After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2671. This certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. You had requested a wetland determination on some property east of the school. As I understand, you want to clear this property in order to expand the athletic fields and facilities. As you can see from the map, most of the area is classified as wetlands (W). There is a small amount of non-wetland (NW) directly adjacent to the cleared area. You will need to acquire permits from the US Army Corp of Engineers, the NC Division of Environmental Management, and the Soil Conservation Service prior to clearing any of the wetlands. Also the non wetland delineation is only for Farm Bill purposes and should be verified by Army Corp and DEM so that their representative can determine if the delineation is suitable for their jurisdictional wetlands. I have enclosed a form that should be completed and returned to my office. This form is used to request a converted wetland for non agricultural use exemption (CWNA) on the wetland areas you wish to clear for athletic fields and/or buildings. Once returned to my office, I will send the form to Raleigh for review and should have the necessary permit from the SCS within 3 - 4 weeks. If approved, this permit will only be for Farm Bill purposes and does not relieve you of your responsibility to obtain the other necessary wetland permits from the Army Corp and DEM. Staff biologists with the Wildlife Resources Commission have completed a review of the project with regard to associated impacts on wildlife and fishery resources in the area. A site visit was made on March 1, 1995. Our comments are provided in accordance with provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C 661-667d), Section 401(b) of the Clean Water Act of 1977 (as amended), and the North Carolina General Statutes (G.S. 113-131 et seq.). The applicant proposes to expand athletic fields and facilities by building a soccer field, track, and bleachers. As proposed, this project would fill approximately 5 acres of 404 wetlands. This wetland area currently serves as a drainage basin for existing baseball, softball, and football fields, and four agricultural fields. Wetlands such as those found on this site provide functions that benefit the public as well as fish and wildlife. Wetlands retain and purify stormwater runoff and provide habitat for numerous species of amphibians, reptiles, birds, and mammals. Wetlands contribute large quantities of organic carbon, forming the food chain base and the resulting biological productivity for many aquatic ecosystems. As proposed, this project is inconsistent with our Policies and Guidelines for Conservation of Wetlands and Aquatic Habitats. Duplin High School 2 March 8, 1995 It is the policy of this agency to oppose projects which "displace, damage, or modify wetland values and functions." We also believe that this project is inconsistent with the Environmental Protection Agency's Section 404(b)(1) guidelines in that the project does not constitute a water dependent activity. We believe that adequate upland acreage exists adjacent to this site to accomplish the proposed construction without impacting wetland areas. Due to these factors, we request that 401 Water Quality Certification not be issued. We appreciate the opportunity to provide input into this permit review. The proposed fill is for the expansion of the athletic field at East Duplin High School, off Highway 111, Beulaville, Duplin County, North Carolina. For the purposes of the Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits. Authorization was provided, pursuant to Section 404 of the Clean Water Act, for discharges of dredged or fill material into headwaters and isolated waters. Your work is authorized by this nationwide permit provided it is accomplished in strict accordance with the enclosed conditions and provided you receive a Section 401 water quality certification from the North Carolina Division of Environmental Management (NCDEM). You should contact Mr. John Dorney, telephone (919) 733-1786. This nationwide permit does not relieve you of the responsibility to obtain other required State or local approval. This verification will be valid for two years from the date of this letter unless the nationwide authorization is modified, reissued or revoked. This verification will remain valid for the two years if, during that period, the nationwide permit authorization is reissued without modification or the activity complies with any subsequent modification. If during the two years, the nationwide permit authorization expires or is suspended or revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the nationwide permit, activities which have commenced or are under contract to commence, in reliance upon the nationwide permit, will remain authorized. This is provided the activity is completed within twelve months of the date of the nationwide permit's expiration, modification or revocation.
