Dear Mr. Johnson:
You have our approval to place fill material in 0.02 acres of wetlands or waters for the purpose
of constructing a channel and temporary coffer dam at North Pond, Pea Island NWR, as you described
in your application dated 8 March 1995. After reviewing your application, we have decided that this
fill is covered by General Water Quality Certification Numbers 2733 and 2727. These certifications
allow you to use Nationwide Permit Numbers 18 and 33 when they are issued by the Corps of
Engineers.
This approval is only valid for the purpose-and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the. conditions listed in the. attached certification. In
addition, you should get any other federal, state or local permits before you go ahead with your
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicator
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401

Dear Mr. Johnson:
You have our approval to place fill material in 0.016 acres of wetlands or waters for the purpose
of reconstructing the North Pond pump station at the North Pond Dike approximately 0.75 miles west
of the Pea Island NWR Visitor Center, as you described in your application dated 8 March 1995. After
reviewing your application, we have decided that this fill is covered by General Water Quality
Certification Number 2733. This certification allows you to use Nationwide Permit Number 18 when it
is issued by the Corps of Engineers.
This approval is only valid for the. purpose- and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new, application.

Enclosed is an application for a Nationwide Permit No. 18
for reconstructing the North Pond pump station. Part of this
reconstruction process involves excavating an access channel to
allow an adequate volume of water into the pumping basin.
Although excavation in wetlands dominated by black needlerush and
marsh elder cannot be avoided, I believe that we have minimized
impacts as much as possible with our preferred alternative.
Except for a temporary cofferdam in North Pond, there will be no
fill placed in wetlands. To further minimize impacts, we will
leave a plug between the new channel and the tidal creek until
suspended sediments have settled.
We discussed the application with the National Marine
Fisheries Service, the U. S. Fish & Wildlife Service - Raleigh
Field Office, and the State Historic Preservation Office by
telephone on March 8, 1995. Each of those offices requested that
we not send them a copy of the application as they would receive
copies through other channels. Consequently, I have enclosed
extra copies for your use or distribution.

RECONSTRUCTION OF NORTH POND PUMP STATION
Introduction
Pea Island, a coastal barrier island in Dare County,
consists of 7 basic habitat types. The most recent survey
revealed 456 acres of ocean beach; 518 acres of barrier dune; 630
acres of sand ridge, brush, and grassland; 3,024 acres of
irregularly flooded salt marsh; 328 acres of salt flat; and 3
brackish water impoundments totaling 940 acres. Beach and dune
acreages change from year to year. In addition, the refuge has
approximately 25,000 acres in Pamlico Sound under management
authority for waterfowl by Presidential Proclamation. Prior to
becoming a refuge in 1938, most of the land was owned by a family
that used it as private hunting lands.
The three brackish water impoundments were constructed in
the mid 1960's for the purpose of optimizing habitat for
waterfowl, wading birds, and shorebirds. These impoundments,
with approximate acreages in parentheses are: North Pond (397),
New Field (320), and South Pond (223). The three impoundments
were originally designed for water management by tidal input
through concrete box culverts and flapgates. Refuge staff soon
realized that the most efficient management for optimum
production required pumping capabilities and pump stations were
constructed for all three impounded sites. Maintenance of proper
water depth and salinity during the growing season is critical to
submerged aquatic and emergent plant productivity. In December,
1993 the North Pond pump house completely burned, destroying the
diesel power unit and bulkheading. The belt driven pump head was
not damaged.
The pump station was not rebuilt in 1994 because of budget
constraints. Countless hours were spent by refuge staff and
volunteers manning flashboard risers in an attempt to maintain
appropriate water and salinity levels during the 1994 growing
season. We were successful in raising water levels during high
tide but only with a southwest wind of greater than 20 mph over a
period of a least 3 days. This combination of conditions
occurred only twice during the 1994 growing season. Efforts were
marginally successful as is evident by a decrease in productivity
from 87% submerged aquatic cover in 1993 to 57% cover in 1994.
The primary reason for this significant decline in productivity
was the inability to maintain adequate water levels relying
exclusively on wind tides. The decline in primary productivity
has led to a substantial reduction in numbers of waterfowl,
shorebirds, and wading birds using North Pond thus far in 1994.
Alternatives Considered
Through a special budget appropriation, the refuge now has
limited funds to rebuild the North Pond Pump Station. Basic
project components include pulling the existing 30" diameter pump
head and reconditioning it, building a new pump house and
installing a reconditioned diesel power unit, and building
protective wooden bulkheads in North Pond and on the sound side.
Project Description: Project components that are the same
for each alternative considered are:
1. Remove the existing 30" diameter pump head and have it
reconditioned and repainted
2. Excavate a trench through the North Pond dike
approximately 10' wide (top width) by 110' long by 10'
deep to install a new 30" steel pipe (0.5" thick).
3. Construct 60' (30' on each side of pipe) of salt treated
wood bulkheading using 10" diameter pilings sunk at
least 20' below grade and 6' above grade with a "cradle"
in the center to support the 30" diameter pipe.
Bulkheading would be constructed at a 300 from
perpendicular with the pump head to create a basin.
This bulkheading would be constructed on the west side
within the side slope of the existing dike and would not
result in backfill being placed into coastal marsh.
4. On the east side of the dike (outlet into North Pond),
30' (15' on each side of pipe) of salt treated wood
bulkheading would be constructed with 6" pilings sunk a
minimum of 10' deep with a 3' above grade elevation.
The bulkhead would be constructed 15 from perpendicular
to the pipe and would have a pipe cradle in the center.
A wooden walkway 30" wide would be constructed to the
end of the pipe. For personnel safety, this walkway
would have rails and would be approximately 10' long.
5. Construct a new wood frame pump house 12' X 18' with
aluminum siding and shingle roof set on 8" diameter wood
pilings with a lockable access door.
In planning for this project, three alternatives were
considered. They are: (1) Reconstruction on original location,
(2) Reconstruction approximately 60 feet north of the 30"
flashboard riser pipe, and (3) Reconstruction approximately 60
feet south of the original location. A separation of 60 feet
from existing structures is necessary because of the sandy soils
used to construct dikes.
Alternative 1--Reconstruction on original location:
Although this may be viewed initially as the most practical
alternative, the concrete box culvert greatly complicates
reconstruction on this location. The culvert was poured when the
dike was first constructed and was neither properly reinforced,
nor was it protected from erosion and undercutting. Since the
concrete was poured using the ground as forms, lack of
reinforcing and protection from undercutting has resulted in
significant fracturing. In order to construct on the original
site, cofferdams would be required in the tidal creek and North
Pond, dike overburden would have to be excavated, the culvert
would have to be broken up, removed, and hauled to an appropriate
disposal site. The 30" steel pipe, installed in the culvert for
pumping purposes, would have to be removed and disposed of
properly. Once site preparation is complete, construction would
proceed the same as 5or the other two locations considered.
Approximately 400 ft of tidal creek would need to be excavated
to crea#ie a basin for the re-installed pump head. Approximately
400 yds of man-made dike would be excavated. Constructing and
removing cofferdams in the creek and North Pond would require
250-300 yd of temporary fill and would result in elevated
turbidity during construction and removal.
This alternative would involve renting equipment that the
refuge does not have and the additional work elevates estimated
total project cost by $20,000 to $30,000. The increase in cost
greatly exceeds the amount available for this project.
Alternative 2--Reconstruction on a North Alignment: This
alternative would be constructed as described but would not
involve removing the concrete culvert and 30" pipe. The pump
head would be removed and the old culvert pipe would be welded
shut. An alignment 60' north of the existing flashboard riser
pipe was selected because of the need to maintaina safe distance
when excavating the trench for the new 30" pipe. This
alternative is the same as described except that it would involve
excavating a new access channel from the tidal creek to the pump
head. Dimensions of the new channel are approximately 15' wide X
70' long (longest side) X 4' deep. This ch nnel would result in
conversion of approximately 885 ft2 (156 yd ) of irregularly
flooded marsh dominated by black needlerush (Juncus roemerianus)
and marsh elder (Iva frutescens) to tidal creek. The new channel
reflects an alignment that would grade into the existing channel
to minimize bank erosion thereby decreasing the possibility of
converting additional marsh to tidal creek.
Alternative 3--Reconstruction on a South Alignment: This
alternative would be constructed as described but would not
involve removing the concrete culvert and 30" pipe. The pump
head would be removed and the old culvert pipe would be welded
shut. Several alignments were examined but were not feasible due
to the need to construct the 30' wing-wall on each side of the
pump head. An alignment 60' south of the existing concrete
culvert was selected because of the need to maintain a safe
distance when excavating the trench for the new 30" pipe and the
avoid having to extend a wing-wall into the creek. This
alternative is the same as described except that it would involve
excavating a new access channel from the tidal creek to the pump
head. Dimensions for this channel are approximately 15' wide X
44' long (longest side) X 4' deep.2 This channel would result in
conversion of approximately 702 ft (117 yd ) of irregularly
flooded marsh dominated by black needlerush (Juncos roemerianus)
and marsh elder (Iva frutescens) to tidal creek. The new channel
reflects an alignment that would grade into the existing channel
to minimize bank erosion thereby decreasing the possibility of
converting additional marsh to tidal creek.
Preferred Alternative: Because of the additional cost
associated with Alternative 1, the project cannot be completed
within the amount of funding available. Alternative l would be
considered a "No Project" option and was deleted from further
consideration due to cost and because it is believed that overall
short- and long-term impacts would be greater. Although
reconstruction of the pump station would be easier with
Alternative 2, a larger area of coastal marsh would be converted
to tidal creek. Therefore, Alternative 3 is the preferred
alternative. It is believed that the benefits to fish and
wildlife accruing.from effic?nt management of North Pond offset
impacts of converting 702 ft of coastal marsh to the same area
of tidal creek.

The NC Division of Coastal Management has reviewed your application for a Nationwide
Permit #18 (DEM ID # 95263) under the US Army Corps of Engineers to replace the pump
station and pipe on the North Pond, Pea Island NWR pursuant to Section 307 of the Coastal
Zone Management Act of 1972 as amended. Based upon our review, we have determined that
Alternative 3 is consistent with the North Carolina Coastal Management Program provided the
following conditions are met:
1) The activity described in your application qualifies to receieve one of the
Nationwide Permits described in 33 CFR Part 330 with the exception of Numbers
17, 21, 24, and 34 which were found inconsistent with the North Carolina Coastal
Management Program.
2) A 401 Water Quality Certification is received, where required, from the North
Carolina Division of Environmental Management.
3) Mitigation shall be conducted for the coastal wetlands impacted for the project.
Coastal wetlands shall be created on a 2:1 (creation:loss) ratio on a nearby site.
Specific mitigation plans shall be coordinated and approved by the NC Division
of Coastal Management.
