We wrote to you on 24 May 1995 discussing concerns that we have regarding the design of the project and placing it on hold until those concerns are addressed. As of today, we have not received a response to our earlier letter. Unless we receive a response from you by 15 December 1995, we will consider that you have withdrawn this application and are not interested in pursuing the project at this time. The permit is to construct an embankment pond for irrigation on an unnamed tributary into Little Creek. This construction will impact approximately 0.75 acres of jurisdictional wetland and will flood approximately 2 acres. The entire area was recently clear cut. The Corp of Engineers and the US Fish and Wildlife Service have looked at this site. Copies are attached. I need a copy of the 401 permit to process a Converted Wetlands for Non Agricultural Use request for Mr. Hines to prevent him from losing U.S.D.A. Program Benefits. The U.S. Fish and Wildlife Service (Service) has reviewed your March 8, 1995 request for our participation, pursuant to Section V of the Memorandum of Agreement (MOA) - Section 111 D.1, concerning requests for an onsite wetland determination/ delineation, and our comments are submitted in accordance with the MOA, and with Section 7 of the Endangered Species Act of 1973, as amended (16 U.S.C. 1531-1543) (Act). A Service biologist made an onsite wetland determination/delineation field visit for applicants James Thomas Hines, John Michael Langdon, and Curtis Johnson proposing to build an embankment pond near the Little River. The Service has determined that this proposed activity is not likely to adversely affect the Federally-endangered dwarf-wedge mussel (Alasmidon heterodon) based on the location of the proposed activity being several miles from Little River. However, we do recommend the applicants adopt the following precautions to protect aquatic species in the tributary and Little Creek: 1. Leave a natural, woody vegetation buffer extending 50 feet on either side of the creeks and tributaries; 2. Provide a 50 foot chemical free buffer zone along the creeks. 3. Install sedimentation and erosion control barriers during construction activities. We appreciate the opportunity to review these U.S. Department of Agriculture AD-1026 requests.
