The Town of Stovall received 1992 Community Development Block Grant (CDBG) funds to construct sewer lines to
serve residents of the Mountain Road Area of the Town. These funds will be combined with funding from USDA Rural
Economic & Community Services to construct sewer lines in the remaining areas of the Town and to construct a
wastewater treatment facility consisting of a lagoon and land application system.
I have enclosed a preliminary cost estimate for the construction of the sewer improvements in the Mountain Road Area
as well as a map identifying the Mountain Road Area and the location of the wastewater treatment facility. The Town
has previously prepared an Environmental Review for this project, however, the original site for the wastewater
treatment component has changed because of unacceptable absorption rates.
Due to the change in the location for the wastewater treatment facility, the Town of Stovall is required to reassess the
impact of this project in accordance with the National Environmental Policy Act (NEPA). Your assistance is requested
in determining the compliance of this project with the Flood Disaster Protection Act of 1973 (PL 93-234) and Imple-
mentary Regulations; Title 24, Chapter X, Subchapter B, National Flood Insurance Program (44 CFR 59-75); Execu-
tive Order 11988 and HUD Procedure for Floodplain Management (24 CFR Part 55; and Executive Order 11990--
Protection of Wetlands.

Dear Mr. Edwards:
Plans and specifications for the referenced project prepared by Recil H.
Wright, P.E., have been reviewed by engineers of this Section. The plans call for
the installation of approximately 22,500 feet of 12-inch water main, valves,
hydrants and other appurtenances along N.C. Highway 10 from Startown Highway to the
site of Blackburn Middle School. These plans and specifications are
approved under Division of Environmental Health serial number 96-10247, dated
September 25, 1995.
The proposed 12-inch water main will cross under the South Fork River. A
separate Section 404 Permit from the U.S. Army Corps of Engineers and a Section 401
Water Quality Certification from the North Carolina Division of Environmental
'Management (DEM) may -Be required. Please contact the DEM Mooresville Regional
Office at (704) 663-1699 and the U.S. Army Corps of Engineers Asheville Field office
at (704) 259-0014 to obtain the permits prior to commencement of construction.
Public water system rules require that a registered professional engineer
verify that construction has been completed in accordance with these approved plans
and specifications. In order to complete the approval of this water main extension,
please furnish us a copy of the engineer's verification affixed with his/her
professional engineering seal immediately upon completion of construction. Customer
connections shall not be made until the.construction verification letter is received
by this office.
One copy of the "Application for Approval..." is enclosed together with one
copy of the plans and specifications bearing the Division of Environmental Health
stamp of approval. One copy of each is being forwarded to our Mooresville Regional
Office. The third copy is being retained in our permanent files.

Dear Mr. Kroeger:
I am preparing an environmental assessment of the proposed
Rural Economic & Community Development/HOME rural rental housing
development adjacent to Littleton, North Carolina.
The development is a twenty-four (24) unit rental housing
development consisting of six (6) one bedroom units and eighteen
(18) two bedroom units. It will be located adjacent to Littleton
in Warren County, North Carolina on Oak Street Extension at the
Warren/Halifax County line on a 4.32 +/- acre site. The site is
currently wooded (planted pines approximately 5 to 8 years old)
with a sloping terrain. Adjacent properties consist of residential
dwellings and cut over woodland.
An environmental determination is to be made with regard to
the project's compliance with Executive order 11990 Protection of
Wetlands, and the Federal Water Pollution Control Act. I am
therefore requesting the appropriate environmental information that
may apply to the project area.
I have enclosed for your use a map indicating the location of
the project. Also, enclosed is a letter from the Town of Littleton
regarding the acceptance and treatment of the projects sewage.

Thank you for your letter dated August 10, 1995 requesting information on
environmental permits that may be required for the Rural Economic & Community
Development adjacent to Littleton, NC. The Water Quality Section of the Division of
Environmental Management can issue a section 401 water quality certification for any
activity that may result in a discharge to waters of the United States and that requires a
federal permit. The 401 Certification stipulates that the project is in compliance with
applicable state water quality standards.
The information you provided indicates that a 401 certification may not be required
since there may not be jurisdictional waters or wetlands on the project site.

Knowing (personally) how infrequently we (in DEM) get thank you's for good work, I
thought it appropriate to thank Max Haner for his work on the Arden Crossing shopping
center Certification. The design that was developed is a good example of how to do the 401

Subject: Review of sediment data from Hatteras Ferry Basin
The Aquatic Survey and Toxicology Unit has reviewed the information faxed to John Dorney and me
on this date. The table below lists the data presented and compares that information (for some of the
parameters) to "ER-L" and "ER-M" levels. These are terms used by the National Oceanic and
Atmospheric Administration (NOAA) as summary terms in their National Status and Trends Programl.
The values represent Effects Range-Low(ER-L) and Effects Range-Median(ER-M) values derived
from a broad literature search conducted by NOAA on the biological effects of sediment contaminants,
using dry weight composition, similar to the values reported for the ferry basin. EPA has suggested use
of these values as evaluation tools for sediment contamination2. Values below the ER-L (which
represents the 10th percentile of the data), are said to be in the "no effect range". Values between the
ER-L and ER-M(which represents the 50th percentile of the data) are said to be in the "possible effect
range". As you can see from the data, the values for which data are above detection and can be
compared to ER-L values would be interpreted as being below levels of concern. I hope this
information provides you with an acceptable evaluation. If we can provide further information or

We acknowledge receipt of your letter dated October 17, 1994 and wish to respond to your comments. It is
our understanding that the source of concern was the filling of a dry bed that was once a pond and had been
drained by a previous owner of the property. During the time that Soil and Environmental Consultants
performed their study, the pond existed but that subsequently and under prior ownership, the dike was
breached. l esting of this area by our geotechnical consultants after our purchase indicated no presence of
water or likely wetland conditions that would cause us to believe that wetlands existed. In fact, the area may
have no longer been a wetland. However, because S&EC did not re-evaluate the situation, we can not say for
certain.
Additionally, the four remaining issues or concerns have been addressed. A deed restriction wili be placed tha>_
prohibits respective home owners from additional wetland impacts. This item is currently being addressed as
part of the recorded covenants for the subdivision. A copy of the covenants will be forwarded to your office
for your use once they have been recorded.
The Town of Apex has resolved to provide a "city-owned greenway" as indicated on the site plan. A copy of
this plan is attached for your review and records.
In addition, site plans addressing the stormwater controls are also attached for your review.
It certainly has not been our intent to knowingly violate or circumvent rules and regulations regarding water
quality- We do, however, apologize for any inconvenience that this matter may have caused. Should you have
any questions in reference to this project, please do not hesitate to call.

Dear Mr. Steckler:
The Wetlands Group received an application for a 401 Water
Quality Certification for the subject project on September 22,
1994. The application requested certification for Nation Wide (NW)
Permits 12, 14, and 26, for a total impact to 2.69 acres of waters
and wetlands for the development of a residential subdivision.
Mr. Danny Smith of the Raleigh regional Office met with Soil
and Environmental Consultants, Inc. (S&EC), on October 10, 1994, to
evaluate the proposed impacts requested in this application. At
the time of the inspection Mr. Smith observed that greater than a
1/3 of an acre of impacts to waters and wetlands had been completed
prior to receipt,of the subject Water Quality Certification.
The 401 Water Quality Certification (WQC) is required by
Section 401 of the Clean Water Act for any activity that requires
a Section 404 permit. The WQC is a determination by the Division
that state water quality standards will not be violated by the
proposed activity. Due to the fact that the waters and wetlands
had been impacted, Mr. Smith was unable to fully evaluate the
wetlands and determine if water quality standards would be
protected. Therefore, you are hereby notified that you are in
violation of 15A 2H .0500. All work which impacts waters and
wetlands should immediately cease.
Please submit a written response to this Notice-of Violation
by November 15, 1994. This response should include a detailed
explanation regarding the cause and extent of the fill prior to the
401 Certification. Please note that this and other violations of

15A NCAC 2H .0500 can result in the assessment of civil penalties.
In addition to the aforementioned response, please address the
following issues or concerns noted below:
-As per your permit application, you have requested 0.90 acres
under a Nation Wide 12 (utility easements). Therefore,
impacts to wetlands (as noted on your site plan) are only
permitted for utility line easements, which are required to be
returned to grade after construction is completed. No
additional impacts to wetlands in these areas are approved and
no additional wetland impacts have been requested. As a
result, this office will require a deed restriction that
prohibits respective home owners from additional wetland
impacts.
-Lots which house wetlands that have not been proposed to be
impacted under NW 26, NW 12 or NW 14 should be avoided. A
deed restriction prohibiting respective home owners from
impacting these wetlands will also be required. Please supply
this office. with written conformation of deed restrictions,
and a site map with corresponding lot numbers.
-Please provide written confirmation by Town of Apex that
communicates their resolve to provide a conservation easement
or "city owned green-way" as indicated on the site plan.
-No information addressing stormwater controls was observed
in the subject site plans. If these plans are available,
please provide information that explains the location and
placement of stormwater outfalls (this should include the
presence of velocity dissipaters, etc.).
Your 401 Water Quality Certification is currently on hold.
This office will proceed with review of this project once the above
information has been received. If you have any questions
concerning this letter, please contact Mr. Danny Smith at (919)
