Utilization of Nationwide 12 (utility lines)
City of Concord, Westside Annexation Project

On 22 November 1995 you wrote to the Division of Environmental Management (DEM)
letting us know you plan to utilize Nationwide Permit 12 for your project to place fill in wetlands or
waters for the purpose of installing a sewer line running perpendicular to Crisco Road, south of Poplar
Tent in Cabarrus County. A written concurrence of the 401 Water Quality Certification is no longer
needed from DEM as long as certain conditions are followed (see attached). However, if the
conditions are not met, then a formal 401 application and Certification is required.

For clarification, condition number 2 which states that utility lines parallel to streams shall be
no closer than 10 feet to the stream is interpreted by DEM as referring to the edge of the construction
corridor rather than the actual utility line.

Gentlemen:

The purpose of this letter is to confirm our telephone conversation of
November 21, 1995, regarding our 401 permit application for the
referenced project. On our walk-through of the project held
approximately one month ago, we identified a section of proposed sewer
line running perpendicular to Crisco Road, south of Poplar Tent which
was routed through a wetlands area. We discussed moving the line away
from the stream bed to avoid the wetland area. It will not be possible
to do this and the additional wetland area to be affected is
1,500 square feet. A sketch of this area is attached for reference.
