Fish and Wildlife Service Mattamuskeet NWR Route 1, Box N-2 Swan Quarter, N.C. 27885 Dear Mr. Phillips: F COPY You have our approval to place fill material temporarily in 1 acres of wetlands or waters for the purpose of pump maintenance on the south-central side of Lake Mattamuskeet at the FA5/6 pump station, as you described in your application dated 3 April 1995. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2727. This certification allows you to use Nationwide Permit Number 33 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with, your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. N/A xw~t Signature Date Acting Refuge Manager FA- 5 / 6 PUMP MA = NT ENANC E PROJ'E CT MATTAMUSREET NATIONAL WILDLIFE REFUGE Swan Quarter, NC DESCRIPTION OF PROPOSED WORK Mattamuskeet National Wildlife Refuge (NWR) staff propose to place a cofferdam consisting of earthen fill material in a man-made ditch which connects the permanent pump station for two waterfowl impoundments (FA-5 and FA-6) to the 40,000 acre Lake Mattamuskeet. The cofferdam is needed to de-water the area where the pump is submersed so that it may be disassembled, removed, serviced, modified (an elbow joint with a flap gate will be attached to the end of the pump's intake pipe to seal lake water out), and reinstalled. The work site is located on the south-central side of Lake Mattamuskeet in Hyde County, North Carolina (Attachment 1) and lies completely within the boundary of Mattamuskeet National Wildlife Refuge (NWR) (Attachment 2). The work site is approximately 0.6 miles from the historic Mattamuskeet Pump Station/Lodge building and the Refuge Headquarters building. It is located just off Wildlife Drive at the at the end of the shared dike between Farm Areas (FAs) 5 and 6 (Attachment 3). The sketch at Attachment 3 shows the location of the proposed cofferdam. The fill material would be placed between the wider pool area adjacent to the pump and the remainder of the ditch leading to Lake Mattamuskeet. Because the water level is normally below ditch top during the warmer months, no fill material would be placed in wetlands other than the man-made ditch for this work. The cofferdam would be in place only as long as needed to complete the pump maintenance (estimated 2 weeks) and then removed. The material would be placed and removed with a drag line operating from the top of the existing dikes or road.
