The Application provides adequate assurance that the discharge of fill material into the waters of Pamlico Sound in conjunction with the proposed development in Dare County will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92- 500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. Condition(s) of Certification: That the activity be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction related discharge (50 NTUs in streams and rivers not designated as trout waters by DEM; 25 NTUs in all saltwater classes, and all lakes and reservoirs; 10 NTUs in trout waters). Violations of any condition herein set forth shall result in revocation of this Certification. This Certification shall become null and void unless the above conditions are made conditions of the Federal 404 and/or Coastal Area Management Act Permit. This Certification shall expire upon expiration of the 404 or CAMA permit. If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of Administrative Hearings, P.O. PROJECT SUMMARY: Applicant desires to construct 140 feet of marsh-level bulkhead and construct 300 feet of high-ground bulkhead along two man-made canals at Scott's Boatyard, Buxton Harbor, Buxton, Dare County. Michael Scott Field Report Page 2 SITE DESCRIPTION Michael Scott currently owns a one acre tract of land located north of Scott's Boatyard at the north end of George Gaskins Road, Buxton, Dare County, adjacent the Pamlico Sound. The property is bordered on the east and west by man-made canals and on the north by private property. The applicant owns a commercial boatyard to the south of the property upon which he performs maintenance and repair work on sport and commercial boats. The man-made canal on the east side of the applicant's property serves as water access to his boatyard. This canal has been regulary dredged and maintained to a depth of 5' below normal water level. The canal on the west side of the applicant's property is not used for water access and has shoaled over the years to depths of 1' to 2' below normal water level. Remnants of old, wooden bulkheads bulkheads exist along the shoreline of the canals on the applicant's property. Near the mouth of the eastern canal, a row of pilings exist in the canal as indication of an early wooden bulkhead. Along the middle of the applicant's property on this same canal are two newer, but deteriorated wooden bulkheads. These bulkheads were constructed to protect the same length of shoreline adjacent a single-family residential structure, one being waterward of the other. Because of the state of deterioration of these bulkheads, coastal wetlands exist along the shoreline landward of these structures. A one to two foot wide fringe of Spartina patens exists landward of the two bulkheads for a distance along the shoreline of approximately 100 feet. At the northern end of the two bulkheads a 120 ft2 area of Spartina alterniflora exists. Proceeding north toward the mouth of this canal, the row of old pilings forms a straight alignment from which the shoreline has eroded landward. A concave area extends landward from this row of pilings a maximum distance of 15 feet; this concave area spans approximately 90 feet of the applicants shoreline. The row of old pilings connects to the original wooden bulkhead wall which turns 90 ° and runs along the applicant's property line approximately 90 to reach the western man-made canal. As the western canal has not been mainatained, its depths are rather shallow and coastal wetlands along the shoreline are much more extensive. A band of Spartina alterniflora exists along the shoreline varying from 8' to 15' wide. A small pocket (150 ft2) of Juncus roemerianus exists just landward of the Spartina alterniflora on the northern corner of the applicant's property. As this area is near the mouth of the canal, it has experienced sever erosion from exposure to wave action of Pamlico Sound. Remnants of an old wooden bulkhead exist below the normal water level in the canal indicating the shoreline has eroded 40' to 50' landward. PROPOSED DEVELOPMENT The applicant desires to protect the shoreline of his property from further erosion. To this end he is seeking permission to construct bulkheading along the shoreline of both man- made canals. Along the eastern canal, the applicant desires to construct approximately 300 ft of bulkheading along the original bulkhead alignment as represented by the row of wooden pilings. This would place the new bulkhead 10' to 12' landward of the most landward of the two existing wooden bulkhead walls. This new bulkheading would also be positioned a maximum of 15' waterward of the shoreline along the concave portion of the shoreline near the mouth of the canal. Once the bulkhead was constructed, the applicant indicates he would remove the two bulkhead walls and excavate the material waterward of the new bulkheading down to the depth of the man-made canal. The shallow water habitat located landward of the new bulkheading along the cove area would be filled once the bulkheading was constructed. Along the western man-made canal the applicant desires to protect and enhance the existing coastal wetlands. To achieve this the applicant proposes to construct approximately 140' of either marsh-height bulkheading or bulkheading with open spaces. The applicant is open to either type of bulkheading which would achieve his goal of preserving the wetlands and shoreline. This bulkhead is planned to be constructed from 5' to 25' waterward of the marsh edge. The proposed bulkhead would tie into the existing deteriorated wooden bulkheading on the applicant's northern property line and to the bulkheading along the middle of the applicant's shoreline. No fill would be placed landward of this bulkhead wall. However, the applicant does desire to fill a small area (approx. 25 W) of Spartina alterniflora wetlands in order to maintain an access easement to the private property north of his property. The applicant hopes that wetland vegetation will increase between his planned bulkhead (either marsh-height or open bulkhead) and the existing wetlands. He seeks agency advice to achieve this end. PROJECT IMPACTS Approximately 300 ft2 of Spartina patens and Spartina altemiflora will be excavated from that area lying waterward of the proposed bulkheading on the eastern canal. Approximately 225 ft2 of the same wetlands will be filled when the bulkheading is constructed and backfilled along the concave shoreline on the eastern canal. This backfilling activity will also fill approximately 675 ft2 of shallow water habitat. Approximately 280 ft2 of shallow water habitat in the western canal will be disturbed during the construction of the marsh-height or open bulkhead. Twenty-five square feet of Spartina alterniflora will be filled along the western canal shoreline in order to maintain an access easement. The bulkheading proposed in the western canal (whether marsh-height or bulkheading with gaps) should serve to protect the existing wetlands and allow wetlands to expand into the shallow water of the man-made canal. An accurate work plat (including plan view and cross sectional drawings) drawn to scale in black ink on an 8 1/2 x 11 white paper. (Refer to Coastal Resources Commission Rule 7J.0203 for a detailed description.) Please note that original drawings are preferred and only high quality copies will be accepted. Blue-line prints or other larger plats are acceptable only if 18 high quality copies are provided by applicant. (Contact the U.S. Army Corps of Engineers regarding that agency's use of larger drawings.) A site or location map is a part of plat requirements and it must be sufficiently detailed to guide agency personnel unfamiliar with the area to the site. The property is bordered on the east and west by man-made canals and on the north by private property. The applicant owns a commercial boatyard to the south of the property upon which he performs maintenance and repair work on sport and commercial boats. The man-made canal on the east side of the applicant's property serves as water access to his boatyard. This canal has been regulary dredged and maintained to a depth of 5' below normal water level. The canal on the west side of the applicant's property is not used for water access and has shoaled over the years to depths of 1' to 2' below normal water level. Remnants of old, wooden bulkheads bulkheads exist along the shoreline of the canals on the applicant's property. Near the mouth of the eastern canal, a row of pilings exist in the canal as indication of an early Wooden bulkhead. Along the middle of the applicant's property on this same canal are two newer, but deteriorated wooden bulkheads. These bulkheads were constructed to protect the same length of shoreline adjacent a single-family residential structure, one being waterward of the other. Because of the state of deterioration of these bulkheads, coastal wetlands exist along the shoreline landward of these structures. A one to two foot wide fringe of Spartina patens exists landward of the two bulkheads for a distance along the shoreline of approximately 100 feet. At the northern end of the two bulkheads a 120 ft2 area of S2artina alterniflora exists. Proceeding north toward the mouth of this canal, the row of old pilings forms a straight alignment from which the shoreline has eroded landward. A concave area extends landward from this row of pilings a maximum distance of 15 feet; this concave area spans approximately 90 feet of the applicants shoreline. The row of old pilings connects to the original wooden bulkhead wall which turns 90 ° and runs along the applicant's property line approximately 90 to reach the western man-made canal. As the western canal has not been mainatained, its depths are rather shallow and coastal wetlands along the shoreline are much more extensive. A band of Spartina alterniflora exists along the shoreline varying from 8' to 15' wide. A small pocket (150 ft2) of Juncus roemerianus exists just landward of the Spartina alterniflora on the northern corner of the applicant's property. As this area is near the mouth of the canal, it has experienced sever erosion from exposure to wave action of Pamlico Sound. Remnants of an old wooden bulkhead exist below the normal water level in the canal indicating the shoreline has eroded 40' to 50' landward. The applicant desires to protect the shoreline of his property from further erosion. To this end he is seeking permission to construct bulkheading along the shoreline of both man- made canals. Along the eastern canal, the applicant desires to construct approximately 300 ft of bulkheading along the original bulkhead alignment as represented by the row of wooden pilings. This would place the new bulkhead 10' to 12' landward of the most landward of the two existing wooden bulkhead walls. This new bulkheading would also be positioned a maximum of 15' waterward of the shoreline along the concave portion of the shoreline near the mouth of the canal. Once the bulkhead was constructed, the applicant indicates he would down to the depth of the man-made canal. The shallow water habitat located landward of the new bulkheading along the cove area would be filled once the bulkheading was constructed. Along the western man-made canal the applicant desires to protect and enhance the existing coastal wetlands. To achieve this the applicant proposes to construct approximately 140' of either marsh-height bulkheading or bulkheading with open spaces. The applicant is open to either type of bulkheading which would achieve his goal of preserving the wetlands and shoreline. This bulkhead is planned to be constructed from 5' to 25' waterward of the marsh edge. The proposed bulkhead would tie into the existing deteriorated wooden bulkheading on the applicant's northern property line and to the bulkheading along the middle of the applicant's shoreline. No fill would be placed landward of this bulkhead wall. However, the applicant.-does desire to filk a small area (approx. 25 ft2) of Spartina alterniflora wetlands in order to maintain an access easement to the private property north of his property. The applicant hopes that wetland vegetation will increase between his planned bulkhead (either marsh-height or open bulkhead) and the existing wetlands. He seeks agency advice to achieve this end. Approximately 300 ft2 of Spartina patens and Spartina alterniflora will be excavated from that area lying waterward of the proposed bulkheading on the eastern canal. Approximately 225 ft2 of the same wetlands will be filled when the bulkheading is constructed and backfilled along the concave shoreline on the eastern canal. This backfilling activity will also fill approximately 675 ft2 of shallow water habitat. Approximately 280 ft2 of shallow water habitat in the western canal will be disturbed during the construction of the marsh-height or open bulkhead. Twenty-five square feet of Snartina alterniflora will be filled along the western canal shoreline in order to maintain an access easement. The bulkheading proposed in the western canal (whether marsh-height or bulkheading with gaps) should serve to protect the existing wetlands and allow wetlands to expand into the shallow water oF the man-made canal.
