Dear Mr. Dorney:
This correspondence is in response to your letter of April 21, 1995,
regarding your Division's review of my client's Department of the Army
Individual Permit application to continue sand mining activities on his
property. The project site is located on property owned by Mr. Rex Tillett,
located off S.R. 1123 (Burnside Road), adjacent to the Croatan Sound,
Manteo, Dare County, North Carolina.
After our March 22, 1995, telephone conversation, I advised my client
of your concerns regarding the existing pipeline, fill area, and need to develop a
mitigation plan. As a result of that conversation, the pipe (which leads from
the basin to the sound) has been removed from the project site. In addition,
the accidental fill area has also been cleaned up, with the material removed
from wetlands. The spoil has been placed on the existing dike and will be used
to repair the dike as needed.
As far as the proposed mitigation plan is concerned, my client has agreed
to undertake the planting of cypress and Atlantic white cedar tree saplings in
the disturbed wetland area between the project site and the sound. Any
remaining affected wetland areas will also be restored to wetland elevation and
planted with cypress and cedars. The work. will take place during the
appropriate growing season conditions and will be available for inspection by
Division staff as requested.

Your application for a Water Quality Certification under Section 401 of the Federal Clean
Water Act was received by the Division on 18 January 1995. The activity for which the
Certification is sought is to fill 3.79 acres of wetland to expand the Radco Mine. A Water
Quality Certification is a determination by the Division that the activity for which the federal
permit or license is sought is not expected to result in a violation of state water quality
standards for the waters of the state.
After a thorough, on-site inspection of your property, my staff has determined that
existing uses are present in the wetlands for which you have requested a certification. These
uses include water storage, pollutant removal, and aquatic life habitat. As provided by 15A
NCAC 2B .0109, the 404(b)(1) Guidelines are used as guidance in determining if a proposed
project will remove the existing uses of a wetland. In accordance with these guidelines the
Division has determined that the subject project is not water-dependent and that you have not
demonstrated that practicable alternatives to the proposed project cannot be constructed in an
upland area. Additional problems with this project were outlined in our 27 February 1995
and 21 April 1995 letters. Responses to those questions have not been received. Therefore I
am hereby notifying you that the subject project would result in a violation of 15A NCAC 2B
.0201(b). Therefore, in accordance with 15A NCAC 211 .0504(e), I have determined that the
401 Water Quality Certification for this project shall be denied.

If this denial is unacceptable to you, you have the right to an adjudicatory hearing
upon written request within thirty (30) days following receipt of this denial. This request
must be in the form of a written petition conforming to Chapter 150B of the North Carolina
General Statutes and filed with the Office of Administrative Hearings, P.O. Box 27447,
Raleigh, NC 27611-7447. Unless such demands are made, this denial shall be final and
binding. Finally, we are available to further discuss modification to your proposal which
would answer our objections and allow issuance of a 401 Certification.

Dear Colonel Sperberg:
The State of North Carolina has completed its review for consistency with the North
Carolina Coastal Management Program, pursuant to 15 CFR 930, of Corps Public Notice number
Action ID 199401811, regarding an application by Mr. Rex Tillett to continue to mine sand from
3.79 acres of a 4.99 acre site at Radco Mine, located adjacent to Croatan Sound near Manteo,
Dare County, NC. According to the public notice, mining has already occurred on .7 of the 3.79
acres of wetlands on the site. Based upon our review, we disagree with the applicant's
determination that the proposal is consistent with the North Carolina Coastal Management
Program.
The area of mining consists of freshwater wetlands adjacent to Croatan Sound. These
wetlands provide functions which benefit the public as well as natural coastal resources.
Wetlands act as a stormwater runoff purification zone between upland areas and surface waters.
Wetlands store and convey flood waters and provide shoreline erosion protection through
attenuation of wave energy. Wetlands also serve as physical habitat for numerous species of
amphibians, reptiles, birds, and mammals. In some instances, wetlands serve as spawning and
nursery areas for anadromous fish. Through deposition of detritus into adjacent waters, wetlands
contribute large quantities of organic carbon to adjacent waters, forming the food chain base and
the resulting biological productivity for many aquatic ecosystems.
The proposal is inconsistent with the Dare County 1993 Land Use Plan. The County 's
policy on wetland impacts is "to promote the preservation of existing expanses of freshwater
wetlands but to accept occasional losses of isolated pockets ....when the level of alteration is
minimal". The County distinguishes between such wetlands by classifying small pockets of less
than one acre of isolated wetlands as Limited Conservation and by classifying those freshwater

wetlands greater than one contiguous acre as Conservation. The proposed mine expansion
involves the loss of a large expanse of wetlands and is clearly in direct conflict with the County's
policy.
A 401 Water Quality Certification from the North Carolina Division of Environmental
Management is required for the proposed activity. Although a final decision has not been issued,
we understand that the Division of Environmental Management may be moving toward denial
of the Certification. If the 401 Water Quality Certification is denied, the proposal is inconsistent
with 15A NCAC 7M.0800.
The North Carolina Wildlife Resources Commission has also concluded that the project
would result in the significant loss of wetlands with no mitigating factors or public benefits.
As proposed. the project is inconsistent with the NC Wildlife Resources Commission's Policies
and Guidelines for the Conservation of Wetlands and Aquatic Habitats. Specifically, these
policies state that "Unless the purpose of the project is to restore wetland values and function,
has significant public benefits, and fully mitigates all wetland and aquatic ecosystem impacts, the
Wildlife Resources Commission opposes excavation in wetlands or aquatic habitats for any
project other than those described in these guidelines."
In summary, the proposed activity will result in the irretrievable loss of 3.79 acres of
wetlands adjacent to Croatan Sound and the elimination of their associated wetland functions and
habitat. The proposal is inconsistent with the enforceable policies and standards of the North
Carolina Coastal Management Program and is inconsistent with the Dare County Land Use Plan.
The proposal is also inconsistent with the policies and guidelines of the Wildlife Resources
Commission. We suggest that the applicant consider alternative upland sites for mining that
would avoid excavation or filling of wetlands. Mining isolated pockets of freshwater wetlands
in upland areas might be considered acceptable if the applicant were to include wetland
restoration and mitigation for the loss of wetlands as part of the proposal.
If the proposal is modified such that it can be found consistent with the North Carolina
Coastal Management Program, or should the applicant successfully appeal our finding, the
following conditions would be required to be included on the Corps License:
1. A 401 Water Quality Certification must be obtained from the Division of Environmental
Management.
2. All proposed work within the SR 1123 right-of-way must be coordinated through the NC
DOT Highway Office in Elizabeth City.
A copy of this letter will be mailed to the applicant to serve as our formal notice that we
have found the proposed activity inconsistent with the North Carolina Coastal Management
program. It will also serve as notice that this finding may be appealed to the Secretary, U.S.
Department of Commerce, Washington, DC. The appeal must be filed within 30 days of receipt
of this letter and must specifically address the applicant's belief that either (1) the activity is
consistent with the objectives of the Federal Coastal Zone Management Act, or (2) the activity
is necessary in the interest of national security.

Management correspondence dated April 13, 1995, we have learned
that your plans to mine approximately 42,366.80 cubic yards of
sand within a 3.79 acre area of wetlands in RADCO Mine located on
the north side of S.R. 1123 (Burnside Road), adjacent to the
Croatan Sound, approximately 1.5 miles west of Manteo, Dare
County, North Carolina, has been determined to be inconsistent
with the Dare County Land Use Plan and the North Carolina Coastal
Management Program. Therefore, under the administrative rules of
our regulatory program, we cannot give favorable consideration to
issuance of Federal authorization. Accordingly, your Department
of the Army application is hereby denied, without prejudice, and
your file has been retired.
Further consideration for Department of the Army
authorization must await your successful appeal of the findings
of inconsistency with the North Carolina Division of Coastal
Management. After you have satisfied the Dare County Land Use
Plan and the North Carolina Division of Coastal Management, we
will re-consider your application for Federal authorization.

On 27 February 1995 I wrote you concerning problems with issuing a Water Quality
Certification for your plans to mine 3.79 acres of wetlands at the Radco site. These problems include
lack of a mitigation plan, wetland fill done before a Certification or Permit was issued and the existing
pipeline which leads south from the upland basin toward the Sound. On 7 March 1995, I received a
letter form your consultant (Gary Mitchell) and I discussed the letter with him by phone on 22 March
1995. Mr. Mitchell was informed that DEMs concerns outlined above remain unanswered and that no
Certification would be issued until adequate answers were received.
To date, I have received no response from you or Mr. Mitchell regarding the concerns outlined
above. If I do not receive an adequate answer within two weeks, I will have to recommend that the
Director of DEM deny this Certification. -

This correspondence is in response to your letter of February 27, 1995,
regarding your Division's review of my client's Department of the Army
Individual Permit application to continue sand mining activities on his
property. The project site is located on property owned by Mr. Rex Tillett,
located off S.R. 1123 (Burnside Road), adjacent to the Croatan Sound,
Manteo, Dare County, North Carolina.
This project involves the continuation of an existing, on-going, sand
mining operation (excavation project), and is not an application to place fill
material in wetlands, as erroneously referenced in your letter. The project as
proposed will allow the applicant to complete the excavation activities
pursuant to the permit life of his State Mining Permit, in addition to
reclaiming the site in accordance with the terms and conditions of the State
Mining Permit.
As previously discussed in response to the September 14, 1994,
correspondence from the U.S. Army Corps of Engineers, the applicant does not
own any uplands suitable to undertake the mining activity, and in fact, is only
attempting to complete an activity that originally did not require a "wetland"
permit when it first began. In addition, the project was reviewed during the
Division of Land Quality's permit process, and it did not require a wetland
permit at that time.
The site consists of a highly disturbed 404 wetland community and
contains several layers of trash, junk, and other debris discarded by local

residents over the years. After the project is completed, the site will be
reclaimed and a "clean pond" surrounded by 404 wetlands, will result. The site
will probably result in an enhancement of wildlife and fisheries habitat, as well
as an improvement in water quality functions.
As far as mitigation is concerned, it is not a practicable alternative for
this site. The project site is predominantly a jurisdictional wetland area, and
except for the existing road, there is no available area to mitigate on without

The Division of Environmental Management, Water Quality Section has reviewed your plans
for the discharge of fill material into 3.79 acres of waters and/or wetlands located at Radco mine (SR
1123) in Dare County for expansion of an existing sand mind. Based on this review, we have
identified significant uses which would be removed by this project. These uses are water pollutant
removal and wildlife habitat. Furthermore, insufficient evidence is present in our files to conclude that
your project must be built as planned in waters and/or wetlands. Therefore, we are moving toward
denial of your 401 Certification as required by 15A NCAC 2B.0109. Until we receive additional
information, we are requesting (by copy of this letter) that the U.S. Army Corps of Engineers and/or
the N.C. Division of Coastal Management place your project on administrative hold.
Please provide us with information supporting your position that your project must be
constructed as planned and that you have no practicable alternative' to placing fill in these waters
and/or wetlands. Specifically can you construct your sand mine on nearby uplands or prior converted
farmland? In addition some new wetland fill has already occurred on this site. Applicant is reminded
that no wetland fill should occur unless a 404 Permit and 401 Certification are issued. Also please
discuss the purpose and need for the pipe that leads south of the upland basin toward the sound. Does
a discharge permit exist for this pipe? Also please discuss any plans for wetland mitigation for this
project. Any documentation such as maps and narrative that you can supply to address alternative
designs for your project may be helpful in our review of your 401 Certification. Please respond within
two weeks of the date of this letter by sending a copy of this information to me and one copy to our
Ms. Deborah Sawyer at the Washington Regional Office at 1424 Carolina Avenue, Washington, N.C.

MR. REX TILLETT, Post Office Box 2313, Manteo, North Carolina 27954,
telephone (919) 473-5537, has applied for a Department of the Army (DA) permit
TO MINE APPROXIMATELY 42,366.80 CUBIC YARDS OF SAND FROM WITHIN A 3.79 ACRE
AREA OF WETLANDS IN RADCO MINE located on the north side of S.R. 1123
(Burnside Road), adjacent to the Croatan Sound, approximately 1.5 miles west
of Manteo, Dare County, North Carolina.
The following description of the work is taken from data provided by the
applicant. The applicant is currently mining wetlands within a 4.99 acre area
permitted by State Mine Permit No. 28-14. Of this 4.99 acres, 0.7 acres have
already been mined to an average depth of 8.0 feet. Plans included with the
application show that the applicant proposes to hydraulically dredge
approximately 42,366.80 cubic yards of sand material from the remaining 3.09
acre unmined wetland area. The dimensions of this proposed mining activity
equal approximately 667 feet long by 245 feet wide by an average of 7.0 feet
deep. A 50 foot natural buffer will remain around the proposed excavation
area. The dredge spoil material will be pumped via a pipe to an approved high
ground disposal area. The area of wetlands to be mined is primarily vegetated
with Salix nigra, Arundinaria gigantea, and Phragmites australis. The purpose
of the work is to continue the existing mining operation on this property.
Plans showing the work are included with this public notice.
The North Carolina Department of Environment, Health and Natural Resources
has authorized this work via Division of Land Quality State Mine Permit No.
28-14.
The applicant has determined that the proposed work is consistent with
the North Carolina Coastal Zone Management Plan and has submitted this
determination to the North Carolina Division of Coastal Management (NCDCM) for
their review and concurrence. This proposal shall be reviewed for the
applicability of other actions by North Carolina agencies such as:
a. The issuance of a Water Quality Certification under Section 401 of
the Clean Water Act by the North Carolina Division of Environmental Management
(NCDEM).
b. The issuance of a permit to dredge and/or fill under North Carolina
General Statute 113-229 by the North Carolina Division of Coastal Management
(NCDCM).
C. The issuance of a permit under the North Carolina Coastal Area
Management Act (CAMA) by the North Carolina Division of Coastal Management
(NCDCM) or their delegates.
d. The issuance of an easement to fill or otherwise occupy State-owned
submerged land under North Carolina General Statute 143-341(4), 146-6, 146-11,
and 146-12 by the North Carolina Department of Administration (NCDA) and the
North Carolina Council of State.
e. The approval of an Erosion and Sedimentation Control Plan by the Land
Quality Section, North Carolina Division of Land Resources (NCDLR), pursuant
to the State Sedimentation Pollution Control Act of 1973 (NC G.S. 113 A-50-
66).
The requested Department of the Army (DA) permit will be denied if any
required State or local authorization and/or certification is denied. No DA
permit will be issued until a State coordinated viewpoint is received and
reviewed by this agency. Recipients of this notice are encouraged to furnish
comments on factors of concern represented by the above agencies directly to
the respective agency, with a copy furnished to the Corps of Engineers.
This application is being considered pursuant to Section 404 of the Clean
Water Act (33 U.S.C. 1344). Any person may request, in writing within the
comment period specified in the notice, that a public hearing be held to
consider this application. Requests for public hearing shall state, with
particularity, the reasons for holding a public hearing.
The District Engineer has consulted the latest published version of the
National Register of Historic Places for the presence or absence of registered
properties, or properties listed as being eligible for inclusion therein, and
this worksite is *not registered property or property listed as being eligible
for inclusion in the Register. Consultation of the National Register
constitutes the extent of cultural resource investigations by the District
Engineer, and he is otherwise unaware of the presence of such resources.
Presently, unknown archeological, scientific, prehistorical, or historical
data may be lost or destroyed by work under the requested permit.
The District Engineer, based on available information, is not aware that
the proposed activity will affect species, or their critical habitat,
designated as endangered or threatened pursuant to the Endangered Species Act
of 1973.
The decision whether to issue a permit will be based on an evaluation of
the probable impacts, including cumulative impacts, of the proposed activity
and its intended use on the public interest. Evaluation of the probable
impacts which the proposed activity may have on the public interest requires a
careful weighing of all those factors which become relevant in each particular
case. The benefits which reasonably may be expected to accrue from the
proposal must be balanced against its reasonably foreseeable detriments. The
decision whether to authorize a proposal, and if so the conditions under which
it will be allowed to occur, are therefore determined by the outcome of the
general balancing process. That decision should reflect the national concern
for both protection and utilization of important resources. All factors which
may be relevant to the proposal must be considered including the cumulative
effects thereof. Among those are conservation, economics, aesthetics, general
environmental concerns, wetlands, cultural values, fish and wildlife values,
flood hazards and flood plain values (in accordance with Executive Order
11988), land use, navigation, shore erosion and accretion, recreation, water
supply and conservation, water quality, energy needs, safety, food and fiber
production, mineral needs, considerations of property ownership, and, in
general, the needs and welfare of the people. For activities involving the
placement of dredged or fill materials in waters of the United States, a
permit will be denied if the discharge that would be authorized by such permit
would not comply with the Environmental Protection Agencies' 404(b)(1)
guidelines. Subject to the preceding sentence and any other applicable
guidelines or criteria, a permit will be granted unless the District Engineer
determines that it would be contrary to the public interest.

The Corps of Engineers is soliciting comments from the public; Federal,
State and local agencies and officials; Indian Tribes and other interested
parties in order to consider and evaluate the impacts of this proposed
activity. Any comments received will be considered by the Corps of Engineers
to determine whether to issue, modify, condition or deny a permit for this
proposal. To make this decision, comments are used to assess impacts on
endangered species, historic properties, water quality, general environmental
effects and the other public interest factors listed above. Comments are used
in the preparation of an Environmental Assessment (EA) and/or an Environmental
Impact Statement (EIS) pursuant to-the National Environmental Policy Act
(NEPA). Comments are also used to determine the need for a public hearing and
to determine the overall public interest of the proposed activity.
Generally, the decision whether to issue this Department of the Army (DA)
permit will not be made until the North Carolina Division of Environmental
Management (NCDEM) issues, denies, or waives State certification required by
Section 401 of the Clean Water Act. The NCDEM considers whether or not the
proposed activity will comply with Sections 301, 302, 306, and 307 of the
Clean Water Act. The application and this public notice for the Department of
the Army (DA) permit serves as application to the NCDEM for certification.
Additional information regarding the Clean Water Act certification may be
reviewed at the offices of the Environmental Operations Section, North
Carolina Division of Environmental Management (NCDEM), Salisbury Street,
Archdale Building, Raleigh, North Carolina. Copies of such materials will be
furnished to any person requesting copies upon payment of reproduction costs.
The North Carolina Division of Environmental Management (NCDEM) plans to
take final action in the issuance of the Clean Water Act certification on or
after March 2, 1995.

Enclosed is the application of Mr. Rex Tillett, for Department of the Army

receipt of this letter verifies your acceptance of a valid request for certification
in accordance with Section 325.2(b)(ii) of our administrative regulations.
We are considering authorizing the proposed activity pursuant to Section 404 of
the Clean Water Act, and we have determined that a water quality certification may
be required under the provisions of Section 401 of the same law. A Department of
the Army permit will not be granted until the certification has been obtained or
waived.
In accordance with our administrative regulations, 60 days after receipt of a
request for certification is a reasonable time for State action. Therefore, if you
have not acted on the request by March 10, 1995, the District Engineer will deem
that waiver has occurred.
