(Trigon) is pleased to provide this letter responding to your request for more information about the referenced project located in Sunset Beach, North Carolina. The request for additional information was summarized in a letter dated July 27, 2006 following your receipt of a Pre- construction Notification (PCN) submitted to the US Army Corps of Engineers (USAGE) for a Nationwide 39 Permit. Our response is organized in the order of the four requested items. Item 1: As we have discussed by telephone, Trigon has submitted an application for an Individual Permit to the US Army Corps of Engineers. A copy of the application submittal is attached. Item 2: As stated in our PCN, the project is not financially viable without Building 4 and additional parking. During the initial feasibility study of the project, the utmost consideration was given to preserving the integrity of the stream. Several schematic design options were considered in an effort to eliminate the need to impact the stream. The proposed layout gives the best building and parking layout, maximizes the open space remaining, and requires the least impact to the stream channel. Trigon has considered every functional design layout including various building heights, building sizes, number of buildings, the number of condominium units, parking spaces, elimination of amenities, storm water structures, building setbacks, site topography, utilities, as well as many other considerations. The heights of the proposed buildings are the maximum allowed by Town of Sunset Beach code. Trigon's civil engineers designed five layouts with different building sizes. The building footprint sizes could be changed; however, the proposed layout produces the maximum efficiency and least impact to the stream channel. The number of parking spaces and setbacks for structures are determined by Town of Sunset Beach code. We have provided an extraordinary effort to layout the site to minimize environmental impacts by examining each variable in the design process, maximizing the site layout efficiency, limiting T~ian~z you ~or our success. Ms. Noelle Lutheran, DWQ October 10, 2006 The Shoreline at Sunset Beach, Sunset Beach, North Carolina Trigon Project No. 042-OS-201 the number of parking spaces to the minimum allowed by the Town of Sunset Beach, working with the limitations of site topography, and allowing for setbacks, utilities, and storm water structures. We believe the proposed site layout, having been altered several times to meet regulatory requirements including Town of Sunset Beach, Brunswick County, and NCDENR, is the best use of the property to avoid additional environmental impacts with the fewest cumulative and secondary environmental impacts. The building sizes, number of buildings, and number of condominium units are by necessity a function of economic feasibility. The unit mix and building configuration is critical to the economic feasibility of the project. The fourth building, not only consisting of condominiums but, the clubhouse, swimming pool and recreation amenities for the residents, is a crucial component to the success and viability of the community. The initial proforma reflected the break-even point including ninety-five units. However, during the evolution of the project, many variables have affected the break-even point. Unexpected limitations and extenuating regulatory requirements have kept the project in a continuous state of flux. Should the building be eliminated, the amenities would either need to be disregarded or moved to another proposed structure. Either scenario would change the unit mix which in turn would revise the financial proforma. These are significant changes that would impact the project tremendously, rendering it financially unsound. Item 3: The site plan has been revised to reflect the USACE comments and is attached. Ms. Frye indicated that they are not currently providing jurisdictional determinations, and; therefore, the USACE has not returned a signed copy of the figure. BLOCK 18 Project Narrative: Project Description Construction of 4 - 3 story privately owned condominiums with associated parking, pool and drainage structures. Area of existing tract: 5.82 ac. Disturbed area: 5.91 ac. (includes right of way and drainage improvements for driveways.) Site Description The site is currently undeveloped with an average slope of 7%. The majority of the site drains to the east and to existing Long Creek Pond on the adjoining property. The existing vegetation consists of poorly maintained, grassed yard area with a few trees and brush scattered throughout the property and heavy brush located around the edges of the property along Long Creek Pond. This site receives off-site drainage from the north through an existing 12" pipe that discharges to an existing stream and drains into Long Creek Pond. Adjacent Property To the east, Long Creek Pond separates the property from a single family residential development. On the northeast property line the site adjoins a home owner's association office. The north, south and west property lines are right of way for public roads and NC-179 respectively. The surrounding area is mainly residential with some small business, recreational and municipal uses. Soils The soil on this site is mainly leon fine sand and pactolus fine sand. Topsoil is expected to be 4" or less with deeper concentrations in low areas. Average slope of site does not meet the profile for either soil due to the proximity to the stream and Long Creek Pond. Erosion Control Measures Erosion control measures on this site include a combination of sediment traps with temporary diversion berms, silt fence with silt fence outlets and two temporary construction entrances. In the initial phase of erosion control and construction, off-site drainage is routed around the site to facilitate the construction of measures on site without having to size those measures for the off-site drainage areas. In the second phase of erosion control and construction, the site is protected around the perimeter with a combination of sediment traps and sediment basins. Flow is directed to these by the use of diversion berms. Silt fence protects areas where drainage areas are small or the installation of a sediment trap or basin would interfere with the infiltration trench on the southwest side of the property. Silt fence outlets with excavated storage are used along silt fence in low areas to relieve pressure and trap sediment while preventing silt fence from being overtopped or washed out. Where existing underground utilities prevent excavation of storage, silt fence outlets are used without the, storage pit. the third phase of the erosion control plan is only to be used once the site is near completion of development and devices must be removed to allow for the completion of drive and parking areas. At this point in time the majority of the storm drainage shall be in place and inlet protection will be in place to filter sediment out before entering the storm drainage system. Silt fence and silt fence outlets will provide additional protection for areas where devices are removed. Storm Water Management To meet State and local storm water quality requirements and local peak flow reduction requirements, an underground storage and infiltration system has been designed for this site. The system consists of a reinforced concrete box containing an overflow weir to distribute flow to the system and allow storms with higher than design peak flows to discharge to the existing stream and an underground, open bottom, PVC detention system encased in washed stone and filter fabric to store design peak flows and provide infiltration to the well drained soils of the site. Water and Sewer Service Water service will be provided to the site from the Town of Sunset Beach and Brunswick County by means of an existing 12" waterline in the right of way of NC-179. Sewer service will be provided by Brunswick County with the installation of an 8" sanitary sewer line across the frontage of the site along NC-179 and Shore Line Drive and a sanitary sewer pump station adjoining the site. Design and construction of the sanitary sewer improvements will be by others. Please note that this decision does not assure that the payment will be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility of the applicant to contact these agencies to determine if payment to the NC EEP will be approved. This acceptance is valid for six months from the date of this letter. If we have not received a copy of the issued 404 Permit/401 Certification within this time frame, this acceptance will expire. It is the applicant's responsibility to send copies of the 404/401/CAMA permits to NC EEP. Once NC EEP receives a copy of the 404 Permit and/or the 401 Certification an invoice will be issued and payment must be made. Based on the information supplied by you the impacts that may require compensatory mitigation are summarized in the following table. The type and amount of the compensatory mitigation will be as specified in the Section 404 Permit and/or 401 Water Quality Certification, and/or CAMA Permit. The mitigation will be performed in accordance with the Memorandum of Understanding between the N. C. Department of Environment and Natural Resources and the U. S.
