Dear Mr. Felch:
You have our approval to place fill material in 0.469 acres of wetlands or waters for the purpose
of constructing a industrial park at Byrum Road site, as you described in your application dated
7 September 1995. After reviewing your application, we have decided that this fill is covered by
General Water Quality Certification Number 2671. This certification allows you to use Nationwide
Permit Number 26 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get any other federal, state or local permits before you go ahead with your
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401

12. The proposed work consists of the construction and development of an industrial
park. The development plan includes several large building footprints which will impact
the wetland areas on the subject site. See Figure 3.
13. The purpose of the proposed work on this approximate 20-acre site will be the
construction and development of an industrial park to service the Charlotte Douglas
International Airport (CDIA). Several large buildings and parking areas are proposed to
provide large storage and other business facilities for commercial interests associated
with CDIA.
14. International Airport Centers, Inc. proposes development primarily in the upland
portions of the site. However, there is the need to make available 0.469-acres of low to
medium quality jurisdictional wetland areas for development within the project site. The
proposed development plan is the most economic and practicable alternative that allows
the project objectives to be accomplished. Therefore, these proposed impacts are
unavoidable due to the siting of several large development footprints on a relatively small
area.
Measures to minimize impacts during the site planning process have been considered,
however, site topography requires that buildings and parking be placed over the small
wetland or that portions become a recontoured swale. To protect water quality down-
gradient from the site, adequate sedimentation and erosion control measures will be taken
during the grading and filling phase of the project. To minimize impacts, best
management practices (BMP's) will be employed such as silt fencing, riprapping and
placing of sediment traps. Implementation of BMP's along with a stormwater
management plan for the site will minimize disturbance to down-gradient waters or
wetlands.
17C. This site was delineated as part of a larger parcel. Only Data Points 4 and 5
pertain to the tract of land for this project.
17D. The stormwater wet retention basin will be designed in conformance with State
requirements. The stormwater plan will be submitted to the State for approval prior to
construction.

surveyed. The surveyed wetland lines must be verified by our staff before the Corps will make a final
jurisdictional determination on your property.

without an approved survey.

Placement of dredged or fill material in wetlands on this property without a Department of the Army
permit is in most cases a violation of Section 301 of the Clean Water Act (33 USC 1311). A permit is
not required for work on the property restricted entirely to existing high ground. If you have any
