These certifications were issued specificly for road crossings and the construction of the lake. As part of an ongoing compliance monitoring and enforcement program for 401 Water Quality Certifications, Todd St. John from the Division's Mooresville Regional Office and myself made a compliance inspection of the North Stone Development on January 31, 1997. We found that the road crossings were and the lake dam had been constructed and work on the golf course appeared near completion. The lake was not full and it appeared that the lake area was being used as a temporary sediment basin for much of the development. From our brief inspection it appears that the project is in compliance at this time. The Division will make additional compliance inspections in the future as the project nears completion. Request for 401 Water Quality Certification to fill wetlands near Huntersville, Mecklenburg County, North Carolina. DEM ID # 95648. Staff biologists with the North Carolina Wildlife Resources commission have reviewed the subject application for 401 water Quality Certification with respect to anticipated project impacts on aquatic habitats. Our comments are provided in accordance with certain provisions of the Fish and Wildlife Coordination. Act (48 Stat. 401, as amended; 16 U.S.G. 661 et seq.), and section 401(b) of the Clean Water Act of 1977 (as amended), and North Carolina General Statutes (G.S. 113-131 et seq.). The project involves the construction of a residential subdivision where the applicant proposes to flood 0.84 acres of wetlands for the construction of a lake on the North Prong of Clarke Creek in the Rocky River Basin. The applicant failed to provide any information on the total number of acres of wetlands located on the project site as required on the application form. No information was provided on lake operation or efforts that will be made to meet minimum stream flow requirements. The applicant did not indicate whether any measures to minimize wetland impacts would be implemented. We are not able to determine whether the applicant made any effort in the project design to limit impacts to jurisdictional wetlands by avoidance and minimization. If avoiding all wetlands is not possible, then we request that the applicant mitigate for the losses. We suggest creating wetlands in the headwaters portion of the lake or in a suitable area adjacent to the lake. Wetlands on this site provide functions which benefit the public as well as fish and wildlife. Wetlands retain and purify stormwater runoff and provide valuable habitat for numerous species of fish and wildlife. We request that the following conditions be incorporated into the 401 Water Quality Certification for this project: 1. Require that 2.52 acres of vegetated wetlands with native aquatic plants be created on-site to replace the 0.84 acres of wetlands that are to be flooded. We suggest creating additional wetlands adjacent to existing wetlands or at the edge of the lake. 2. Require that all remaining wetlands on the site be protected from development. Deed restrictions should be placed on individual lot owners to prevent further wetland destruction. 3. Implement and maintain a strict, State Approved Sedimentation Control Plan to prevent silt from entering streams and other wetlands areas.
