On behalf of VK Magnolia LLC (owner/applicant) please find attached, a complete application and
supplemental information requesting written concurrence from the US Army Corps of Engineers
(USACE) and the North Carolina Division of Water Resources (NCDWR) that the proposed
impacts associated with the activities described herein may proceed under Nationwide Permit
(NWP) 12 and General Certification (GC) 4133. A Neuse Buffer Authorization is also requested.
Project Location
The project is located southeast of Hebron Road and Danube Lane intersection in Durham, NC.
Representative coordinates for the project are 36.054°N, 78.887°W.
Project Summary and Purpose
The overall project includes the construction of a single-family residential subdivision with
associated roads and utilities which will connect to existing adjacent infrastructure in the area.
The purpose of the overall project is to construct a residential subdivision and associated utilities
to meet the demand for housing in this part of Durham County, NC. The purpose of the proposed
impacts is to connect a portion of the residential project located in the SW corner of the property
to the rest of the project with a gravel walking path and to connect this portion of the project's
sewer to existing lines located to the east of the tributary.
Project History
The overall project consists of a residential subdivision with single-family residential units and
associated utilities (e.g. sanitary sewer utility, road, stormwater, etc.). Action ID SAW -2013-01300
refers to a "No Department of the Army Authorization Required" notice issued on July 22, 2013

for the site plan which previously avoided wetland, stream, and buffer impacts. A riparian buffer
determination (NBRRO#13-255) was issues by NCDWR on September 18, 2013. The stormwater
management plan was previously approved by Durham.
The project site was previously forested but has been cleared in the past year. The construction
of the infrastructure (i.e. roads, utilities, stormwater BMPs) is complete in the southern portion of
the project and is being constructed in the NE portion of the project (closest to Hebron Road) as
per the previously reviewed plan. The portion of the project located in the SW corner that the
proposed sewer crossing and gravel walking path will access, has not been cleared and is still
wooded.
No recorded historic structures or historic districts are located on the project site (see attached
Figure 4).
The NC Natural Heritage Database (2019) was queried and a report (dated July 4, 2019) was
received from NCNHP. A population of smooth coneflower (Echinacea laevigata) is recorded as
being located within the 1 -mile search radius of the Project. The majority of the subdivision has
been cleared in the past year however previously contained densely vegetated woods with dense
mid and understories. The portion of the project in the SW corner that will be accessed by the
proposed sewer and gravel walking path connection has not been cleared and contains dense
woods with densely vegetated mid and understories. The area where the crossing will occur is
mapped as lacking the basic soils typically preferred by the smooth coneflower, therefore the
smooth coneflower's preferred habitat does not exist within the proposed corridor.
Avoidance and Minimization
Proposed roads and lots were arranged on the overall project so as to avoid impacts to wetlands,
streams, and riparian buffers. Temporary stream impacts were minimized to 32 LF associated
with the proposed sewer crossing. Additional stream impacts were avoided by utilizing a bridge
to cross the stream with the walking trail. Riparian buffer impacts were minimized by crossing the
stream at a perpendicular angle. Construction fencing will be used to define the construction
corridor and prevent any accidental additional impacts. Silt fencing will be installed to provide
additional protection from runoff.
Project Impacts
The project will incur only temporary impacts to 32 LF of stream associated with a sewer line utility
installation. No impacts to wetlands are proposed.
The Project is located within the Neuse River Basin. Permanent buffer impacts proposed for the
project include 3,175 Square Feet (ft2) (1,893 ft2 in Zone 1 and 1,282 ft2 in Zone 2) resulting from
the sewer installation and 1,430 ft2 (1,072 ft2 in Zone 1 and 358 ft2 in Zone 2) resulting from the
gravel walking trail.
Mitigation
Stream impacts were minimized and avoided to the maximum extent practicable for the overall
project and will only include the temporary impacts totaling 32 linear feet, so no stream mitigation
is proposed. Impacts to the riparian buffer are considered "Allowable" in the Table of Uses.
Therefore, no buffer mitigation is proposed.

application. Upland areas to the NE on the site are currently being developed as per previously submitted plans. The
property to the west is forested. Single-family residential developments exist in the vicinity of the project.

Subdivision).

3d. Explain the purpose of the proposed project:
The purpose of the overall proposed project is to construct a residential subdivision and associated utilities to meet the
demand for housing in this part of Durham County, NC. The purpose of the proposed impact is to extend a sewer line
from the western portion of the site to existing lines located to the east of the proposed crossing.
3e. Describe the overall project in detail, including the type of equipment to be used:
The overall project consists of a residential subdivision with single-family residential units and multi -family units with
associated utilities (e.g. sanitary sewer utility, road, stormwater, etc.). Access to the subdivision will be from Danube
Lane to the west and Horton Road to the north. Permanent wetland and stream impacts have been avoided. Multiple
Stormwater BMP's are proposed to treat stormwater on-site. Approved stormwater BMPs already exist in locations
adjacent to the portions of the site that have already been constructed. Proposed temporary stream impacts and
riparian buffer impacts will result from the installation of a sewer line that crosses the stream at a perpendicular angle
and a bridged (i.e. no stream impact) greenway path that utilizes the sewer easement when possible. Heavy equipment
typically used for utility installation projects (e.g. back hoes, bulldozers, etc.) will be utilized.

Authorization Required" letter was issued (see attached copy) on July 22, 2013 for the proposed site plan (same as current
with the exception of the proposed sewer crossing). The project was assigned SAW -2013-01300. A stream and buffer
determination site meeting was held with Ms. Sara Knies on September 18, 2013 and a determination letter (NBRRO#13-
255) issued on September 18, 2013 see attached).

and lots were positioned and aligned so as to completely avoid impacts to streams, wetlands, and buffers. With the
exception of the single perpendicular crossing both sewer line corridors and greenway trails were designed to avoid
streams, wetlands and riparian buffers. A bridge will be used for the greenway crossing so as to avoid stream impacts.
Construction fencing will be used to define the construction corridor and prevent any accidental additional impacts. Silt
fencing will be installed to provide additional protection from runoff.

The North Carolina Natural Heritage Program (NCNHP) appreciates the opportunity to provide
information about natural heritage resources for the project referenced above.
A query of the NCNHP database indicates that there are records for rare species, important natural
communities, natural areas, and/or conservation/managed areas within the proposed project

The attached 'Potential Occurrences' table summarizes rare species and natural communities that
have been documented within a one -mile radius of the property boundary. The proximity of these
records suggests that these natural heritage elements may potentially be present in the project area
