The project site is located adjacent Currituck Sound in the Poplar Branch Township, on SR 1137 (Aydlett Road) in Currituck County, North Carolina. The proposed project site comprises ±166.97 acres that include ±62.36 acres that have been delineated as Section 404 wetlands by Mr. Tom Steffens of the U. S. Army Corps of Engineers. SR 1137 bisects the property and the upland portion of the site was in active agriculture until several years ago. The site has ±2,881' of shoreline along Currituck Sound. It is important to note that this site is referred to as the Baum site and has been the location of several archaeological studies dating back to 1972 when East Carolina University personnel investigated the presence of an ossuary at the site. The Office of Archives and History has identified two. sites on the property and identified them as 31 CK194 and 31 CK129. A recent report by Coastal Carolina Research, Inc. was submitted to Archives and History and the installation of a bulkhead on the propertywas an agreed upon method to stabilize the shoreline to prevent future erosion loss of any remaining artifacts or remains. As indicated above, the majority of the upland portions of the site were in active agriculture until several years ago. The fields are in various stages of successional growth ranging from annual grasses, to several fields on which small pines and hardwoods have volunteered. The south end of the property is a large area of Section 404 wooded wetland abutting Currituck Sound. As you move northward, you move onto one of the old agriculture fields, and this ±1,024' long area is actively eroding. This field ends at a drainage ditch that opens into the Sound. The edge of the ditch is vegetated with red maple. The next section of the .site has 404 wetlands along the shoreline with a field landward of the wetland area. This wetland area is vegetated with wax myrtle, bay, red cedar, and various wetland grasses. A small area of Coastal Wetlands is present along the waters edge within this 404-wetland area and is vegetated with Spartina cynosuroides. The 404-wetland area along the shoreline continues across anotherdrainage ditch as you continue north along the property. This ditch is also vegetated with red maple along the ditch bank. The 404-wetland ends at another field with an eroding bank. This field section is ±250' wide along the sound front and abuts another large area of 404 wetlands at the northern end of the field. Two small ponds. exist on the property within these open field areas. Currituck Crossing Currituck Crossing, LLC, C/O Greg Cox Currituck County Express Permit Review Program Page Two The site is bordered on the north (upstream) side by an undeveloped tract vegetated similarly to the applicant's including wooded wetlands and agricultural fields. The site is bordered on the south (downstream) side by a large expanse of wooded wetlands. There are no piers along this section of shoreline for more than 1,000' in either direction. The project site has an existing elevation of ±4.0' above the normal water level (NWL). Currituck Sound at this location has been classified as SC by the Environmental Management Commission. The area is open to the harvesting of shell fishing. Project description The applicant proposes to develop the site by creating 106 single-family lots (21 sound front) with a minimum lot size of 20,000 ft± 0.46 acre). Twenty-foot wide asphalt roads are proposed within the Subdivision. Approximately centered on the site, is a proposed t50' wide common lot with a 6' wide by 175' long access pier and a 500 ft2 (25') octagon shaped platform with a gazebo at the waterward end. The pier and platform will have a railing around the perimeter to prevent boat docking. The existing water depth at the end of the proposed structure is ±2.3'. The sound is ±2.5 miles wide at this location. A 6' wide by ±57' access walkway is proposed over the 404-wetland area to connect to uplands. The walkway over the 404 wetland area will be elevated a minimum of 3' measured from the wetland substrate to the bottom of the decking. A 6' wide paved pathway will connect the walkway to the road. A second access area is proposed at the southern end of the site. Access to this area will be a 6' wide by ±338' access walkway over the 404-wetland area originating from a proposed cul-de-sac. The walkway over the 404 wetland area will be elevated a minimum of 3' measured from the wetland substrate to the bottom of the decking. The applicant proposes to stabilize the shoreline by installing bulkhead and retaining walls. A total of ±535' of bulkhead is proposed at the two upland field areas along the erosion escarpment. The bulkhead will be a maximum of 5' below the NWL and will average at the NWL. Approximately 2,498' of retaining wall is proposed along the landward edge of the 404-wetland areas. Two lakes are proposed including a common area around them with paved walking paths and recreation areas. The location of the lakes will be the same location as the existing ponds, and the northern most lake will be ±7.85 acres while the southern lake will be ±11.98 acres. A boat storage area and a community playground are proposed on the west side of SR 1137 at the back of the proposed Subdivision. ~ Currituck Crossing Currituck Crossing, LLC, C/O Greg Cox Currituck County Express Permit Review Program Page Three The total amount of impervious coverage for the site is ±412,850 ft2 or 5.8% including roadways, sidewalks, and walking paths. As proposed, the amount of impervious coverage within the 75' Coastal Shoreline Area of Environmental Concern (AEC) is ±100 ftz or 0.1 %. With the exception of the bulkhead and retaining wall installation as well as the 6' wide wooden access to the proposed pier no other activity is proposed within the 30' Coastal Shoreline Buffer The applicant proposes to install individual septic systems on each lot and the County has tested 10% of the lots and signed off on them as per their requirements for Subdivision development. The applicant is in the process of having the remaining lots tested. Water will be provided by Currituck County. Anticipated impacts The project as proposed will result in the filling of ±200 ft2 of Sound bottom as a result of the bulkhead installation. The pier and boardwalk installation will result in the shading of ±1,550 ft2 of Sound bottom and ±2,369 ftz of 404-wetlands. The project will result in the disturbance of ±4,094,640 ftz (94 acres) of uplands as a result of the construction activities. The project as proposed will result in ±100 ft2 of impervious surface within the Coastal Shoreline AEC. David W. Although it was previously cultivated, I understand it has not been farmed for several years. Elevations on the project range from around 8 feet above sea level to sea level. The site is currently drained by feeder ditches that convey runoff to a primary collection ditch that transverses the property in an east- west direction. Runoff is ultimately leaves the site both to the Currituck Sound to the east and to the swamp on the west. An existing culvert beneath Aydlett Road connects the watercourses, allowing variation in drainage patterns depending on climatic conditions. In the 1970's, archaeological investigations found several ossuaries in the vicinity, resulting in a portion of the site to be listed an the National Register of Historic Places (NRHP). For this reason, an Archeological Survey was performed on the site and is included within this submittal. Existing wetlands have been delineated on the both the east and west side of the project. The US Army Corp of Engineers has reviewed and concurred with the plat delineating the west side of the project. However, I understand that the ACOE is not currently signing plats of this nature. Proposed Development: The project inGudes 106 lots being developed as a Conservation Community subdivision in accordance with the Currituck County Ordinances. Lots will be a minimum of 20,000 sf and large amounts of open space will be provided within the community to be maintained by the Homeowners Association. Cox Development Company, LLC also intends to construct a 200' pier and a 500 square foot gazebo. Approximately 200 square feet of the gazebo will be covered. Construction of the pier and gazebo will begin at the landward side of the proposed bulkhead as shown on the site plan. The pilings for the pier and gazebo will be water jetted in and the cross members will be attached to the pilings to create the framework for the pier and gazebo. The floor for the pier and gazebo will then be placed onto the framework. Construction will be finalized, via foot traffic across the pier and gazebo. The pier and gazebo are not intended to be utilized as dockage for marine craft. Approximately 3,000 If of bulkhead will also be installed along the wetland or shoreline as well as portions of boardwalk constructed over delineated wetlands. The existing cemetery along Aydlett Road will remain within an open space as shown. Permuting Compliance: The Archeological Surrey notes that is the historical remains have likely eroded into the sound and recommends the installation of the bulkhead to prevent further erosion. The boardwalks and gazebos are being provided as community amenities within dedicated open space. The majority of the shoreline contains delineated wetlands separating the sound from the uplands. County regulations require these wetlands to be defined as open space rather than included within the lot boundaries. For this reason, proposed lots are being defined to the wetland line (and placement of bulkhead) rather than to the shoreline. However, it is expected that adjacent property owners will have exclusive use of the open space within the "sound-front wetlands" and may potentially apply for additional permits in the future. A lot owner may create one lot per year for a total of five lots. Lots shall have a minimum lot size of forty thousand (40,000) square feet, except in the RO2 District. .---~~Section 927 Conservation Subdivision The purpose of Conservation Subdivision Design is to preserve agricultural and forestry lands, natural and cultural features, and rural character that would be likely lost through conventional development approaches. To accomplish this goal, greater flexibility and creativity in design of such developments is encouraged. This type of subdivision allows the developer to decrease lot sizes and leave the land "saved" as common open space, thereby lowering development costs and increasing the amenity of the project without increasing the density beyond what would be permissible is the land were to be developed into lots using the conventional subdivision standards. Section 928 Lot Sizes and Septic Systems 1. In any single-family residential subdivision, a developer may create open space subdivision lots that have or contain 20,000 square foot minimum lot sizes, subject to Albemarle Regional Health Services approval. 2. All required septic system improvements and requirements including, but not limited to the septic tank, drain lines, repair area and pumps shall be located on the individual lot they are designed to serve. (Amended 5/3/04) Section 929 Determining Density or Yield 1. An applicant proposing the development of a Conservation Subdivision shall be required to produce a "Yield Plan" that shall be developed in accordance with the regulations contained with this Section. 2. The purpose of the Yield Plan is to determine the maximum permissible density that shall be allowed on the parcel(s) of land to be subdivided. Permissible density shall be calculated using the underlying zoning district(s) (see Section 202). Yield Plans shall be conceptual in nature and are not intended to involve significant engineering costs, they shall be realistic and not show development in areas that would not ordinarily be legally permitted in a conventional layout (i.e. the location of streets or residential lots in wetland areas or within identified Areas of Environmental Concern). 3. Typical Yield Plans shall include, at a minimum, the following information: 937 (a) The location and types of wetlands and other environmentally sensitive areas (i.e. hummocks, dunes, maritime forests); (b) Topographic information from U.S. Geological Survey maps; (c) Types of soils on the property based upon the soil survey by USDA Soil Conservation Service; (d) Proposed lot and street layouts that conform to existing development standards governing lot dimensions, street design and parking. 4. On sites not served by public sewerage or a centralized private sewage treatment facility, soil suitability for individual septic systems shall be demonstrated. The Planning Staff and Albemarle Regional Health Services shall select 10 percent of the lots to be tested, in areas considered to be marginal. Costs for the tests shall be the responsibility of the applicant. If tests on the sample lots pass the soil test as conducted by Albemarle Regional Health Services, the applicant's other lots shall also be deemed suitable for septic systems, for the purpose of calculating total lot yield. However, if any of the. sample lots fail, several others of the county's choosing shall be tested, until all the lots in a given sample pass. Section 930 Density Bonus and Incentives For Developing A Conservation Subdivision 1. Fractional numbers shall be rounded when determining density bonuses under this Section. 2. A density bonus above what the Yield Plan will allow, not to exceed 20 percent in an Agricultural zoning district and five percent in the other zoning districts, is permissible for subdivisions developing under conservation subdivision standards. 3. A five percent density bonus above what the Yield Plan will permit, shall be allowed when at least 50% of the open space land (excluding Primary Conservation areas) is being actively farmed and remaining under the ownership of the developer, farmer or farm preservation trust and is protected from future development by a permanent conservation easement. 4. In the residential and agricultural zoning districts, a five percent density bonus shall be given above what the Yield Plan will allow where at least 20 acres of other than open space land is donated and accepted for county facilities. 5.
