C. 28302-1089 Dear Sirs: You have our approval to place fill material in 3.0 acres of wetlands or waters for the purpose of constructing a sanitary sewer at the Carvers Creek area, as you described in your application dated 15 June 1995. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2664. This certification allows you to use Nationwide Permit Number 12 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. Anti- seep collars shall be placed at stations 2 + 50, 4 + 25, 7 + 50, 12 + 75, 28 +25, 32 + 25, 33 + 75, 35 + 50, 39 + 50, 40 + 75, 44 + 25 and 47 + 25. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Environmental Management under Section 401 of the Clean Water Act. If you have any questions, please telephone John Domey at 919-733-1786. NORTH CAROLINA 28305 TELEPHONE: (910) 4845191 FAX: (910) 484-0388 June 15, 1995 US Army Corps of Engineers ?0 Wilmington District PO Box 1890 Wilmington, NC 28402-1890 ATTN: Mr. Matt Flint REF: Carver's Creek Outfall US 401-N to Oak Island Fayetteville, NC Dear Mr. Flint: The Public Works Commission of the City of Fayetteville (PWC) is proposing the installation of approximately 3650 feet of 30 inch and 1280 feet of 24 inch gravity flow sanitary sewer in the Carver's Creek area. This sanitary sewer system potentially could serve more than 5000 acres in the Fayetteville area. We have determined from extensive on-site investigations that in order for this sanitary sewer system to be installed 3.0 acres of wetlands will be impacted. Wetlands delineations of the proposed site were performed in the field by Bud Needham and Chip Bolchoz with a portion of the delineation having been previously approved by Scott McLendon, USACOE. Therefore, we would like to apply for the necessary Nationwide permit to implement this sanitary sewer system. We would like to assure you of our previous planning to minimize wetland impact. For example, the majority of the manholes (MH) are located on upland areas. Also, given our previous experience in, this area, we will use the USACOE's guidelines for the installation of utility structures in wetlands such as, but not limited to: 1. Clearing limits of 40 feet. 2. Replacement of excavated material and topsoil. 3. Control of erosion and sediment flow 4. Return disturbed area to original contours and stabilize immediately upon completion of construction. These erosion control measures are subject to approval by the North Carolina Department of Environment, Health & Natural Resources. Please note that the water level will have to be lowered in Bullard's Pond for the construction and this has been previously approved by NCDEHNR.
