Box 230 High Point, NC 27261 Re: April 19, 1996 Monitoring Inspection of the I-40 / Pegg Road Sewer line Project Dear Mr. O'Neal: On April 19, 1996 Kelly Hayes of DMP representing -he City of High Point, met with Ron Lim lle and Alan Smith, from the Division's Winston-Salem Regional Office and myself, to look at the I-40 / Pegg Road sewer line project. Ren Linville met with Ben Palmer of DMP on April 26, 1996 to look at that portion of the sewer line south of Gallimore Daly Road. The project was authorized by General Water Quality Certification Number 2664 on January 24, 1995 and by the US Army Corgis of Engineers Nationwide Permit # 12. Our monitoring inspection is part of an ongoing program of compliance checks on a variety of projects across the State. Certification Number 2664 contains the following standard conditions: the construction corridor (including stockpiling of materials) be limited to a 40 foot width within wetlands and must be minimized to the maximum extent practicable; permanently maintained access corridors shall be restricted to the minimum width practicable and may not exceed 10 _eet in width; and established sediment and erosion control practices be utilized to prevent violations of turbidity standards in the adja:ent streams. Nationwide Permit #12 also requires that preconstruction wetland contours shall be restored, excess material will to removed to a non-wetland disposal area, and any exposed slopes and streambanks tv stabilized immediately upon completetion of :onstiuction. Listed here are the concerns and compliance problem that we found with the I-40 / Pegg Road prl-Ject. 1. The sewer line construction impacted several areas of jurisdictional wetlands which were net shown on the project plans and which were rot fully restored to preconstructic n contours. We also found small ditches and &amageways which had been left along and within some of the wetland areas. These wetland areas were located at the confluence of two streams just south of Thorndike Road (near manholes # 54 and 55) and between Gall --nore Dairy Road and Millwood School Road (manhole # 5 to manhole # 12). width. 2. The construction corridor through these wetlands areas often exceeded 40 feet in P.O. Box 295:.5. Spoil material was often pushed right up to banks of the adjacent stream leaving no vegetative buffers and allowing sediment to erode directly into the creek. 4. Many of the sewer line stream crossings are at small angles increasing the impact to the stream and in several areas the stream bed has not been restored to original contours. To convect these problems the City of High Point should restore those impacted wetland areas to their preconstruction contours and fill in any ditches dug during construction; pull loose fill material back from the stream banks and stabilize with vegetation; and restore the stream beds back to their preconstruction contours. Based on our field observations with Kelly Hayes and Ben Palmer, changes in the sewer line design could have avoided some of the wetland impacts and reduced the stream impacts. We believe that it would be in the City of High Point's best interest for watershed protection to leave vegetative buffers along the streams and to revegetate disturbed areas as quickly as possible. Future sewer line projects will fall under General Water Quality Certification Number 3022 which replaced Number 2664 in September 1995. The new certification also requires that a sewer line parallel to a stream be located at the furthest distance from the stream as is practicable and no closer than ten feet and that anti-seep collars be placed every 150 feet along the downstream gradient of the utility line as it passes through wetlands. DEM strongly encourages the City to look closely at future sewer line projects to identify wetland areas and minimize impacts to those areas and to adjacent streams. Box 230 High Point, N.C. 27261 Dear Mr. O'Neal: FILE COPY You have our approval to place fill material in 0.8 acres of wetlands or waters for the purpose of constructing sewer lines at near Hwy 68 and Millwood School Road, as you described in your application dated 13 January 1995. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2664. This certification allows you to use Nationwide Permit Number 12 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design- that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow: the. conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicator , hearing. You must act within 30 days of the date that you receive, this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. If red-cockaded woodpeckers are observed within the project area or active cavity trees found, the project has the potential to adversely affect the red-cockaded woodpecker, and you should contact this office for further information. The Service concurs that the proposed project is not likely to adversely affect Federally-listed endangered or threatened species, their formally designated critical habitat, or species currently proposed for Federal listing under the Endangered Species Act, as amended.
