Hougnon: You have our approval to place fill material in 0.52 acres of wetlands or waters for the purpose of constructing a 1.8 miles of roadway and bridge across Little River, as you described in your application dated 13 July 1995. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2671. This certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers. This Certification replaces and updates one issued on 25 July 1995. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. A biological assessment was prepared by the Department of the Army to fulfill it's Section 7(a)(2) responsibilities under the Endangered Species Act of 1973, as amended (16 U.S.C. 1531-1543) (Act). These comments are provided in accordance with provisions 6f the Act. Based upon the information provided in your biological assessment, the Service concurs with your conclusions that the proposed project will have "no effect" on the endangered rough-leaved loosestrife (Lysimachia asperulaefolia), American chaffseed (Schwalbea americana), pondberry (Lindera melissifol.ia), St. Francis' satyr (Neonympha mitchelli francisci) or endangered red-cockaded woodpecker (Picoides borealis) in clusters 182, 260, 330, 1301, 1303, and 1305 and "is not likely to adversely effect" the endangered red-cockaded woodpecker (Picoides borealis) in clusters 369, 1302, and 1304. Therefore, we believe that the requirements of Section 7 of the Act have been satisfied. However, obligations under Section 7 consultation must be reconsidered if: (1) new information reveals impacts of this identified action that may affect listed species or critical habitat in a manner not previously considered; (2) this action is subsequently modified in a manner which was not considered in this review; (3) a new species is listed or critical habitat determined that may be affected by the identified action. In regards to the proposed bridge construction to cross the Little River, we would like to emphasize that it is the U. S. Army's responsibility to determine the amount of wetlands to be impacted by this project, and to secure any necessary permits from the U.S. Army Corps of Engineers Regulatory office located in Wilmington, North Carolina. If this project will result in the filling of Clean Water Act Section 404 jurisdictional wetlands, a compensatory wetland mitigation plan may be required. We appreciate your efforts to ensure the conservation of listed species as part of our joint responsibilities under the Act.
