APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS

Dear Mr. Hester:
You have our approval to place fill material in 1.51 acres of wetlands or waters for the purpose
of developing a portion of the South Granville Industrial Park at SR 1215 and Norfolk Southern
Railroad , as you described in your application dated 4 October 1995. After reviewing your
application, we have decided that this fill is covered by General Water Quality Certification Number
2671. This certification allows you to use Nationwide Permit Number 26 when it is issued by the
Corps of Engineers. This Certification replaces the one issued to you on 16 November 1995.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. Deed
restrictions shall be placed on the large wetland which will not be filled to prevent future fill.
Concrete plugs shall be placed in the channels at several locations in that wetland to increase water
retention time. In addition, you should get any other federal, state or local permits before you go
ahead with your project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401
of the Clean Water Act. If you have any questions, please telephone John Domey at 919-733-1786.

SUBJECT: 401 Certification for South Granville Industrial Park,
Unnamed Tributary of Picture Creek, Neuse River Basin,
Granville County, 951075
Biologists on the North Carolina Wildlife Resources
Commission staff have reviewed the subject project. A site visit
was made on November 2, 1995. Our comments are provided in
accordance with certain provisions of the Clean Water Act of 1977
(33 U.S.C. 466 et seq.), the Fish and Wildlife Coordination Act
(48 Stat. 401, as amended; 16 U.S.C. 661-567d) and North Carolina
General Statues (G.S. 113-131 et seq.),
The proposed project involves the destruction of 1.51 acres
of wetlands under NW 26 for the construction of an industrial
building. Although these wetlands are located in Class C-NSW,
they are immediately upstream Qf WSIv-NSW and are important in
maintaining downstream water quality. These wetlands appear to
be ephemeral in nature and include some pools, which provide
important breeding habitat for amphibians.
This project is part of the South Granville Industrial Park;
however, this certification appears to apply to only one
industry. We are concerned that this piece meal approaoh to
certification does not provide for effective avoidance,
minimization and mitigation. Additionally, another industry that
may or may not be associated with this property has applied for a
certification to destroy 1.23 acres on the adjacent tract of
land. The cumulative impacts from numerous individual permits
have the potential to degrade downstream water quality, destroy
important amphibian habitat, and contribute to downstream
flooding.

We have the following comments and requests concerning this
application:
Z. Request the applicant submit an application that includes
the entire industrial park, so that the total impacts to
water quality and aquatic species can be determined and
effective mitigation can be implemented.
2. We request that deed restrictions be placed on the property
to prevent further destruction of wetlands by current or
future owners. The remaining wetlands on the property
should have sufficient runoff diverted to them tQ maintain
hydrology. We prefer that this flow he routed through a
detention pond to reduce pollutants and energy. At a
minimum the water should be routed through a flow dissipater
to prevent wetlands from being blown out or the water should
be allowed to sheet flow into the wetlands.
3. Reduce the wetland impacts by shifting the parking lot to
the end of the building and moving the sheds out of wetland
A.
4. We are concerned that the stormwater retention pond is not
of sufficient size to protect downstream water quality and
areas from flooding; and thus, request verification of the
size.
5. Stormwater from any truck parking areae or truck maintenance
areas should be routed to an oil/water separator prior to
discharging to the retention pond.
6. Unavoidable wetland impacts should be mitigated at a ratio
of 2:1 (ereated:dest.royed). We recommend that a portion of
the mitigation be in the form of creation of ephemeral pools
to replace those that are destroyed. Mitigation areas
should be adjacent to existing wetlands or streams.
