetland and the other wetlands due to the high infiltration capacity of the surrounding sandy (Candor series) soils. It may have limited function due to it's location above a small pond (on adjacent property) where it may serve to buffer hydraulic and sediment loading of the pond. Loss of this area may have limited impact upon-the pond. The function of wetland area C is also limited due to its small size and location. Flow from this area was not observed. The adjacent areas are previously cultivated fields with a narrow buffer strip of wooded area between. This area likely filtered agricultural runoff from the adjacent field (not presently cultivated). It may also function as an ephemeral pool. The value of this area may be somewhat dependent upon cultivation of the nearby field. 2of3 Endangered Species No endangered species were observed on the site. Impact to the Red-Cockaded Woodpecker (Picoides borealis) was discussed with Mark Cantrell, the U. S. Fish & Wildlife Service official responsible for oversight of its recovery in the area. It was determined that the site lies outside the known range of existing Red-Cockaded Woodpecker colonies. Client's Position The presence of jurisdictional wetlands on the site were at first seen by NCMS as an obstacle to development of the site. This position has changed during the course of preliminary planning. The jurisdictional wetlands are now seen by NCMS as an asset by creating a buffer area to help reduce noise pollution and reduce the occurrence of individuals gaining entry without purchasing a ticket. Summary NCMS understands the need for compliance with all state and federal laws concerning jurisdictional wetlands and their associated processes. The development of this site will impact 1.12 acres of jurisdictional wetland at three different locations on the property. The impact on jurisdictional wetlands and their associated processes has been considered throughout the planning phase of the project. Design changes been made to minimize impacts to jurisdictional wetlands. The area where the drag strip will cross is very diverse. This area may have considerable wildlife value. The other areas are likely limited in function and value due to their small size and location in the landscape. Impact Areas The locations of the three areas on the site where jurisdictional wetlands will be impacted are at (A) tfie drag strip crossing, (B) the RN camp ground area, and (C) the RN camp ground area and regular parking area near the railway right-of-way. The largest area of impact (A) does not appear to have been disturbed by any type of development or fanning for at least one hundred (100) years. The stream which flows though this area is in a more or less distinct channel. The stream is likely perennial, though this is not certain. Vegetation consists of a thin canopy of large Black Gum (Nyssa), and smaller Red Maples (Ater rubrum), and Tulip Poplars (Liriodendron tulipifera). The mid-canopy species consist of Tulip Poplar, Sourwood (Oxydendrum arboreum), Sweet Bay (Magnolia virginiana), and Smilax species. Shrub species consist of Virginia Willow (Itea virginica), Viburnum (Viburnum nudum), Sweet Pepperbush (Clethra alnifolia), and Tag Alder (Alnus serrulata). The herb layer contains predominately ferns (Osmunda cinnamomea, Osmunda regalis) and sphagnum moss. Endangered Species No endangered species were observed on the site. Impact to the Red-Cockaded Woodpecker (Picoides borealis) was discussed with Mark Cantrell, the U. S. Fish & Wildlife Service official responsible for oversight of its recovery in the area. It was determined that the site lies outside the known range of existing Red-Cockaded Woodpecker colonies. Client's Position The presence of jurisdictional wetlands on the site ,were at first seen by NCMS as an obstacle to development of the site. This position has changed during the course of preliminary planning. The jurisdictional wetlands are now seen by NCMS as an asset by creating a buffer area to help reduce noise pollution and reduce the occurrence of individuals gaining entry without purchasing a ticket. Summary NCMS understands the need for compliance with all state and federal laws concerning jurisdictional wetlands and their associated processes. The development of this site will impact 1.12 acres of jurisdictional wetland at three different locations on the property. The impact on jurisdictional wetlands and their associated processes has been considered throughout the planning phase of the project. Design changes been made to minimize impacts to jurisdictional wetlands. The area where the drag strip will cross is very diverse. This area may have considerable wildlife value.. The other areas are likely limited in function and value due to their small size and location in the landscape.
