Due to the requirements to obtain a FEMA Floodway Fill Permit and a Letter of Map Revision a change in the plans is required to the primary road crossing. This change will also necessitate the removal of a portion of a recently constructed road. The new road design is intended to reduce the impacts to the floodway and therefore will reduce the amount of fill, reduce the cost of the bridge, and reduce impacts to wetlands from the original plans. The original plans for the permitted impact (site #16) for this road crossing was 0.31 acres. The proposed impact with the new roadway design is 0.20 acres. The following will also be incorporated into the design and construction of the road crossing. As discussed on site with Steve Lund, the flow from a small stream that was diverted during golf course construction to feed an irrigation pond will be redirected back to the wetland area. The hydrology of this wetland will also be enhanced through the use of the storm drainage system from the roadway. The temporary drainage ditch along the existing Devonshire Road (adjacent to portion to be removed) will be eliminated with the new road construction. As discussed the drainage will be redirected immediately back to the wetland area to maintain the hydrology. This wetland area is currently protected from adjacent development by barricades and silt fencing. Please let me know if you have any questions or require additional information. Thank you. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Numbers 2664, 2732, 2733 and 2671. These certifications allow you to use Nationwide Permit Numbers 12, 14, 18 and 26 when they are issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. Additional written approval is required from DEM for the stormwater and mitigation plan. Any lots with jurisdictional wetlands shall have deed restrictions to prevent future wetland fill. Runoff from the golf course shall be directly so as not to flow directly into nearby streams and tributaries. Fill of site number 16 (Wetland Permitting and Mitigation Plan) shall be further minimized or conclusively demonstrated to DEM that such minimization is not feasible. In addition, you should get any other federal, state or local permits before you go ahead with your project. This certification carried the additional conditions that runoff from the golf course shall not flow directly into nearby streams; fill at site number 16 shall be further minimized; and deed restrictions shall be placed on any lots with jurisdictional wetlands to prevent future wedand fill. Also any changes in your project that would impact wetlands requires notification to this office and may involve additional authorization. As part of an ongoing compliance monitoring and enforcement program for 401 Water Quality Certifications, Todd St. John from the Division's Mooresville Regional Office and myself made a compliance inspection of the Birkdale golf course on January 31, 1997. From our inspection it appears that your project is in compliance with the conditions of the certification. At a future date we would like to make another site visit to Birkdale with you r consultant to take a closer look at the mitigation measures and biofilters. Your cooperation in complying with the conditions of your 401 Water Quality Certification is appreciated. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Numbers 2664, 2732, 2733 and 2671. These certifications allow you to use Nationwide Permit Numbers 12, 14, 18 and 26 when they are issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. Additional written approval is required from DEM for the stormwater and mitigation plan. Any lots with jurisdictional wetlands shall have deed . restrictions to prevent future wetland fill. Runoff from the golf course shall be directly so as not to flow directly into nearby streams and tributaries. Fill of site number 16 (Wetland Permitting and Mitigation Plan) shall be further minimized or conclusively demonstrated to DEM that such minimization is not feasible. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. PROJECT LOCATION AND DESCRIPTION The project area is located in Mecklenburg County, north of the City of Charlotte and west of Huntersville in the Piedmont region of North Carolina. It is generally considered in the Lake Norman vicinity. Charlotte is the major urban center for ' surrounding areas in both North and South Carolina and the entire area north of Charlotte is experiencing considerable growth and development particularly in the Lake Norman vicinity. The project area is near Interstate 77 and adjacent to Sam ' Furr Road (SR 2145), which is currently being widened from NC 73 to US 21 (State Project 6.804755 - T.I.P. No. R-2624). The current project area is primarily rural in character with mostly former agricultural and undeveloped land. A large ' portion of the acreage is in open fields, utility rights of way, pine woods, or fields undergoing various stages of succession. ' The "Birkdale" project of ± 645 Acres will be a Mixed Use Development consisting of office space and commercial space, single family and multi- family dwelling units, an 18 Hole Championship Golf Course, and other related land uses. THREATENED AN ENDANGERED SPECIES Federally listed plant and animal species with endangered or threatened status are protected under the Endangered Species Act of 1973. The US Fish and Wildlife Service has identified two endangered species - Schweinitz's sunflower (Helianthis schweinitzii), and the Carolina heelsplitter (Lasmigona decorata). Schweinitz's sunflower thrives in full sun characteristic of successional fields, margins, and forested openings. The Carolina heelsplitter is a freshwater mussel which prefers shaded areas either in a ponded portion of a small stream or in runs along steep banks with moderate current. Primary habitat is waters less than three feet deep with a soft mud, muddy sand, or shady gravelly substrate. It is normally restricted to protected silted areas or under banks especially associated with obstructions such as stumps or fallen trees. Its current distribution according to the US Fish and Wildlife Service is limited to portions of two streams --- Goose creek and Waxhaw Creek -- and a small river originating out of rural areas in Union County. Therefore it is not expected to occur on this site. ' Five candidate plant species, Common Nestronia (Nestronia umbellula), Heller's Trefoil (lotus helleri), Georgia Aster (Aster georgianus), Tall Larkspur (Delphinium exaltatum), and Virginia Quillwort (Isoetes virginica) are known to occur in ' Mecklenburg County. Because the site contained potential habitat of the Schweinitz's Sunflower a field survey was conducted in conjunction with the planning efforts of this project. The study was conducted by James Matthews, of the Habitat Assessment and Restoration Program in the first week of July, 1995. According to his report (See Appendix A), no Federal, State, or Local plant species of concern were identified or expected to occur on the site. 1 n 1 State Protected Species The Carolina Darter (Etheostoma collis) is a fish that inhabits small streams such as those found in the project area. This species has a federal status of Proposed Special Concern and a State status of Special Concern. The species prefers small clear streams of less than 15' width with moderate to swift current and a sand/gravel benthic composition. It apparently tolerates a wide range of water quality conditions and vegetation types adjacent to the streams and appears resistant to pollution. (E. Menhinick). Although several intermittent and permanent tributaries will be crossed by the proposed alignment, it seems likely that the darter if present would continue to inhabit these streams after development. The greatest potential impact would be from construction related sedimentation and turbidity. The use of BMP's and proper sizing of culverts should result in negligible impacts to downstream water quality. According to the Environmental Assessment for Sam Furr Road (SR 2145) Widening and Interchange at 1-77, Mecklenburg County from NC 73 to US 21, ' "records maintained by the North Carolina Natural Heritage Program, NCDEHNR indicate no State listed threatened or endangered species in the immediate vicinity of the project. However, the Santee Chub (Hybopsis zanema), a State listed species of concern, has been reported in downstream segments of McDowell Creek. Increases in siltation could result in adverse impacts on this species". Therefore strict adherence to an approved erosion and sedimentation ' control plan will be implemented during the construction period in order to alleviate further degradation of water quality. L F r ?7 CULTURAL RESOURCES V. CULTURAL RESOURCES The Office of State Archaeology (OSA) and the Survey and Restoration Branch ' (SRB) of the NC Department of Cultural Resources - State Historic Preservation Office (SHPO) was visited on April 28, 1995 to review existing mapping on the ' USGS Quad maps, if any. The purpose of this review was to determine if there was of previously identified sites in the project area. A copy of the Environmental Assessment (EA) for Sam Furr Road (SR 2145 - State Project 6.804755 : T.I.P. ' No. R-2624) Widening and Interchange at 1-77 was also reviewed. Based on the review of the maps at the OSA and at the SRB, no previously identified or surveyed sites are currently indicated on the maps within the project area. Several areas around the project area and in the vicinity have been surveyed and although several sites were indicated, none were determined eligible for the listing in the National Register. There is the possibility that the findings would be similar on this site. According to the EA for Sam Furr Road, the SHPO indicated that they had conducted a review of that project and were aware ' of no properties of Architectural, Historical, or Archaeological significance which would be affected by that project. ' Required formal contact was made with the State Historic Preservation Office requesting concurrence with these findings. Their response will be forwarded to the U.S. Army Corps of Engineers immediately upon receipt. 1 I F i AQUATIC HABITAT C?? V. AQUATIC HABITAT 0 The aquatic systems in the project area consist of an intermittent tributaries and McDowell Creek surrounding areas, and wetlands. A variety of wildlife is supported by these systems including mammals, birds, reptiles, amphibians, fish, insects, mollusks, and crustaceans. Fish Species Fish species that are most likely to occur in the project area includes (but not limited to) blue head chub, red breast sunfish, blue gill, mosquito fish, and rosyside dace. The Carolina darter, a species of Special Concern, is not expected to inhabit McDowell creek. However, the Santee Chub (Hybopsis zanema), a State listed species of concern, has been reported in downstream segments of McDowell Creek. Increases in siltation could result in adverse impacts on this species". Therefore strict adherence to an approved erosion and sedimentation control plan will be implemented during the construction period in order to alleviate further degradation of water quality. Crustaceans and Shellfish Cambarus and Procambrus crayfish are expected to inhabit areas near intermittent tributaries. Indigenous and Asiatic clams, and snails are likely to inhabit the pond area and are not expected to substantially inhabit intermittent tributaries. The diversity of fish, crustaceans, and shellfish, will be limited on this site due to the intermittent nature of the small tributaries. Amphibians and Reptiles Amphibians and reptiles that are likely (but not limited to) to occur near streams include marbled and mud salamanders, spring peepers, bullfrog, mud turtle, skink, black snake, and copperhead. Existing habitat is expected to remain in natural areas close to the banks and in undisturbed wetland areas. Short term construction impacts, primarily stream sedimentation will affect aquatic habitat, however this will be minimized to the extent practicable to promote rapid recovery. Project construction will strictly adhere to an approved Sedimentation and Erosion control Plan. Best Management Practices will include utilizing siltation trapping ponds and other erosion control structures where appropriate. Impacts from hazardous materials and other toxins to fish and aquatic life such as fuels will be avoided by not permitting staging areas to be located near surface waters. Also, as required by the 401 Water Quality Certification conditions, measures will be taken to prevent "live" or fresh concrete from coming into contact with waters until the concrete has hardened. r n I JURISDICTIONAL WATERS OF THE UNITED STATES C VI. JURISDICTIONAL WATERS OF THE UNITED STATES ' The ecological, aesthetic and recreational values of Waters of the United States, including wetlands, are protected by Federal and State regulations. They are considered sensitive habitats for fish and wildlife and also provide flood protection ' and pollution control. Section 404 of the Clean Water Act requires regulation of discharges and ' authorizes the US Army Corps of Engineers to regulate the disposal of dredged or fill material into "Waters of the United States", which includes wetlands. The North Carolina Department of Environment, Health and Natural resources, ' Division of Environmental Management, Water Quality Section also reviews permitting effects based on Section 401 of the Clean Water Act. Wetlands are defined as: 'hose areas that are inundated or saturated by groundwater at a frequency and duration to support, and that under normal ' circumstances do support, a prevalence of vegetation typically adopted to life in saturated soil conditions. wetlands generally include swamps, marshes, bogs, and similar areas". (33 CFR 328.3(b), 1986) An area is determined to be a wetland when it exhibits Hydric Soil, Hydrophytic ' Vegetation, and Wetland Hydrology characteristics. These characteristics are required to be in accordance with the definitions in the US Army Corps Wetland Delineation Manual, 1987. Areas which exhibit these three characteristics is ' identified as a wetland and permits are required for development activities within these areas. ' The Clean Water Act also protects surface waters through Section 404 and Section 401. Surface waters can include, but not limited to, creeks, lakes, streams, ponds, and intermittent tributaries. L The extent of the Jurisdictional Waters were determined in the field following the Routine On-Site Determination Method as defined according to the 1987 Corps of Engineers Wetland delineation Manual and verified by the US Army Corps of Engineers. The extent of the Jurisdictional waters of the US on this 645 Acre site is approximately 7.07 Acres. These wetlands and tributaries have been identified ' as PF01A (Palustrine Forested Broad Leaved Deciduous Temporarily Flooded) and/or PSS1A (Palustrine Scrub-Shrub Broad Leaved Deciduous Seasonally ' Flooded) according to the National Wetland Inventory Map (USFWS). These wetland areas are various stages of succession ranging from emergent to mature bottomland hardwood forest. WETLANDS PERMITTING AND MITIGATION The Harris Group has actively pursued professional planning input to develop this strategically and economically important project while maintaining sensitivity to environmental concerns. Preliminary planning involved site analysis and consideration of environmental and regulatory issues. Topography, natural features and systems, circulation network, site organization, open space and development requirements, and environmental issues were considerations in designing the overall plan. During the schematic planning stage meetings were held with representatives of the US Army Corps of Engineers and the North Carolina Division of Environmental Management to review schematic planning efforts including unavoidable impacts, and minimization and mitigation measures. The plan and commitments made in this report reflect a positive response to the preliminary negotiations and determinations, and concerns of the regulatory agencies. Except for temporary construction and development impacts we believe that the proposed project will not cause significant impacts to the ecological functions or values of Jurisdictional Waters of the US. Avoidance and Minimization Through intensive planning efforts, filling large tracts of wetlands to build the golf course and development sites has been avoided. The wetlands were incorporated into the design of the golf course and the only fills necessary are at two landing areas. Where fairways cross wetland areas woody vegetation will be removed by hand clearing or other approved techniques to avoid "mechanized land clearing" and soil disturbance. Vegetation in the fairway area will be replaced with low growing herbaceous wetland vegetation. Best Management Practices will also be employed to minimize impacts to Jurisdictional Waters. This will include: - Siltation Barriers - Sediment Traps and Diversion Ditches - Barricades to define construction limits to sensitive sites and to protect trees - Preconstruction meetings - Other methods as appropriate Vehicular access will be restricted to specific areas to avoid disturbance to adjacent wetlands and natural areas. Methods to prevent short term impacts will be inspected regularly and maintained during construction of the project. 1 ' Proposed Impacts The development of Birkdale will require an estimated 1.66 Acres of impacts to ' Jurisdictional Waters of the US. These are detailed on the following plans and schedules. The goal was to meet the mitigation ratios proposed by the North Carolina Division of Environmental Management and Draft Corps of Engineers Guidelines. The type ' of mitigation shown on the plan are described below generally fall under the category of ENHANCEMENT. ' Enhancement - Increasing one or more of the functions of an existing wetland by manipulation of vegetation and/or hydrology. Also, measures shall be taken to prevent live or fresh ' concrete from coming into contact with waters until the concrete has hardened. C) Mitigation to include re-establishing wetland vegetation in bottomland hardwood wetlands cleared for the golf course, and in wetland (former agricultural area now in succession) near proposed major road crossing as indicated on plans. Bio-filter areas in the golf course and littoral areas selected stormwater ponds will implemented as indicated on the mitigation plan. All ponds that are to be designed as wet detention ponds will be in accordance with NCDEM Guidelines. D) Wetland clearings when necessary for utility crossings, roads, and temporary access to be combined into the same cleared area where feasible. E) Wetlands to be clearly marked prior to construction to prevent accidental damage to wetlands. Contractor to be held responsible for unauthorized wetland damage not permitted according to plans and specifications. Preconstruction meetings shall be held if necessary with representatives of the COE and the NCDEM. F) Temporary construction access crossings shall be made from high ground to high ground over channels which do have adjacent wetlands. Temporary culverts will be provided to preserve existing natural drainage. Immediately after n completing construction, the channel will be restored to its natural vegetation. t , landing areas. STORMWATER MANAGEMENT PLAN A Stormwater Management Plan will be designed and implemented for portions of the project that consist of Commercial, Office, Corporate, and Business land uses. Stormwater runoff from these uses listed above has the potential to degrade water quality in all types of waters. Wet detention basins shall be the primary treatment system. Properly designed wet detention basins have been proven to be a viable solution to reduce pollution. They are efficient in removing suspended solids ad other pollutants, reducing peak runoff rates, and controlling downstream erosion. There is also a potential aesthetic value if the pond's can be designed into the overall plan. ormwater Management Plan Conce_pts Stormwater management becomes necessary when increasing the impervious area within an existing natural area. The impact of the increased runoff and reducing natural filtration will be analyzed with respect to the capacity and stability of natural channels and the presence of environmentally sensitive areas. The pre and post-development runoff will be determined and used as the basis of stormwater management techniques. Special consideration will be given to avoiding erosion and degradation of environmentally sensitive areas, wetlands, and surface waters. The Stormwater Management Plan will include: A. Wet Detention Basins that will attenuate 1.0 inch of rainfall over a 24 hour period for high density sites including office, commercial and business uses. C. Riser outflow structures to maintain a pool and encourage filtration. B. Utilization of wetland mitigation areas where possible to increase filtration. D. Directing runoff into natural areas and wetland/biofiiters to treat runoff before entering surface waters. E. Maintaining natural and planted areas between the developments and Jurisdictional Waters. F. Development of a wetland littoral shelf where feasible in shallow areas. The planners will utilize information and guidelines provided by the North Carolina Department of Environment, Health, and Natural Resources in developing the design of wet detention basins. I 1 PLANS AND MONITORING ?I 1 IX. PLANS AND MONITORING Detailed plans for each area will be further articulated from the conceptual plans included in this document. These plans will be submitted to the Corps of Engineers and the North Carolina Division of Environmental Management for ' approval. Plans will include : Site Preparation Requirements - Vegetation Requirements Tracking and Monitoring Requirements ' A monitoring program will be developed to monitor the mitigation areas to include: ' 1. Vegetation Parameters a. Species Composition and Abundance b. Survival ' c. Growth Monitoring of vegetation will be conducted on an annual basis according to the following general procedures. A. Observation along designated transects and sample plot locations B. Photographic documentation ' C. Monitoring will take place on an annual basis in late summer to early fall (August-September). Periodic site visits will be conducted for ' maintenance, aesthetic purposes, and possible modifications to increase survival rates. D. Field data and Photography will be summarized in an annual report and will be submitted to the Corps of Engineers, NC Division of Environmental Management and other interested agencies. Stewart - LandDesign Engineering Services, Inc Environmental Assessment - Endangered Species Birkdale Residential Golf Course Development ' Huntersville, NC The Birkdale Residential Golf Course Development is ± 680 acres on both sides of ' McDowell Creek, south of Sam Furr and David Kenney Farm Rds., with access to Northcross Dr. to the east, and Babe Stillwell Farm Road and Hwy 73 to the west. The majority of the acreage is in open fields, utility rights-of-way, pine woods, or fields undergoing various stages of ' succession. There is very little mature hardwood forest. The field work was performed the first week of July. To facilitate the survey work, we used the Orthophotoquad 1:24,000 topographic sheets to determine the open areas in the site, as of the date of the photography in 1976. This allowed us to see which areas may be available, since most of the species occur in open habitats. We were careful to search the open fields, margins of the woods-floodplain ecotone, the utility rights-of-way (Transco Pipeline, Piedmont Natural Gas and Duke Power), the power line rights-of-way and forest ecotones along Hwy 73, David Kenney and Babe Stillwell Farm Rds. We ' also used the soil series maps for Mecklenburg Co. to determine potential soils available. Two soils compatible with Helianthus schweintzii were noted, Mecklenburg and Enon. We were careful to check these soils for the sunflower, where open areas coincided. There have been significant changes in the management of the land in this area since the aerial photography in 1976. Many fields have been abandoned or planted in trees. Many areas that had been fields in the past are now dense, weedy, shoulder-high mixtures of Johnson Grass, Goldenrods, Blackberries, Lespedeza, Honeysuckle and Poison Ivy that do not provide a habitat for the species of concern. Several of the previously open fields had mixed pine/hardwood forests with DBHs of 6 inches. All of the fields on the orthophotoquads east of McDowell Creek are not open presently. Comments on the species from Mecklenburg County: ' Helianthus schweinitzii - no plants were found during the field survey. Most of the fields have such a dense growth of weedy species that this species could not be successful. The open areas along the utility rights-of-way had no populations. Anemone berlandieri and A. caroliniana - These species bloom in early spring and are not ' evident now, but the habitats are not generally available. - Aster georgianus - Several clasping leaved aster populations were noted, but they were A. patens. Baptisia albescens - No baptisia species in fruit were noted. ' Botrychium jenmanii - This species was not noted, and the survey is a little early in the season. Cardamine dissecta - The habitat for this species, open understory floodplain is not present. ' Carex projecta - There are no well-developed swamps on the site. u 1 Delphinium exaltatum - The soil type and habitat is not present. Dodecatheon meadia var. meadia - The habitat is not present. Echinacea laevlgata - The habitat is not present. Gnaphalium helleri var helleri - There were plenty of open woods margins, but no evidence of this species. Probably the soil type was not present. Hexalectris spicata - There may be some vegetative habitat present, but the soil type probably is not. We did not see any of this species. Lotus helleri - Most of the fields were too densely vegetated for this species to survive. Several relatively open areas are present, but the species was not. Nestronia umbellula - We did not see any of this species. Silphium perfoliatum - We did not see any of this species. Silphium terebinthinaceum - We did not see any of this species. Solidago rigida ssp. glabrata - We did not see any firm-leaved goldenrods. There were no sightings of any species of concern for Mecklenburg County. Ja s F. I have previously visited the Office of State Archaeology and the Survey and Restoration Branch concerning this site to review existing data on the USGS Quad maps and no archaeological sites or architectural sites eligible for listing on the National Historic Register were indicated. Several areas around the project area and in the vicinity have been surveyed and although several sites were indicated, none were determined eligible for the listing in the National Register. Based on my site visits and as you may be able to see from the attached aerial photographs, the site is very disturbed by past agricultural practices, roads, and utility line clearings - both overhead powerlines and buried gas and oil trunk lines. A large part ' of the project site is now in heavy successional overgrowth. Woodland areas were severely impacted by Hurricane Hugo. I am also not aware of any standing structures on the site. I was also able to review a copy of the Environmental Assessment (EA) for Sam Furr Road (SR 2145 - State Project 6.804755 : T.I.P. No. R-2624) Widening and Interchange at I-77. According to the EA for Sam Fun Road, the SHPO indicated that they had conducted a review of that project and were aware of no properties of ' Architectural, Historical, or Archaeological significance which would be affected by the project. DEN ID # 95794. Biologists on the North Carolina Wildlife Resources Commission Staff have reviewed the subject document, our comments are provided in accordance with certain provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et seq.) and the Fish and wildlife Coordination act (48 Stat. 4ol, as amended; 16 U.S.C. 661-667d) and North Carolina General Statutes (G.S. 113- 131 et seq.). The applicant plans to Construct a mixed use development with office/commercial apace, single/multifamily housing, and golf course on a 645-acre site at the headwaters of McDowell Creek in Northern Mecklenburg County. The applicant proposes to fill a total of 2.21 acres of wetlands under NWP#26, NWP##14, NWP#18, and NWP#12. The project site contains approximately 7.07 acres of wetlands. The Santee Chub (Hybopsis zanewa), a state listed species of concern, has been reported in downstream McDowell Creek according to the document. A detailed mitigation plan is presented. The applicant used avoidance and minimization with wetlands being incorporated into the design of the golf course. Best management practices will be used to minimize impacts to jurisdictional waters. We will not object to the issuance of this permit as long as the applicant conducts mitigation as proposed. However, we have the following recommendations to protect the wetlands and downstream habitats: 1. A total of 6.63 acres of vegetated wetland areas should be created or re-established on-site to replace the 2.21 acres of wetlands that are to be filled. The created wetlands should be located adjacent to existing wetlands or streams. 2. Require that all remaining wetlands on the site be protected from additional development. Deed restrictions should be placed on individual lot owners to prohibit wetland destruction. 3. Implement and maintain a strict, state approved sedimentation control plan during construction to prevent silt from entering streams and other wetlands. The ± 645 Acre development is located north of Charlotte and west of Huntersville in the rapidly growing Lake Norman area of Mecklenburg County. The potential for impacts to Jurisdictional Waters was anticipated early in the planning process and impacts to wetlands have been avoided and minimized. All of the proposed impacts and mitigation have been preliminarily reviewed and discussed with the Corps of Engineers (Mr. Steve Lund) and the North Carolina Division of Environmental Management (Mr. Mike Parker). The development will also comply with the requirements of the Mecklenburg County/City of Charlotte Watershed Buffer Guidelines. As an integral part of the development, minimization of impacts to Jurisdictional Wetlands and Waters of the US will include measures to protect water quality such as: treatment of runoff from commercial and maintenance areas; management of construction and staging areas; protection of natural buffer areas and vegetation; strict adherence to an approved Sedimentation and Erosion Control Plan; and other Best Management Practices. Mitigation will include enhancement of existing wetland areas, providing littoral zones on the stormwater ponds and "bio-filter" zones as indicated on the attached plans and report.
