Dear Mr. Looney: You have our approval to place fill material in 0.78 acres of wetlands or waters for the purpose of constructing a commercial development at Hwy. 107 at SR 1350, as you described in your application dated 27 March 1995. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2671. This certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. The design of the proposed wet detention pond shall be modified to allow some wetland vegetation to develop on the margin to facilitate water quality improvements. Additional written DEM approval is required for the final pond design. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Environmental Management under Section 401 of the Clean Water Act. If you have any questions, please telephone John Domey at 919-733-1786. Anderson SUBJECT: Water Quality Certification #95329 Lodestar Properties-Walmart Jackson County qp O o T*l I9?1s o„q ??FS The basic use of the 0.78 acre wetlands associated with this Walmart project would be for water storage to reduce the gush from about 20 paved acres into the stream. Since the stream is already highly urbanized and in a culvert for a good part of its length, the additional runoff will probably not change the water chemistry excessively. The preliminary grading plan indicates a pond for sedimentation control during construction. I talked to Jeff Odin about expanding the pond and retaining it with some vegetation and a shallow pool in the bottom. A controlled release through a submerged pipe would more than adequately mitigate the loss of the existing wetlands and should prevent an increase in downstream flooding. Jeff Odin is supposed to let me know about how willing the owners are to use the pond as described. In any case I recommend we issue the Water Quality Certification with conditions to encourage this use or, if we have the authority, to require it. We should probably keep in mind that the best use of this stream has already been determined to be draining the highway, many parking lots, the DOT and Forest Service and School Bus Garages.
