Box 29535 Raleigh, NC 27626-0535 Dear Mr. Dorney: ?q '1c?G VIP, ti No This letter is with reference to DEM Project 93511 (South Ridge Subdivision) located at U.S. 158 Bypass in Dare County, which involved a request for Nationwide Permit No. 26 made in the name of Nags Head Construction & Development, Inc. As we have discussed in our previous correspondence, this project was placed on hold while the Nags Head Land Use Plan was amended to allow the proposed project. Enclosed you will find the finding of consistency from the North Carolina Division of Coastal Management, and by copy of that letter of consistency, we ask for reactivation of your consideration of the 401 water quality certification. I have enclosed a copy of the subdivision plat which shows the location of the roads and size and configuration of the individual lots for this proposal as you requested. It is my understanding that this information is needed for you to continue to assess the 401 water quality certification. I look forward to your expeditious response to this request. Box 1000 Washington, NC 27889-1000 Dear Mr. Sugg: This letter is with reference to the application of Nags Head Construction & Development, Inc., for a Department of Army authorization to place fill in wetlands in Nags Head, North Carolina. Please reference action I.D.#199302886. This request was denied without prejudice subject to the reconsideration of the North Carolina Division of Coastal Management and its review of the Nags Head Land Use Plan. This finding was made on July 22, 1993, and since that time, Nags Head has revised its land use plan which has made this proposal consistent with the terms of the land use plan language. On January 6, 1995, we received the attached finding of consistency, and forward this to your office and to the Division of Environmental Management under I.D. #93-N-028 for your consideration of authorization. I have also attached a letter of September 9, 1993, from Dr. Wright which summarizes the federal record and indicates that the letters which were received during the review process, include the North Carolina Department of Environment, Health and Natural Resources' finding of inconsistency with the land use plan, and the letter from the National Marine Fisheries that found no adverse affect on fisheries resources. You will also note that there were no comments received from U. S. Fish & Wildlife nor U. S. Environmental Protection Agency. Dear Sirs: The North Carolina Division of Coastal Management has reviewed the above referenced application for a Nationwide Permit dated June 7, 1993 and resubmitted by your agent George Wood on December 19, 1994 pursuant to Section 307 of the Coastal Zone Management Act of 1972 as amended. Based upon our review, we have no objection to the proposed activity provided the following conditions are met: The activity described in the above referenced application qualifies to receive one of the Nationwide Permits described in 33 CFR Part 330 with the exception of Numbers 17, 21, 24, and 34 which were found inconsistent with the North Carolina Coastal Management Program. 2. A 401 Water Quality Certification is received, where required, from the North Carolina Division of Environmental Management. 3. All Town of Nags Head and County of Dare approvals and authorizations are received.
