APPROVAL of 401 Water Quality Certification

Dear Ms. Johnson:
You have our approval to place fill material in 0.1 acres of wetlands or waters for the purpose of
constructing a residential subdivision in Davidson, as you described in your application dated 19 April
1995. After reviewing your application, we have decided that this fill is covered by General Water
Quality Certification Number 2671. This certification allows you to use Nationwide Permit Number 26
when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get any other federal, state or local permits before you go ahead with your
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 30 days of the, date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401

Re: General 401 WOC - NWP #26 for + 58 Acre Residential Site Town of Davidson,

Dear John:
On behalf of the Johnson Group, I am requesting a 401 Water Quality Certification for a
NWP#26 to impact ±0.10 Acres of headwaters to develop this + 58 acre residential site in
Davidson. This site is near the Davidson Creek portion of Lake Norman. The site was
evaluated for jurisdictional waters on April 18, 1995.
The majority of the site is an upland ridge with moderately steep side slopes to a well
defined drainageway. The soils according to SCS Soil Survey on site include Cecil sandy
clay loam (CeB2) a typical well drained upland soil. A small inclusion of Helena (HeB)
was identified in a very small drainage way near the rear property line. The site is near
the top of a drainage area of a small intermittent tributary of Davidson Creek (now part
of Lake Norman). Vegetation includes mixed hardwoods (dominated by Facultative
species) to dense scrub/shrub overgrowth in various stages of succession. Areas of the
woodlands were impacted by Hurricane Hugo.
The total area of Jurisdictional Waters on the site is + .10 or less acres based on my site
evaluation and are limited to potentially ponded area within a upland (wet weather)
drainage way. The development plan calls for this area to be potentially utilized for
stormwater management and buffer. The developer will require strict adherence to an
approved Sediment and Erosion Control Plan and I have informed my client that an
application to the NC Division of Environmental Management will be required if the
development area changes and impacts of 1/3 acre or greater to Jurisdictional Waters are
necessary.
