After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Numbers 2664, 2732, 2733 and 2671. These certifications allow you to use Nationwide Permit Numbers 12, 14, 18 and 26 when they are issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. Wetland enhancement and water quality measures outlined in the 30 March 1995 letter from Kevin Martin shall be implemented. Deed restriction (example attached) shall be included on all lots with jurisdictional wetlands not proposed to be filled. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. Suite 105 Raleigh, NC 27607 Raleigh, NC 27615-6846 RECEIVED Dear Mr. Dorney and Ms. Manuel: APR 31995 ENVIRONMENTAL SCIENCES The purpose of this letter is to request a revision to our application for BRANCH Nationwide Permits 26,14,12 and 18 and a 401 Water Quality Certification for the project known as the Sweetwater which was submitted on 2/24/95. The project is bisected by SR 1550 and White Oak Creek in Johnston County, NC as shown on the enclosed plans and vicinity map. Our original application was incomplete because it lacked any proposed mitigation and most importantly it incorrectly identified a road crossing as being qualified for a Nationwide Permit 26 when in reality (because the crossing is below headwaters) it should have been a Nationwide 14. I realize this may cause the restart of the 30 day permit processing "clock". Fill in Waters of the US has been revised accordingly and will be required to develop the site for golf course and residential community, including padv?ays, cart paths, parking, and lots. It will be necessary to impact a total .82 a es of jurisdictional Waters of the US above headwaters for placement of roposed facilities. In addition to the 4.94 acres to be impacted under NW 26. Other impacts are 1.78 acres for Nationwide 14 and-.10 acres for below headwaters Nationwide 18 and 9.33 acres under Nationwide 12. (See attached revised map for impact location and size.) The plans for the development have been modified in order to minimize impacts by 1.54 ac. overall as compared to our original application; upland areas have been utilized as much as possible. Wetland enhancement on holes 1A, 2B and 7C has been proposed in locations as shown on the attached tables as well, total acres to be enhanced equal 1.01 ac. For water quality protection/ mitigation the client is building two stormwater detention ponds and at DEM's request has agreed to perform shrub and wetland grass/ sedge plantings (1.03 acres) along the creek where Hole number 5A plays over the creek to reduce warming of streamwaters. Detailed plans for the residential pods surrounding the course are close to their final version but may require future revisions. The client realizes that these must be addressed prior to construction. It is anticipated that any changes would require no or only minimal wetland impacts. The project is bisected by SR 1550 and White Oak Creek in Johnston County, NC as shown on the enclosed plans and vicinity map. We previously met Jean Manuel on-site on two occasions to review wetland delienations and discuss impacts. We also discussed this project in the office with John Dorney and Danny Smith of DEM. Overall the Engineer Architect and Developer have minimized impacts to high and medium value wetlands to the greatest extent possible. In fact considering the amount of wetland on-site they have done on outstanding job in wetland avoidance. Fill in Waters of the US will be required to develop the site for golf course and residential community, including roadways, cart paths, parking, and lots. It will be necessary to impact a total of8.-:16acres of jurisdictional Waters of the US above y headwaters for placement of the proposed facilities. In addition to the 1 acres 1 • y ?°"v to be impacted under NW 26." Other impacts are 6_4S acres for Nationwide 14 and .10 acres for below headwaters Nationwide 18 and 9.32acres under k Nationwide 12. (See attached map for impact location and size.) The plans for the development have been modified in order to minimize impacts to wetlands; upland areas have been utilized as much as possible. Site Photo 1 shows the high quality wetland area along White Oak Creek that has been avoided other than for 1 road crossing. Site Photo 2 and 3 show the low quality wetland area to be impacted for construction of a storm water pond (impact area J on map). Site Photo 4 shows the low quality wetland area along an old sewer line to be impacted by the golf hole 6C (impact area G43). The location of the Nationwide 18 impact is at impact area G44 and is above the Soil/Site Evaluation ¦ Mapping and Physical Analysis ¦ Wetlands Mapping and Mitigation ¦ Environmental Audits On-Site Waste Treatment Systems, Evaluation and Design proposed utility line. Site Photo 5 shows the wetland area in front of the green of hole 3B to be cleared and played over. This area has potential for being turned into a freshwater marsh similar to that along White Oak Creek. It currently is a marginal wetland area of red maple, gum and loblolly pine with minimal function and Valve. This possibility can be discussed further during the permit process as potential enhancement. To expedite the permitting process and to ease the process for everyone involved, the following individuals/agencies have been provided with a complete copy of this entire application package: Danny Smith (DEM Raleigh Regional Office), David Franklin (Wilmington Corps), USF&WS, and NC Dept of Cultural Resources. Detailed plans for the residential pods surrounding the course are close to their final version but may require future revisions. The client realizes that these must be addressed prior to construction. It is anticipated that any changes would require no or only minimal wetland impacts. Based on your survey methodology and the negative results regarding the presence of the dwarf wedge mussel (Alasmidon heterodon) in White Oak Creek, it appears that this proposed project will not impact the dwarf wedge mussel. However, we do recommend that the applicant adopt the following precautions for a known population of the dwarf wedge mussel at the confluence of White Oak Creek and Swift Creek: 1. Leave a natural, woody vegetation buffer extending 50 feet on either side of the creeks; 2. Provide a 50 foot chemical free buffer zone along the creeks. 3. Install sedimentation and erosion control barriers 'during construction activities.
