Dear Mr. Haywood:
You have our approval to place fill material in 1.1 acres of wetlands or waters for the purpose of
road construction and lot fill at Cole Mill Road and E. Oak Drive, Durham, as you described in your
application dated 2 June 1995. After reviewing your application, we have decided that this fill is
covered by General Water Quality Certification Numbers 2732 and 2671. These certifications allow
you to use Nationwide Permit Numbers 14 and 26 when they are issued by the Corps of Engineers.
This approval is.only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow tfie conditions listed in the attached certification. Deed
restrictions shall be placed on all lots with jurisdictional wetlands to prevent future wetland fill. In .
addition, you should get any other federal, state or local permits before you go ahead with your.
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401

Attached-is an application and other pertinant information to do some work in a single-family
subdivision in Durham, N.C. We have developedt the first phase of this project on land that our
family has hart for over fifty years. Now we are starting the second- and final phase . Our plan, all
along, has been to preserve the pond that we built on the site years ago. That is the reason we
pursued and were granted cluster development approval by the City of Durham when we began
the community.
A brief history of the site is:
1) We built both ponds on-the site.
2) The silt pond that we are filling was built years ago when one of
the surrounding neighborhoods was being developed. That has
been complete many years.
3) The area designated wetlands is in a location where a large
amount of the runoff from an adjacent neighborhood that was
completed about ten years ago, was focused.
We are proposing to flit the no-longer-needed silt pond that is one acre in size and t/10 acre of
the large pond. The area designated wetlands by Mr. Alsmeyer is to be made part of a larger-
