After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Numbers 2664, 2732 and 2671. These certifications allow you to use Nationwide Permit Numbers 12, 14 and 26 when they are issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. Deed restrictions shall be added to all lots with jurisdictional wetlands to prevent future lot fill. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. Anderson,"973fent Region Coordinator Habitat Conservation Program DATE: July 14, 1995 SUBJECT: 401 Certification for Thad Blue for a Golf Course and Residential Development, Mill Creek, Little River/Cape Fear Basin, Whispering Pines, Moore County NC, DEM Ill # 95561 Biologists on the North Carolina Wildlife Resources commission staEf have reviewed the subject project. our comments are provided in accordance with certain provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d) and North Carolina General Statutes (U.S. 113-131 et seq.). The applicant proposes to impact 4.25 acres of wetlands under Nationwide Permit 12, 1.7 acres under Nationwide Permit 14 and 1.1 acres under Nationwide Permit 26 . The application states that there are 77.50 acres of wetlands on the site. The waters of Mill Creek are classified as WS-III&B and flow to the WS-iii HQ waters of Little River. This golf course and residential development have the potential to significantly adversely impact water downstream. Therefore, minimizing wetland impacts and mitigating loss of functions and values are essential to protecting the downstream high quality water and habitats. We have the following recommendations to protect the wetlands and downstream habitats: 1. on-site mitigation should be made for the 2.8 acres of wetlands that will be destroyed. Require that all remaining wetlands on site be protected 6(cl from development. Deed restrictions should be placed on individual lot owners to prohibit destruction of wetlands. 3. We recommend that a 100-foot forested buffer be maintained or established along any perennial streams and a 50-foot forested buffer be maintained along intermittent streams where feasible. Where fairways will not allow for forested buffers, combinations of low woody shrubs and native tall grass/herbaceous buffer should be retained along the drainages to allow for play over. 4. The wetlands disturbed for utility construction should be restored according to conditions specified in 401 certification for nationwide 12. 5. A 100-foot forested buffer should be left along wetland areas where feasible. 6. Maintaining high native grass/herbaceous rough areas would .? reduce impacts from applications of toxic substances and aid in filtration of these pollutants from fairways, tees and greens. 7. Grassed swales and sheet flow should be used where feasible instead of curb and gutter for stormwater conveyance. Stormwater from the clubhouse and parking lot areas should be allowed to sheet flow to the course or be conveyed to a wet retention pond instead of being discharged directly to surface waters. According to the plans submitted you are requesting to discharge fill material into 2.034 acres of wetlands for road crossings, a sewer substation, and pond excavation, pursuant to Nationwide Permit No. 26; 0.60 acres of wetlands for road crossings, pursuant to Nationwide Permit No. 14; and 4.25 acres of wetlands for utility lines, pursuant to Nationwide Permit No. 12. Also, based on the plans you provided, it is our understanding that you propose to remove the vegetation from 13.73 acres of wetlands to make way for the fairways for your proposed golf coarse. According to federal regulation 323.2 f, as amended August 25, 1993, "activities that involve only the cutting and removing of vegetation above the ground (e.g., mowing, rotary cutting, and chain sawing) where the activity neither substantially disturbs the root system nor involves mechanized pushing, dragging, or other similar activities that redeposit excavated soil material" in wetlands, do not require DA authorization. We are concerned about the large amount of wetlands you propose to clear and encourage you to be especially diligent in avoiding any non-exempt or unauthorized activities in these wetland areas. Please be aware that DA authorization must proceed any discharge of fill material, excavation, and/or mechanical land clearing in wetlands. For the purposes of the Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits. Authorization, pursuant to Section 404 of the Clean Water Act and Nationwide Permit No. 12, was provided for the discharge of material for backfill or bedding for utility lines, including outfall and intake structures, provided there is no change in pre-construction contours. Additionally authorization, pursuant to Section 10 of the Rivers and Harbors Act of 1899 and Section 404 of the Clean Water Act and Nationwide Permit No. 14, was provided for fills for roads crossing waters of the United States (including wetlands and other special aquatic sites) provided: a. The width of the fill is limited to the minimum necessary for the actual crossing; Printed on 0 Recycled Paper -2- b. The fill placed in waters of the United States is limited to a filled area of no more than one-third acre. Furthermore, no more than a total of 200 linear feet of the fill for the roadway can occur in special aquatic sites, including wetlands; c. The crossing is culverted, bridged or otherwise designed to prevent the restriction of, and to withstand, expected high flows and the movement of aquatic organisms; d. The crossing, including all attendant features, both temporary and permanent, is part of a single and complete project for crossing of a water of the United States; and e. For fills in special aquatic sites, including wetlands, the permittee notifies the District Engineer (DE) in accordance with the "Notification" general condition. Finally, authorization was provided, pursuant to Section 404 of the Clean Water Act and Nationwide Permit No. 26, for discharges of dredged or fill material into headwaters and isolated waters. Your work is authorized by these nationwide permits provided it is accomplished in strict accordance with the enclosed conditions and your submitted plans. You must also receive a Section 401 water quality certification from the North Carolina Division of Environmental Management (NCDEM). You should contact Mr. John Dorney, telephone (919) 733-1786. This nationwide permit does not relieve you of the responsibility to obtain other required State or local approval. This verification will be valid until the nationwide permit is modified, reissued, or revoked. All the nationwide permits are scheduled to be modified, reissued, or revoked prior to 21 January 1997.
