Box 1003 Charlotte, N.C. 28201-1003 Dear Mr. Girdwood: AA14?EHNR November 1, 1995 Iredell County DEM Project # 951156 You have our approval to place fill material in wetlands or waters for the purpose of constructing docks, piers, and floating boat slips at Pinnacle Shores Subdivision, as you described in your application dated 26 October 1995. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2674. This certification allows you to use General Permit Number 030 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. Wilmington District's Regional (General) Permit Number 198200030. The State of North Carolina certifies that the specified category of activity will not violate Sections 301, 302,303, 306 and 307 of the Public Laws 92-500 and 95-217 if conducted in accordance with the conditions hereinafter set forth. Conditions of Certification: 1. Proposed fill or substantial modification of waters or wetlands for this General Certification requires written concurrence from the Division of Environmental Manage- ment. 2. Individual Certifications shall be required after public notice for projects in DEM-classified trout, ORW and HQW waters. 3. That established erosion control practices are utilized to prevent violations of the appropriate turbidity water quality standard (50 NTUs in streams and rivers not designated as trout by DEM; 25 NTUs in all saltwater classes, and all lakes and reservoirs; and 10 NTUs in trout waters); 4. Measures shall be taken to prevent live or fresh concrete from coming into contact with waters of the state until the concrete has hardened; 5. That additional site-specific conditions may be added to projects proposed under this Certification in order to ensure compliance with all applicable water quality and effluent standards; 6. Concurrence from DEM that this Certification applies to an individual project shall expire three .rears from the date of the cover letter from DEM. Non-compliance with or violation of the conditions herein set forth by a specific fill project shall result in revocation of this Certification for the project. The Director of the North Carolina Division of Environmental Management may require submission of a formal application for individual certification for any project in this category of activity, if it is determined that the project is likely to have a significant adverse effect upon water quality or degrade the waters so that existing uses of the wetland or downstream waters A! Application is being made to Duke Power Company for the required F.E.R.C. permit to construct docks, piers, and floating boat slips for 33 boats at this subdivision. There will be no dredging or shore line stabilization in the docking area. We ask that you advise us, by return mail, of any comments you may have concerning this development or of any permits your authority may require. Your comments are a requirement of the F.E.R.C. permit application. Thank you for your cooperation and prompt response.
