Box 5892 Raleigh, N.C. 27650 FIL f Cop, Dear Mr. Valentine: You have our approval to place fill material in 0.347 acres of wetlands or waters for the purpose of constructing a road crossing and utilization of uplands for sand mining at south of SR 1800, as you described in your application dated 20 June 1995. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Numbers 2732 and 2671. These certifications allow you to use Nationwide Permit Numbers 14 and 26 when they are issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Environmental Management under Section 401 of the Clean Water Act. If you have any questions, please telephone John Dorney at 919-733-1786. We plan to utilize Nationwide Permits 26 and 14 for this project Please find enclosed our permit application, site plans showing location of jurisdictional wetlands and proposed impact acreage for-the mine. All impacts are to occur in a cutover area. The wetlands were flagged and located by GPS (Global Positioning System) (see wetland delineation map). Northings and Eastings for each point are attached. Only the area of the property to be disturbed was evaluated. (See attached Delineation Map.) The total impact of the pit is 0.27 acres of isolated wetlands. The road crossing (to access high ground) impact is 0.077 acres. The area will be Wet mined. with a barge. The barge will access high ground via a canal that will be dug thru an existing road (non-wetland) that will result in no wetland impact There will be no discharge to the Neuse River and no pumping to de-water the site.
