Dear Mr. Crew:
You have our approval to place fill material in 0.3 acres of wetlands or waters for the purpose of
constructing a sewer line at Beaty Road sanitary outfall, as you described in your application dated
5 January 1995. After reviewing your application, we have decided that this fill is covered by General
Water Quality Certification Number 2664. This certification allows you to use Nationwide Permit
Number 12 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification:. In
addition, you should get any other federal, state or local permits before you go ahead with your
project.
If you do not accept any of the conditions of this certification, you may. ask for an adjudicatoryhearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing,:
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes, to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401
of the Clean Water Act. If you have any questions, please telephone John Domey at 919-733-1786.

SUBJECT: Application for 401 Certification by City of Gastonia
for installation of sewer lines along an unnamed
tributary to Catawba Creek, Gaston County (No. 95030).
This correspondence responds to a request by you for our
comments regarding the application for 401` Certification by the
City of Gastonia for installation-.of sewer line along an unnamed
tributary to Catawba Creek along SR 2439 and SR 2714. The sewer
line will cross SR 2710, SR 2711, and SR 2445.
The North Carolina Wildlife Resources Commission (NCWRC) has
the following recommendations:
1) Stream crossings should be minimized, located at narrow
areas, and made perpendicular to the stream where possible.
2) Sewer lines should also be buried in the substrate at stream `0
crossings or attached to bridges so that fish passage is not
blocked and debris does not collect.
3) If sewer lines will be encased in concrete at crossings,
this must be accomplished so that wet concrete does not
contact live stream water. This will lessen the chance of
altering the stream's water chemistry and causing a fish
kill.
4) An undisturbed vegetated buffer zone should be preserved VA
between the stream and construction activities, except at
crossings. Where the buffer zone is less than 50 feet wide,
erosion control measures should be especially stringent.
5) Excavated material should be stockpiled away from streams.

6) Riparian vegetation, especially trees, should be preserved
as much as possible at stream crossings. Trees that must be
removed should be cut near ground level, leaving the stump
and roots in the bank for stability and to possibly sprout.
7) Natural materials should be used as much as possible to
restore stream banks at crossings. Riprap should be limited
to the stream bank below the high water mark, and vegetation
should be used for stabilization above high water.
8) Permanent herbaceous vegetation in disturbed areas should be
established within 15 days of ground disturbing activities
to provide long term erosion control. We prefer a "seed as
you go" strategy rather than allowing a large amount of soil
to lay bare.
9) A portion of the right-of-way (ROW) (1 acre scattered)
should be planted with VA-70 lespedeza, Korean lespedeza,
and/or partridge pea to provide food and additional habitat
for wildlife.
10) The ROW should be mowed if necessary not more than once
every 2-3 years. We recommend mowing only in February and
March.to protect small game nesting later in the year.
