This office is in receipt of your response to the above referenced Notice of Violation.
We are informed that the required check dams have been reinstalled and that site conditions
prevented floodplain benching in all but a minimal portion of the stream. As soon as the
scheduled revegetation along the stream's edge has been implemented, please notify the
Winston-Salem Regional office. Based on the Recreation Department's concerns about
visibility and security, you may prefer to revegetate with lower growing varieties of riparian
plants.
Please keep in mind that failure to perform this project in accordance with the 401
Certification would remove pre-existing water quality functions and would violate the North
Carolina Antidegradation Water Quality Standard (15A NCAC 2B .0201).

The City of Winston-Salem Recreation and Parks Department
acknowledges receipt of the Notice of Violation and the Non-
Compliance with the 401 Certification Conditions at Bowen Park.
The intent was never to be in non-compliance but to complete a
workable project acceptable to both Land Quality Management and
Water Quality Management.
A design for the Bowen Park Creekbank Stabilization Project
was submitted and, after several revisions, approved by your
Division. This design included debris control check dams,
revegetation of streambanks, and floodplain widening "which can be
widened" (see notes on sectional detail design) through the use of
floodplain benching. Theoretically, we thought all possible
problems had been addressed. Our design was incomplete as we
failed to station our floodplain benches and no specific locations
were designated in the approval by your division. We, therefore,
share in this oversight.
On September 22, 1995, I met with Ron Linville of Water
Quality Management, along with representatives from Raleigh, at the
Bowen Park Site to review the non-compliances of the project. It
was determined that an area of fifty lineal feet (50') could have
been used for floodplain benching at station 6 + 30. The total
lineal footage of the project is 2435'. Installing the floodplain

bench would. have only impacted the project by 2%. This percentage
would have had a minute effect on the velocity of the stream
throughout the total project; therefore, it is requested that this
action be waived.
To date, we have reinstalled debris control check dams in
adjacent waterways to the Bowen Boulevard Creek and volunteer
vegetation is starting to grow through the armored banks. We hope
this letter will serve as an explanation and that our corrective
actions will satisfy compliance issues in regard to the 401
Certification of Water Quality Management.

APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS

Dear Sirs:
You have our approval to place fill material in 0.8 acres of wetlands or waters for the purpose of
stabilizing streambank at Bowen Boulevard Park, as you described in your application dated
31 January 1995. After reviewing your application, we have decided that this fill is covered by
General Water Quality Certification Number 2665. This certification allows you to use Nationwide
Permit Number 13 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. Stream
side planting of such species as alder, black willow, green ash, sycamore or river birch shall be done
after construction (approximately 400 trees/acre) to stabilize the shoreline: Rock check dams shall be
installed at all ditches or tributaries to the stream in the project area to reduce velocities. In addition,
you should get any other federal, state or local permits before you go ahead with your project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401

The following conditions have been discussed with W-S
Recreation and WSRO Land Quality Section (Gray Hauser). Very
little of this project will be in actual wetlands or in the stream;
however, water quality and erosion control improvements should be
anticipated after the project as shown in the modified blueprint
(enclosed). Additionally, the park should be enhanced visually.
Significant urban runoff flows through this park. Your expertise
and knowledge could provide additional considerations, should you
be in the W-S area in the near future. The City Recreation
Department is under cosiderable local pressure to get on with this
project.
Recommended Conditions for Certification of Stream Stabilization:
1. Erosion and Sedimentation measures will meet or exceed
requirements of the N.C. Land Quality Division. (A copy of final
plans should be provided to the WSRO Water Quality Section.)
2. Grading and soil removal should be done in a manner so as
to minimize instream impacts. Instream dredging should be avoided
and should be minimized whenever such dredging is necessary.
3. Hardening of steep slopes should only be accomplished in
areas where it is not possible or practical to widen the floodplain
by creating the proposed lower floodplain benches.
4. Floodplain bench areas created during the project should
be as wide as practical without interfering with existing uses.
5. Final riparian revegetation should occur on both water
edges of the stream by use of tag alders, black willows and/or
river birch. Areas away from the actual creek may be vegetated
according to city landscaping requirements. Green ashe and
sycamores may be suitable for aesthetic purposes and may provide
for enhanced upper bank stabilization during severe flooding.
6. Rock check dams should be installed in ditches and other
tributaries discharging into the stream throughout the project area
for the collection of debris and trash as well as to reduce
sidestream water velocities.
