You have our approval to place fill material in 0.25 acres of headwaters for the purpose of
developing this commercial/industrial site at Westinghouse Boulevard & Downs Road in Charlotte, as
you described in your application dated 22 June 1995. After reviewing your application, we have
decided that this fill is covered by General Water Quality Certification Number 2671. This certification
allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
l you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get any other federal, state or local permits before you go ahead with your.
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This cendfication and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401
of the Clean Water Act. If you have any questions, please telephone John Domey at 919-733-1786.

Dear John:
On behalf of for Mr. Dwaine Holden of John Adams Properties c/o McQuire Properties, I am
requesting a 401 Water Quality Certification for a NWP#26 to impact +0.25 Acres of headwaters
to develop this + 6 Acre commercial/industrial site in Charlotte. This site is in the southwest area
of Charlotte and is along the rapidly growing Westinghouse Boulevard industrial corridor. The
jurisdictional waters were evaluated in June, 1995.
The majority of the site is moderately sloped with a well defined drainageway. The soils according
to SCS Soil Survey on site include typically well drained soils including Iredell fine sandy loam
(IrB) and Mecklenburg fine sandy loam (MeB). The site is near the top of a drainage area of a small
intermittent tributary of Sugar Creek (Classification-C). Vegetation includes mixed hardwoods to
dense scrub/shrub overgrowth in various stages of succession. Much of the areas of the woodlands
were impacted by Hurricane Hugo. Facultative (FAC and FACW) vegetation is common along the
intermittent tributary and in the small wetland area.
The total area of Jurisdictional Waters on the site is + 0.25 acres based on my site evaluation and
are limited to a small bank to bank intermittent and a small wetland area at the base of the elevated
railway berm. The development plan depicts that most of the area will be utilized for stormwater.
management and buffer. The developer will require strict adherence to an approved Sediment and
Erosion Control Plan and I have informed my client that an application to the NC Division of
Environmental Management will be required if the development area changes and impacts of 1/3
acre or greater to Jurisdictional Waters are necessary.
