Box 1003 Charlotte, N.C. 28201-1003 FILE COPY Dear Mr. Byers: You have our approval to place fill material in 0.20 acres of wetlands or waters for the purpose of commercial/office site construction at Three Coliseum Centre, as you described in your application dated 28 February 1995. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2671. This certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed. in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. Byers of Crescent Resources, Inc., I am requesting a 401 Water Quality Certification - NWP#26 to impact ±0.20 Acres of headwaters (±0.17 Acres Wetlands, ±0.03 Acres Surface Waters) to develop this ± 36 Acre commercial/office site in Charlotte. The Jurisdictional Waters on this project site were verified as headwaters by the USACOE on February 24, 1995. This site is near the intersection of Irwin/Sugar Creek (Water Classification - C) and Tyvola Road in the vicinity of the Charlotte Coliseum. The majority of the site is an upland ridge with steep side slopes. A large portion of the site includes an abandoned quarry which has become a lake. A channel flows from the main body of the lake and pours over rip-rap down the steep banks of Irwin/Sugar Creek. The soils on the site include primarily Pacolet sandy loam (PaE), and Cecil sandy clay loam (CeB2 & CeD2) which are typical upland soils. The banks of Irwin Creek are approximately 15' - 20' high. Vegetation includes mixed hardwoods and very dense scrub/shrub overgrowth in various stages of succession. The forest areas on this site were particularly heavily impacted by Hurricane Hugo. Facultative (FAC) vegetation is common along the Creek and drainageways. The remaining areas of the site especially in the vicinity of the quarry are completely covered in Kudzu from the base of the banks of Sugar/ Irwin Creek, over the quarry area and in the remaining overstory. Jurisdictional Waters on the site are limited to small bank to bank intermittent tributaries, the quarry lake probably fed by groundwater and surface runoff upstream, and a small wetland areas fed by a small spring. The small spring may have been exposed as part of the mining operation. The quarry lake is expected to be incorporated into the design of the complex as a central water feature. All areas in the proximity of Irwin/Sugar Creek with hydrophytic vegetation were carefully evaluated for soil and hydrological conditions that may have qualified the areas as jurisdictional wetlands. The attached map does indicate wetland areas near the site that are potentially adjacent to Irwin/Sugar Creek, however it is not in the development area or on the property. The developer will require strict adherence to an approved Sediment and Erosion Control Plan to protect these wetland areas from development impacts. Proposed impacts to Jurisdictional Waters include the wetland area associated with the spring and intermittent tributaries. An additional permit may be requested in the future to modify the drainage channel from the lake, if necessary. I have informed my client that an application to the NC Division of Environmental Management will be required if the development area changes and impacts of 1/3 acre or greater to jurisdictional waters are necessary. Also, I have made my client aware that impacts to wetlands adjacent to Irwin/Sugar Creek are not eligible for this Nationwide Permit and would be subject to the Individual Permit Process.
