Therefore, the State of North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92- 500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. Condition(s) of Certification: That the activity be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction related discharge (50 NTUs in streams and rivers not designated as trout waters by DEM; 25 NTUs in all saltwater classes, and all lakes and reservoirs; 10 NTUs in trout waters). 2. Live (fresh) concrete shall not come into contact with water of the Neuse River. Violations of any condition herein set forth shall result in revocation of this Certification. This Certification shall become null and void unless the above conditions are made conditions of the Federal 404 and/or Coastal Area Management Act Permit. This Certification shall expire upon expiration of the 404 or CAMA permit. If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of Administrative Hearings, P.O. The area will then be dewatered, and excavation for the structure shall begin. All excavated material shall be disposed of on the property at a site that has been previously approved by the NCDEHNR Land Quality Division. Upon the completion of all construction activities to the intake structure, the river bank on both the upstream and downstream sides of the structure shall be stabilized with Class II rip rap as shown on the plans. (Placement of rip rap in the waters of the U. S. has been addressed by the individual' permit application). When all construction activities are completed and an inspection of the structure by the Engineer has been accomplished, the sandbag cofferdam shall be removed. The Contractor shall take all steps necessary to prevent the ripping of the sandbags and the spillage of material into the river. The estimated time of construction is approximately 120 days beginning on July 1, 1995 and ending on October 27, 1995. Please note that these dates may change because of construction delays. This report formalizes the U.S. Fish and Wildlife Service's (Service) preliminary recommendations provided during our on-site investigation on March 22, 1994, for the proposed Johnston County Water Treatment Plant near Wilsons Mills, Johnston County, North Carolina. These comments are provided in accordance with the provisions of the Fish and Wildlife Coordination Act (48 Stat. 401 as amended; 16 U.S.C. 661 et seq.) and Section 7 of the Endangered Species Act of 1973, as amended (16 U.S.C. 1531-1543). The March 22 site visit included Mr. Tim Broome and yourself from McKim and Creed, Mr. David Yow from the North Carolina Wildlife Resources Commission (WRC), Mr. Charley Musser of Sungate Design Group, Mr. Haywood Phthisic from the Johnston County Department of Public Utilities, and Service biologist Ms. Kate Looney. The entire length of the water treatment project was walked starting from the proposed raw water intake and pump station site adjacent to the Neuse River, to the surface water and raw water retainment areas, and concluding at the proposed water treatment plant site. The site visit also included the proposed transmission main from the Jones Brothers water tank around the Channel Master plant to State Road 2301 in Selma. Because the majority of the proposed site for the water treatment plant and the water retainment areas have been previously disturbed, the Service believes that these portions of the project will have minimal adverse impacts. At the time of the visit, wetland delineation had not yet been complete. We request that the Environmental Assessment include the acreage of all wetland impacts, as well as maps of their location, and the proposed plans to mitigate any unavoidable wetland losses. Wetland mitigation should be on a habitat value basis. During the on-site investigation, the placement of the pump station and water intake structures were discussed. The Service recommends that the water intake structure be placed in the Neuse River as opposed to within the intermittent drainage to the Neuse River. We believe that the original proposal of constructing a dike along the a river bank for water collection would be more destructive than placing -the intake structure instream. We recommend the pump station be placed on either of the upland areas adjacent to the intermittent drainage. We believe that the proposed water intake structure and pump station can be constructed with few impacts to riparian habitat and the Neuse River by using proper erosion control techniques and maintaining a vegetative buffer between the pump station and the Neuse River. During construction of these structures, we recommend that all equipment and machinery be kept out of the vegetative buffer area. We understand that the actual sites for the pump station, maintenance road and water pipe line have not yet been determined. Therefore, we believe that potential environmental impacts can be reduced by placing these portions of the project appropriately as to preserve large, mature trees. The Service believes that the proposed transmission main which is to begin at the Jones Brothers water tank, cross Interstate 95 and ultimately follow State Road 2301 can be installed with little adverse environmental impacts. Additional disturbance in the area could be reduced by utilizing the existing power line right-of-way or the area surrounding the Channel Master parking lot; however we do not anticipate having any major concerns regarding this portion of the project. We would like to reiterate that all wetland impacts as well as proposed mitigation should be included in the Environmental Assessment. Further, the Service reserves the right to provide more detailed comments on the need, if any, for wetland mitigation dependent upon the results of the wetland jurisdictional determination. Based on the site visit, and our own additional information, the Service believes that the proposed project is not likely to adversely affect any Federally-listed endangered or threatened species. Therefore, the requirements of Section 7 of the Act have been satisfied. However, obligations under Section 7 of the Act must be reconsidered if: (1) new information reveals impacts of this identified action that may affect listed species or critical habitat in a manner not previously considered; (2) this action is subsequently modified in a manner which was not considered in the document; or, (3) a new species is listed or critical habitat determined that may be affected by the identified action. The following description of the work is taken from data provided by the applicant and from observations made during a site visit by a representative of the Corps of Engineers. Plans submitted with the application show that 0.04 acre of jurisdictional waters of the United States will be impacted by the proposed project. An area 95 feet long by 21 feet wide, extending 14 feet waterward of the existing bank, will be excavated to a depth of 2 feet below the river bottom for the construction of the 93-foot-long, 12 foot high retaining wall. Approximately 37 cubic yards of material will be removed for the installation of the retaining wall, tee screen and pipes, and steel deflectors. Approximately 53 cubic yards of concrete will be discharged below the plane of ordinary high water to construct the retaining wall and casing for the steel pipes that support the floating debris deflectors. The retaining wall will be constructed along the edge of the existing riverbank, extending out 16 inches into the river. The proposed tee screens will extend out another 3 feet (maximum) beyond the wall. Eight 15-foot long steel pipes will be buried a minimum of 3 feet deep, approximately 9 1/2 feet from the river bank, for the construction of the floating debris deflectors. The retaining wall will be constructed with four tee-type intake screens mounted to sliding rails along the outside face of the wall and connected to a 20-inch diameter pipe that leads to the water treatment facility. All excavated materials will be transported to a high ground spoil disposal site on the property approved by the North Carolina Department of Environment, Health, and Natural Resources, Division of Environmental Management, Land Quality Section. Seventy-five cubic yards of Class II Rip-Rip will be utilized to stabilize the river bank for a distance of 50 linear feet on either side of the retaining wall. The site consists of a typical upper coastal plain riverine system, characterized by a central stream channel with adjacent floodplains on either side of the-river. The site of the proposed retaining wall is currently 4 I red along the bluff of the river bank with the majority of the work to r within the river. The average depth of the river at the proposed intake 7-ture is 5 feet. The area adjacent to the proposed.retaining wall is scterized as high ground vegetated with loblolly pine (Pinus taeda), gum (Liquidambar styraciflua), tulip poplar (Liriodendron tulipifera), maple (Acer rubrum), white oak (Quercus alba), flowering dogwood (Cornus ida), black cherry (Prunus serotina), American holly (Ilex opaca), Lean elm (Ulmus Americana), bitternut hickory (Carya cordiformis), wild s (Vitas rotundifolia), honeysuckle (Lonicera japonica), and greenbrier Lax rotundifolia)I. The purpose of the work is to provide facilities for the extraction of cater from the Neuse River to be treated and used as the potable water Ly for Johnston County. Presently, unknown -ological, scientific, prehistorical, or historical data may be lost or -oyed by work under the requested permit. The District Engineer, based on available information, is not aware that roposed activity will affect species, or their critical habitat, nated as endangered or threatened pursuant to the Endangered Species Act 73. The decision whether to issue a permit will be based on an evaluation of robable impacts, including cumulative impacts, of the proposed activity is intended use on the public interest. Evaluation of the probable is which the proposed activity may have on the public interest requires a 2 careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards and flood plain values (in accordance with Executive Order 11988), land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agencies' 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. The Corps of Engineers is soliciting comments from the public; Federal, State and local agencies and officials; Indian Tribes and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to determine whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects and the other public interest factors listed above. Comments are used in the preparation of an Environmental Assessment (EA) and/or an Environmental Impact Statement (EIS) pursuant to the National Environmental Policy Act (NEPA). Comments are also used to determine the need for a public hearing and to determine the overall public interest of the proposed activity. Generally, the decision whether to issue this DA permit will not be made until the NCDEM issues, denies, or waives State certification required by Section 401 of the Clean Water Act. The NCDEM considers whether or not the proposed activity will comply with Sections 301, 302, 306, and 307 of the Clean Water Act. The application and this public notice for the DA permit serves as application to the NCDEM for certification. Additional information regarding the Clean Water Act certification may be reviewed at the offices of the Environmental Operations Section, NCDEM, Salisbury Street, Archdale Building, Raleigh, North Carolina. Copies of such materials will be furnished to any person requesting copies upon payment of reproduction costs.
