I apologize for the confusion and offer the following clarification. On 6 November 1995, DEM issued a 401 Certification to you to la(,p ill material in 2.0 acres of wetlands to establish a V.;fsture and spray field on your property. My letter of 21 December 1995 was in error and should not have been sent. Please be aware however, that spraying wastewater onto jurisdictional wet.!,- cis is not allowable under the National Pollutant Discharge Elimination System (NPDES). As long as your 2.0 acre site is gQl a jurisdictional wetlands waste can be applied. Therefore, .r the fill is appropriately made, application of waste may be initiated. Further, an approved waste maim Bement plan may be required by the Wilmington Regional Office of DEM. The Duplin County NRCS staff can probably assist you in determining how to appropriately prepare the site for spray application. In addition, according to DEM rules, a 25 foot vegetative buffer must be maintained between any spray field and streams sb own on a USGS topographic map in order to assure proper treatment of waste and no runoff off-site into waters of the state. On our site visit of 2 February 1996, we observed off-site runoff from the small intermittent stream which crosses the site and believe that jurisdictional wetlands are still present on the site. These problems will need to be addressed by consulting the Wilmington Regional Office of DEM regarding the necessity of developing a waste management plan. Mr. Bostic was not present at the meeting. Mr. Bostic has four hog houses with two waste lagoons located just behind the houses. The hog house and lagoon sit at an elevation of about 6 feet above the floodplain of Limestone Creek to the north. The floodplain of Limestone Creek consists of a mature coastal plain swamp forest with narrower wetland fingers extending out from the main swamp up natural drainageways. Vegetation in the swamp forest is dominated by bald cypress, tupelo gum, and black gum. Higher areas in the floodplain contain a mixture of swamp chestnut oak, white oak, water oak, sweetgum, loblolly pine, sweetbay, swamp cyrilla, american holly, and horse sugar. Mr. Bostic has cleared approximately 10 acres just below his waste lagoons. The area was cleared by pushing whole trees to the edges, particularly along the north side. The resulting field was leveled and sowed with grass which at this time is coming up very sparsely. The middle two acres of the field is slightly lower in elevation and remains jurisdictional wetland. An intermittent stream enters the wetland area of the field from the south. A narrow ditch has been cut on the north side of the field at the wetland area and extends about 100 feet toward the swamp. At the time of my site visit water was flowing down the intermittent stream into the center of the field. Runoff from the dirt road and some of the area around the hog houses was also flowing across the field and into the ditch where it entered the waters of Limestone Creek swamp. During drier seasons this runoff may not reach the swamp directly. In an attempt to rate the wetland area that had been cleared I looked at the adjacent wetlands immediately south and north. I came up with a rating of 56-60 with significant uses in water storage, pollutant removal, wildlife habitat, and aquatic life value. I believe that the intermittent stream probably broadened out as reached the flatter floodplain creating the wetland area. The wetland area now receives runoff from some of the mobile home park upstream as well as the hog operation. John signed the 401. # On Nov. 7, Adkins called and said that they were considering an enforcement ;action and could we hold the 401. J M ?Q'-#-Je? asked Beverley to get all the copies of the 401 and hold on to them. # She evidently got them all except unknowingly, the one to Bostic. # John D, assuming that nothing had gone out, followed up with another letter on % Dec. 21 that said we had insufficient evidence to issue the 401. Obviously tring to support the RO. We are in the process of trying to resolve this asap per your request. We will be getting up with Adkins immediately. Insufficient evidence is present in our files to conclude that your project must be built as planned.in waters and/or wetlands. Therefore, we are moving toward denial of your 401 Certification as required by 15A NCAC 2B.0109. Until we receive additional information, we are requesting (by copy of this letter) that the U.S. Army Corps of Engineers and/or the N.C. Division of Coastal Management place your. project on administrative hold. Please provide us with information supporting your position that your project must be constructed as planned and that you have no practicable alternative to placing fill in these waters and/or wetlands. Specifically can you construct your spray field without spraying onto wetlands? Application of waste water to waters of the state is not permittable under state laws. Any documentation such as maps and narrative that you can supply to address alternative designs for your project may be helpful in our review of your 401 Certification. Back in 1992 I requested an AD-1026 wetland delineation through the local Soil and Water/NRCS district. The maps indicated that I had quite a bit of upland located behind my swine nursery. since the establishment of my swine operation, I have had several complaints regarding my facility. My active waste management plan includes fields that are at or near homes and the highway. I wanted to solve the problem; therefore, I decided to clear the area behind my swine operation, hoping to alleviate the situation and prevent complaints to your office concerning my facility. Through the land clearing process, there was a small wetland area that was accidentally cleared. I acted according to policy when I fulled out the joint COE/DEM form so I could use this area. I received a letter on November 6, 1945 giving me permission from your office to fill 2.0 acres of wetlands for the purpose of creating a,paature and spray field. I communicated with the Soil and Water/NRCS district office and got the impression that there would beilff problem from the COE with the filling of this area. I later received a letter from the COE on 12/14/95 saying they would not take any action as long as my project did not impact any further wetland areas. Now i have received this latest letter dated December 21, 1995 that absolutely shocked and upset me. Mr. Dorney, I feel that 1 have acted according to policy and I have tried to act environmentally by using this small area (not 2.0 acres approx. 1.2) for the uptake of nutrients not as a discharge zone. The area is confined and can not reach any other water of the state. I have expended dollars acting on the letters I had received earlier an?o not feel it is fair for your office to treat me this way. I have no practical alternative of which I can afford at this point in time. Insufficient evidence is present in our files to conclude that your project must be built as planned in waters and/or wetlands. Therefore, we are moving toward denial of your 401 Certification as required by 15A NCAC 2B.0109. Until we receive additional information, we are requesting (by copy of this letter) that the U.S. Army Corps of Engineers and/or the N.C. Division of Coastal Management place your project on administrative hold. Please provide us with information supporting your position that your project must be constructed as planned and that you have no practicable alternative to placing fill in these waters and/or wetlands. Specifically can you construct your spray field without spraying onto wetlands? Application of waste water to waters of the state is not permittable under state laws. Any documentation such as maps and narrative that you can supply to address alternative designs for your project may be helpful in our review of your 401 Certification. Mr. Bostic was not present at the meeting. Mr. Bostic has four hog houses with two waste lagoons located just behind the houses. The hog house and lagoon sit at an elevation of about 6 feet above the floodplain of Limestone Creek to the north. The floodplain of Limestone Creek consists of a mature coastal plain swamp forest with narrower wetland fingers extending out from the main swamp up natural drainageways. Vegetation in the swamp forest is dominated by bald cypress, tupelo gum, and black gum. Higher areas in the floodplain contain a mixture of swamp chestnut oak, white oak, water oak, sweetgum, loblolly pine, sweetbay, swamp cyrilla, american holly; and horse sugar. I Mr. Bostic has cleared approximately 10 acres just below his waste lagoons. The area was cleared by pushing whole trees to the edges, particularly along the north side. The resulting field was leveled and sowed with grass which at this time is coming up very sparsely. The middle two acres of the field is slightly lower in elevation and remains jurisdictional wetland. An intermittent stream enters the wetland area of the field from the south. A narrow ditch has been cut on the north side of the field at the wetland area and extends about 100 feet toward the swamp. At the time of my site visit water was flowing down the intermittent stream into the center of the field. Runoff from the dirt road and some of the area around the hog houses was also flowing across the field and into the ditch where it entered the waters of Limestone Creek swamp. During drier seasons this runoff may not reach the swamp directly. In an attempt to rate the wetland area that had been cleared I looked at the adj acent wetlands immediately south and north. I came up with a rating of 56-60 with significant uses in water storage, pollutant removal, wildlife habitat, and aquatic life value. I believe that the intermittent stream probably broadened out as reached the flatter floodplain creating the wetland area. The wetland area now receives runoff from some of the mobile home park upstream as well as the hog operation.
