Nationwide Permit for an
Activity Located in Hertford

The North Carolina Division of Coastal Management has reviewed the above
referenced application for a Nationwide Permit dated 17 May 1995 pursuant to
Section 307 of the Coastal Zone Management Act of 1972 as amended. Based upon
our review, we have determined that the proposed activity is consistent with the
North Carolina Coastal Management Program provided the following conditions are
met.
1. The activity described in the above application qualifies to receive
one of the Nationwide Permits described in 33 CRF Part 330 with the
exception of Numbers 17, 21, 24 and 34 which were found inconsistent
with the North Carolina Coastal Management Program.
2. A 401 Water Quality Certification is received, where required, from
the North Carolina Division of Environmental Management.
This letter does not relieve you of the responsibility to ensure that all
other State authorization and/or permit requirements are met prior to

APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS

You have our approval to place fill material in 7.15 acres of wetlands or waters for the purpose
of constructing an irrigation pond at SR 1176, as you described in your application dated 17 May
1995. After reviewing your application, we have decided that this fill is covered by General Water
Quality Certification Number 2671. This certification allows you to use Nationwide Permit Number 26
when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow;the conditions listed in the attached certification- DEM
shall be copied on all mitigation reports. In addition, you should get any other federal, state or local
permits before you go ahead with your project.
If you do not accept any of the conditions of-this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401

Please find the attached packet which includes a re-submission of a joint
application form for 401 & 404 permits and/or certifications. Since the first
application was submitted, approval has been obtained from DEHNR relative to a
401 certification.
The NC Division of Marine Fisheries has rescinded its objections following a
visit to the site and now has no objections to the project.
Following a visit from Corps representative Henry Wicker to the site , a plan
for mitigation was discussed. A summary of the discussion is reflected in the
agreed to mitigation plan.
The dam is proposed to have a top width of 12 feet with a 2.5:1 front slope and
a 3:1 back slope. The maximum height of the dam will be 18.5 ft. from existing
natural ground. The dam will be approximately 400 ft. long and a maximum of 120
ft. wide at the deepest fill area. The dam will be built to meet Soil
Conservation Service specifications.

MITIGATION PLAN
An existing parcel of cropland currently owned by E. R. Evans
will be reverted to its natural condition by plugging the
artificial drainage on the site as can be seen on the attached
sketch. The majority of the area will immediately regain wetland
hydrology. The artificial drainage will be removed by placing a
100 ft. earthen plug in each end of the existing drainage swale.
The disturbed areas will be re-vegetated following the
installation of the plugs. The area will be planted in hardwood
at a rate of 400 trees per acre. It is agreed that the area will
be monitored for 2 years and significant seedling mortality will
be replanted if needed.
I agree to the above mitigation plan on the condition that a 404
permit or certification is approved.

Please find the information below regarding your request for information
concerning your proposal to construct an impounded pond to create a water supply
for irrigation. Maps are also attached showing the areas and acres you
expressed an interest in irrigating. The total cropland area is 211 acres.
Using a conservat:i_ve figure of applying 611/acre/season you would need a minimum
of 1266 acre inches assuming little le or no recharge. The pond you are proposing
is estimated to be a 13.1 acre pool area. Assuming an average depth of 61 depth
of water in all areas this would produce 943 acre inches. You would need to
reduce your wetted acreage or assume a higher recharge rate. At current
estimates, the pored will provide approximately 3/4 of your projected deeds.

Dear Mr. Evans:
You have our approval to place fill material in 7.15 acres of wetlands or waters for the purpose
of constructing an irrigation/wildlife pond at your farm near SR 1176, as you described in your
application dated 2 February 1995. After reviewing your application, we have decided that this fill is
covered by General Water Quality Certification Number 2671. This certification allows you to use
Nationwide Permit Number 26 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose-and design that you described in your application: If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. An
undisturbed buffer of approximately 50 feet shall be left around at least.90% of the margin of the
pond. In addition, you should get any other federal, state. or local permits before you go ahead with
your project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 4.01

Please find the information below regarding your request for information
concerning your proposal to construct an impounded pond to create a water supply
for irrigation. Maps are also attached showing the areas and acres you
expressed an interest in irrigating. The total cropland area is 211 acres.
Using a conservative figure of applying 611/acre/season you would need a minimum
of 1266 acre inches assuming little or no recharge. The pond you are proposing
is estimated to be a 13.1 acre pool area. Assuming an average depth of 6' depth
of water in all areas this would produce 943 acre inches. You would need to
reduce your wetted acreage or assume a higher recharge rate. At current
estimates, the pond will provide approximately 3/4 of your projected needs.
