Box 190 Cofield, N.C. 27922 Dear Mr. Newsome: ?EHNR May 22, 1995 Hertford County DEM Project # 95416 FILE GOP, You have our approval to place fill material in 0.8 acres of wetlands or waters for the purpose of expanding an irrigation system at your farm near Cofield, as you described in your application dated 30 March 1995. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2671. This certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. A. Newsome, Jr. of Cofield, N.C. which is located in Hertford County. Essentially what Mr. Newsome has requested is to be granted an exemption for an .8 acre area which he cleared in the summer of 1994. This is a small area located within a much larger area which was cleared. Mr. Newsome had filed a 1026 on the majority of the area in 1992, however he ultimately cleared further than the 026 determination covered. As can be seen in Mr. Newsome's letter, the exemption is being requested in conjunction with the proposed installation of a center pivot irrigation system. A copy of the irrigation system has been prov' ed in the packet. The .8 a re area Mr. Newsome has cleared has been determined to be wetlands by the ton Area Soil Specialist. The determination was carried out in conjunction with the U. S. Army Corps of Engineers. The U. S. Army Corps representative provided Mr. Newsome a nationwide 26 permit on the spot and cautioned Mr. Newsome to apply for permits prior to carrying out clearing or other activities in wetland areas. No additional action required by the Corp. Mr. Newsome is requesting a Minimal Effect under the terms that the area not be drained and it would be left in permanent grass to allow the irrigation equipment to cross. Minimal Effect Agreement The following agreement has been developed to clarify the terms by which the applicant {R. A. Newsome, Jr.} is willing to comply with, as part of a Minimal Effect Exemption Application. As part of the Minimal Effect Agreement, Mr. R. A. Newsome, Jr. agrees to stabilize and maintain the .8 acre wetland area with a suitable grass to prevent erosion and provide adequate ground cover which will create a vegetative filter for the incoming surface water flow. The area will not be grazed or cultivated in any form which could constitute the removal of a crop. The wetland hydrology of the area will not be altered by any artificial drainage. i.e. - an open ditch, tile, etc. The area has been sloped to allow surface water to exit through a swale or shallow depression type drain which is very similar to the original landscape. The wide swale should enhance the filtering effect of the grass sod. It is agreed that the owner will not be required to plant or maintain trees within the .8 acre wetland area. Enclosed are irrigation maps submitted by Revelle Agri- Products, Inc. showing area proposing to irrigate. In order for the irrigation system to work efficicently to irrigate the full 135 acres, it is imperative to be able to utilize this ..8 acre. The conversion effect would be minimum because of no additional deep ditching or attempt to lower the water table. Permanent grass vegetation will be maintained which will provide a better filtering system than previous wooded conditions. The hydrology of the area will remain the same as it was prior to clearing. Vegetation on the area proposed will remain in grass; we are not requesting to use as cropland. It is my request to obtain the necessary minimal effect determination which will allow me to leave the .8 acre in a grassed condition. The .8 acre is not intended to be grazed, hayed or cropped. If we do not cross this area we will lose approximately 16 acres. Appreciable amount of land will not be irrigated due to this fact. Also attached you will find the information you have requested regarding the application for Post-conversion Minimal Effects Determination.
